    What is going on everybody, this is TGA, today, joined by ‪@CJAuditsAuditingNI‬. And in today's video, we conduct a silent audit, at Gloucestershire Police Headquarters in Quedgeley, just on the outskirts of Gloucester, in support of ‪@DJEMEDIA‬. Hope you all enjoy.

    The 2 uniformed officers were great and handled the auditors with respect without threats or aggro, completely opposite to the security guard and officer in training gear. No mention of aggregated trespass from them, accepted filming without question. 👏

    I think this worked a treat.
    I'm subscribed and member to DJE Media.
    But i do think he talks a bit too much at times and digs himself in occasionally.
    Your approach put them on the back foot.
    And although the two that took over and showed you around were great.
    I think keeping silent they gave you more than if you had opened your mouths.
    As they were over compensating the silence with a more thorough guide.
    CJ was funny as fook in this.
    Top audit fellas.

    Awkward to watch for me as I felt bad for the officers, it must have been an uncomfortable interaction with people being silent. The officers were very professional.

    They do not understand consent in the law. Consent cannot be given nor be taken away, this is simply because everyone has the same rights.
    Consent taken away for example in criminal proceedings if you take someone's life. That's one example.
    Also, the sergeant was a genuine great man. Like police used to be like.

    Well done lads the Silent audits are very effective for allowing incompetent personal to run their mouths . So the plain clothes who failed to id is under the impression that if a member of the public fails to be answerable to him he will incite mental health issues .
    Big up the Officers at the end ,courteous and professional towards us the viewing public .Imagining you addressing all of us when the camera is rolling is best practice .

    The irony of the title: not moving from a property will lead to aggravated trespass 🤣
    I can guarantee that none of them know what they are talking about when they make the threat of aggravated trespass-there are conditions to be met of which 99% of situations we witness don't apply.
    Silence is golden,as was the audit!

      Guaranteed they’ve never read the legislation. This legislation is aimed at travellers occupying land. There’s no way an auditor would reach the threshold for aggravated trespass.

      ​@@DMC888I think you should read the other part of the legislation that refers to people causing an aggravated trespass from a civil trespass, not the legislation regarding mass trespass such as travellers, where the law has a specific act for.

      @@DMC888 All you have to do is refuse to leave when asked, this becomes obstruction which is one of the criteria's that make it aggravated trespass.

    Kudos to the Sergeant - even though he was up against the silent audit he was very professional & handled the situation spot on. The constable straight away shook hands - again the way policing used to be done. Thank you, sergeant, for the tour and explaining the police vehicles / equipment. Cheers from the outback 🦘🦘🦘

    I'm not a fond lover of the police in general (I do have my personal reasons), but the 2 officers giving the 'tour' were so polite,curtious & professional. I never thought I'd say this..!
    Lets hope this video is shown to all police forces & officers to show this is the correct way to interact with the public, i mean, we are policed by consent, paid for by our taxes. Those 2 officers are a model of how modern day policing should always be conducted.
    At no point were the auditors threatening toward anyone. Glad you guy's exercised you silence. I would've happily lost the £5 bet to actually thank them for being so professional.

    6:20 an open gate is not an implied right of access, an implied right of access requires you to believe that the occupier wishes you to access on the “implication “ that you have a legitimate reason to enter

      @@johncummins3860 I’m not sure …. it doesn’t matter though as they weren’t going to the reception even if there was one. And even if they did, the occupier cannot reasonably be assumed to want them to enter so they can go to reception and film the staff.

    They're all police in the same place under the same laws. How can one tell you to leave and there's no videoing allowed, another wants your ID and says you can't be there, and yet another says he dosen't want your details and says he's happy for you to film and offers a tour ?????? No wonder they don't know their arse from their elbows, but it's always the public that suffer for their inadequacies.

    section 64A
    (1A) be photographed elsewhere than at a police station-
    (a) with the appropriate consent
    case law Wood v Commissioner of police (2009)
    unless ((1B) is in place
    (a) arrest
    but Sgt has informed of BWV = consent is given , as
    (b) if the appropriate consent is withheld ... hence 🤐

      Uh? This doesn't say what you claim. Wood v Commissioner of police (2009) makes it clear that photos/video is lawful under common law. Section 64A of PACE does not state that photos/video must not be captured without consent, it simply states when it CAN be done.

      @@TheBILLANDERSON I assume you mean "retain", and they actually covered both aspects of taking and retaining. And yes, I do agree that they found it was unlawful to "retain" them, but the "taking" of them they found to be fully legal under common law. Providing the photos/video are deleted in a reasonable amount of time, then it is compatible with Article 8(2) of ECHR and GDPR. You have misunderstood the relevant part of PACE, you are right that it states when they MAY photograph, but that doesn't mean they MUST NOT in other circumstances. The common law right to film in public (as there is no expectation of privacy) that you have, is the same right they have. If, however, you invite them into your dwelling and they are wearing BWV, they have no right to film/photograph you UNLESS you either give permission or it is one of the conditions covered under PACE.

Where did the retention element of your point get introduced, and how is that relevant to the original comment you made?
      Do you agree that *filming* in a public place, by the police, is not limited by PACE D5.12A and the case law you referenced supports that recording is fine.
