    While it seems unfair that the defendants drove the car free for 6 months, the verdict is about making the victim whole. She has the car back and with the repair costs awarded to her, the car will be worth what it should be worth and the plaintiff will have the asset of $1,250, technically more than what she sold it for. Had the defendants kept the car, JJ would have awarded her the money for what she sold it for, $1,200.

    I don't think the defendants should've gotten to drive a car around for six months for free but it was the plaintiff's responsibility to repossess the car after the first non payment and she didn't so it might not necessarily be fair but Judge Judy was absolutely on the law when she didn't award her compensation and this is a court of law not a court of what's "fair"~ She didn't ask for it in her case anyways, just the value of the car~

  • @maxval5933
    @maxval5933 Před rokem +31

    I don't agree with this judgment. I know JJ was trying to "make the plaintiff whole", but the truth is that making her whole means that the defendants borrowed and used the car for six months without paying anything. In cases where the sale of a car gets revoked, the buyer should pay for the time they used it as if the car had been rented. Otherwise, there's an unjust enrichment from the defendants because plaintiff fulfilled her obligation ("to deliver the goods"), and defendants gave nothing to her while still benefitting from the use of the goods.
    Btw: I know that JJ probably didn't give her a judgment for the use of the car because JJ didn't want plaintiff to get an amount of money that resembled the total value of the car while still keeping the car. However, the unjust enrichment still happens.

    • @xoxjanjounxox
      @xoxjanjounxox Před rokem +1

      She should have gave the defendants the car and the title and the plaintiff the money. That would have been fair.

    • @CameronL211
      @CameronL211 Před rokem +3

      Not how it works bud, she sold it for $1200 and got it back and now with the repairs it’s still work $1250 thus she lost nothing. If u get a car repossessed you still will not have to pay the outstanding balance. I do however think they should have paid for the alignment but judge Judy probably is thinking, it most likely was not aligned before they got it and with the age there’s a good chance it wasn’t.

    • @ClaudiaSilvaTorres
      @ClaudiaSilvaTorres Před rokem +1

      You are absolutely right, i even saw another case where she gave the plaintiff money for the time the defendents used the car, as if it was rented, so i don't get why in a case where the situation is the same, the rulling is different.

    • @xoxjanjounxox
      @xoxjanjounxox Před rokem

      @@ClaudiaSilvaTorres maybe the car was worth more in that case. I saw a case where the defendants were making payments and they did not get back their money..

    • @maxval5933
      @maxval5933 Před rokem +1

      @@CameronL211 When you get a car repossessed you don't have to pay the outstanding balance, but while you had the car, you paid for it; that's the whole point. Defendants in this case paid absolutely nothing. Plaintiff may not have lost any money (which is what JJ meant by "making her whole"), but the doctrine of unjust enrichment still applies. Plaintiff lost all the mileage that the defendants used and received nothing for it. If this had been a rental and not a sale, you wouldn't think that plaintiff "lost nothing". In that scenario, if defendants had paid nothing (like they did in this case), and if plaintiff had received back the car plus damages (like she did in this case), you would still think that defendants should pay for the rent while they used the car.
