    Can you talk about the recent changes at NAR and how buyer's agents can no longer depend on being compensated by the seller?

      Sure! First off the National Association of Realtors is STILL fighting their lawsuit. The case has not been settled or closed. Several brokerage firms have settled on other cases and are changing the way they conduct business. The challenge currently being fought with NAR is that buyers do not have transparency regarding buyer's agent's commission amounts which could ultimately effect the price of the home they are purchasing. Buyers don't get a fair crack at negotiating the price of the house because the price of the house is already padded with the buyer's commission in mind (the seller pays both the listing agent and the buyer's agent's commission in most transactions). In the past, the buyers compensation was not disclosed to the buyer in any documents. Some brokerages are requiring buyer broker agreement, where the buyer is responsible for paying their own representation in a transaction. The payment of buyer's agent commission would be agreed upon upfront...the buyer's agent's commission would be paid through escrow. You will notice on most real estate websites, the buyer's commission is now disclosed. No matter what happens with the NAR lawsuit, they can always appeal. This could take several years to change procedures. However, most brokerage firms are already making changes (buyer/broker agreements in place) so they avoid any further exposure. Hope that helps:)

    What if you own your home & hold the title? Do you save money when closing?

      No, unfortunately. What you are paying the title company for is to ensure that the property can convey without any liens or encumbrances. It really title insurance. The title company is guaranteeing that the property can transfer. Great question.

    Hi Audra, I've been enjoying your content. I recently inherited my mother's property after her passing and she had a reverse mortgage. Could you speak to how a seller deals with them and advise if I wanted to keep the house and rent it out.

      Hello there! Appreciate your patience with my slow response. If you would like to sell the house, you just have to have enough equity in the property to cover the balance on the reverse mortgage. If you would like to keep the house and/or rent it, you would have to refinance the existing reverse mortgage amount. As soon as a death occurs, typically the reverse mortgage company will want what's due to them...so they will want you to refinance or sell the property so they can get paid. Every reverse mortgage is set up a bit different. You will want to understand the terms of the reverse mortgage. Best of luck to you.

    This video was so helpful! What if you were inherited a house many years ago and are not sure how much your cost basis is. My agent told me she can't tell me the true cost basis but she printed out how much homes sold in my area at the time l received property. How do I get an official number I can use when reporting my taxes? Thanks!

      Hello there! I would definitely talk to a CPA. They are the experts in giving advice on how to file taxes. It does get a bit tricky. However, if you inherited a property, you may not need to worry about it (I'd check with a CPA for sure on this topic).

    Can you talk about buyers asking for credits and what do seller have to fixed?

      Hi Kristin, that is a great topic. I will do a video on it. First off, I don't like my sellers doing repairs. You run the risk at closing day if the buyer is satisfied with the repair (happens all the time). The house is going to be the buyers eventually, they should have their own contractors working on the house...this limits liability to you as the seller. I would always recommend a credit over an agreed upon repair request. However, in all of my offer I write in the contract the "seller will make no repairs and/or credits." Sometimes you as the seller will need to comply to get the deal done...its always a good idea to get a home inspection upfront to limit the amount of repairs negotiated. Hope this helps...but will do a more comprehensive explanation in an upcoming video. Thanks for your question.

    What should be course of action if both seller and seller agent blatantly hid many issues and caused undue problems for the buyer in a market where waiving inspection was the norm.

      The only thing you can do is hire your own legal counsel and fight them. You would definitely want to prove they intentionally hid and did not disclose items they should have. If you can do that, then you more than likely have a case. The question is how much is it going to cost to go forward. It may be worth it for you. So sorry to hear this. Breaks my heart.

    Does the buyer or seller pay the closing cost, or those cost split. The last house I sold I felt I paid for everything.

      Hello There! Both the buyer and the seller pay their own closing costs (typically). If you are the seller you carry the burden of the costs because you are paying the commissions for both the buyers and listing agent. Its costs a lot of money to sell a home.

      If you are a seller, I would say 7-8% and if you are a buyer 2% ish. 10% is a bit on the high side...at least in my area.

    Audra, getting ready to sell my home. It seems realtors in my area are charging the 6% commission rate. But in your video it show 5%. Could I negotiate a 5% or 5.5% with my realtor? Also I don't really know what else (in terms of cost or services) can be negotiated with them. Please help! I'm just assuming I will be responsible for all these costs as a seller.

      First off, I would ask each realtor you are interview with for an itemized Net Sheet. This is very important. You should be paying NOTHING but the agreed upon commission. Not sure what area you are from, but there is no set commission structure. I would write into the listing contact that you want high quality drone and standard photos, video , property brochures...high quality. Most agents don't offer this in my experience because its expensive. Everything is negotiable. It certainly can't hurt to ask for a reduction is commission...but just be careful they don't cut the important marketing that helps sell your house. If they aren't doing anything extra (like staging a home), I would ask for a discount. If they say no...oh well, you tried. Also, the agents that reduce their commission too quickly isn't good either. If they are going to give up commission quickly, they may give up quickly in the negotiations on your property too. There should be a clear front runner as you are interviewing these agent. If not, keep interviewing. You can also ask them to give a complimentary appraisal, home inspection, and/or staging. They aren't going to like it, but who cares. You are negotiating for yourself. I would also do your research on the escrow company the agent is recommending. I would definitely ask the escrow company for a discount (not sure if your area uses escrow companies). I ask for discounts all the time. The worse that can happen is they say no. At the end of the day, this is a business transaction. Treat it a such. Hope that helps.

      Yes! I would say most of the homes in California have an HOA. 30%-ish do not. Really depends on the area.

      I love all pets...and yes the unconventional ones too. However, when I am showing properties that have glass enclosures for those unconventional pets, the visitors usually flock to the aquariums trying to look or find these critters. It takes the focus off the home and onto the pets. I don't love that. I recommend my clients purchase a decorative screen to keep the pets hidden or cover the enclosures when visitors arrive. You want the focus to be on the property not what's living in it. In my area we have warm weather around the year. I do recommend my clients relocate their pets into the garage as to not distract from the showing process. I understand that can't be accomplished in some areas...but not a bad idea if you have a garage and/or warmer weather. Best of luck to you! Thanks for watching my videos.
