- The plaintiff used to rent a home from the defendant. The plaintiff claims she won’t return his security deposit, so he’s suing. The defendant argues the plaintiff purposefully damaged the home and stopped paying rent, so she has every right to hold his deposit.

Section 8 needs to be reviewed and revamped.
As a landlord, I have rented to people who are on section 8. It can be a good thing until you end up with a tenant like this. First of all, section 8 pays the majority of your rent plus gives you a credit for the utilities that you are responsible for paying. That amount is subtracted from the rent that you would have to pay, which is only 33.3% of your income. If you don't pay your rent, then you can and will be thrown off the program and replaced by someone who will. If you trash the place, section 8 pays the difference between your security deposit and the cost of damages, and of course, you get thrown off the program, but this time for life. I'm not sure how section 8 is run in other states, but I actually like renting my homes and apartments to section 8 holders. I'm guaranteed that most of the rent will be paid on time, and I know that if my property is destroyed that it will be taken care of without a fight.
Of course, I also take care of my properties, and I do regular inspections and maintenance. I don't wait for the tenant to call me and tell me that the furnace, a/c, waterheater, etc, is broken. I maintain everything in my properties, so I don't have any major issues. I try to keep them nice so that the tenants will also want to keep it nice. I think too many landlords are just there to collect the money. They need to remember that their tenants pay them to live in their property, which usually makes the mortgage payment, no tenants, no mortgage payment, equals no property. They deserve to have a house that they can be proud to call their home. It's the landlords property, but it's their home, and without them, a lot of landlords would lose their properties. It all comes down to RESPECT. Respect each other and work together, and you'll find that you have tenants and landlords that are actually happy. Tenants aren't just a business arrangement. Their real people with real problems, sometimes the landlords forget that. If you can't make your mortgage payments without the rent payments, then you need to find a different way to make money because life happens and if you're going to kick them out if they're 5 days late you're going to go through a lot of tenants. I'd rather have happy tenants who aren't overcharged for rent and stay in my properties for a long time (I have a waiting list), then have overpriced properties and tenants who don't care because I don't care.

Why did he think he would get his security deposit back if he stayed until March, when he was supposed to leave in January?
He's lucky she didn’t countersue for February and March and the repairs that the security deposit didn’t cover

I'm on section 8. If you don't have enough to pay your rent because you loose your income it's your job to go to section 8 and ask them to redo the rent amount based on your income. You are still responsible for the rent that you are suppose to be paying until section 8 makes there determination. If you over pay the landlord can either use the over pay on months that continue your lease or give you it back. I had 3 months free rent due to overpayment. You have to stay on top of your stuff.

Him being a jerk actually has nothing to do with Section 8. Most people do not understand that Section 8 is very strict and has lots of rules and regulations that must be followed by the tenant and the landlord. There are crappy tenants and landlords regardless of whether they receive subsidy or accept subsidy. Yes, some may take advantage of the system, but when they do, they are terminated from the program.
The boldness of individuals believing they can exploit landlords, despite being aware of their own wrongdoing.
