- You may have heard of the Menendez Brothers and their controversial past, when news broke about the brothers murdering their rich parents and then they stunned police when they confessed to the murders. This story gets weirder and in today's amazing video we look at the trial of the Menendez Brothers and if they possibly could have been innocent, or is this just an open and shut case of spoiled brats who got in over their heads.

Didnt the doctor breach the confidentiality by telling his mistress???
Yes, however doctors are allowed to break confidentiality if there are dangers to yourself or others. Strange he didn't report to police, instead just telling his mistress.
Yes but if a patient confesses to a violent crime (that they have committed or will commit) patient confidentiality no longer applies.
He did. The narrator contradicted himself - I was just about to point out the same thing.
@@adaminflux That varies depending on the crime I'm pretty sure. There are some violent crimes that they don't break confidentiality on, but some they have to report.
Beauty on a Barn Budget It's not a gray area. It's pretty cut and dry. If someone confesses to a crime, that confidentiality goes out the window and the therapist is legally obligated to go to the police. It's a law.

This right here is something people still seem to not understand. The brothers had grown up wealthy and were always used to spending money like it was water. The excessive spending after the killings is indicative of PTSD and one of the ways in which people deal with their trauma and grief. I don't know why people use the spending as an argument for their guilt. I could maybe buy that argument if the brothers had grown up in poor or average wealth but even then it's a stretch.

Wouldn't the psychologist telling his mistress about the confession be breaking doctor patient confidentiality?
@Mary Gomes when the patient confesses to a violent crime and have hurt others in said crime patient confidentiality doesnât apply donât quote me tho no completely sure
The reason why they allowed it was that the state said that once they threatened the doctor to stay quiet that it cancelled the patient doctor agreement. So everything after that was admissable in court. So they allowed the tapes after the threat.
Dr's are mandatory reporters, but that applies to telling the police, social services, etc. So yes, technically that did break confidentiality. But once they threatened him, it gave him the right to talk about the situation according to the police.

Both were over 18 at the time of the murders. They may have been their parents' children, but why is the video calling two adult offenders boys?
Damali Dixon itâs a defense that lawyers/press use, usually on white wealthy men over 18. The children of wealthy parents. The same way the press use it on the Trump sons. Itâs a way to build a defense that they are just naive boys, whom are worthy of redemption. Whom make mistakes but have promised future. Versus minority young men. We are considered an adult at 16 and referred to as men.
Also, many psychologists that have done interviews with them said that when Lyle was 21ish his emotional age/ maturity was of a twelve-year-old, and Erik's, when he was 18) was of an eight or nine-year-old due to their trauma

this fact can be incredibly hard for survivors to process when theyâve tried to disclose abuse to someone only to be given a skeptical eyebrow raise in response, not feeling believed, as a survivor, is something
thatâs going to crush someoneâs motivation to seek help, when your support system doesnât believe you, you really begin to feel like youâre not worthwhile.
What the brothers did to their parents was bad, but what the parents did to their kids was pure evil. The dad sexually and mentally abused the boys very frequently while the mother did nothing to stop him and even contributed to the mental abuse. The parents had it coming for them. The boys may have had many different ways to handle the situation but the constant fear that their dad would ruin their lives if they filed a report (the dad literally told them this) would have been immense. The boys could have handled this much better, such as not going on a money spending spree and admitting right away, but you cant blame them for trying to get revenge on their parents and the amount of anger that they felt. In the end, they dont deserve life sentences without parole, they deserve 10 years and therapy. They should be out by now. But its even sad to see that the brothers dont really mind prison, as they would be content with any life without their parents. I hope their appeal this year goes well.
