  • Today, Craig is going to wrap up our discussion of discrimination by looking more closely at those “discrete and insular minorities” referenced in the 14th Amendment. We’ll talk about instances of discrimination of Asian, European, and Latino immigrants, Native Americans, non-English speakers, people with disabilities, and LGBT people. We’ll also talk about federal and state responses to this discrimination. It’s a lot to cover, and we’ll only scratch the surface of the battles these groups fought (and are still fighting) for equality, but we will give you some historical context for the discrimination that has occurred and the court decisioned made to help defend these groups.

      ***** What arguments? "Illegals deserve nothing, because they broke the law"? Have you thought about *why* they broke the law. Have you ever tried putting yourself in their shoes? Are you over 16 years old, aka have you realized that people do things because life circumstances just demand it, and not because you think "mwahaha! I'm going to live in poor housing conditions with minimal legal rights in America, making pennies, just to steal away everyones jobs!"
      Honestly. Unlike the vast majority of youtube commenters, I've studied history, I've studied history, and I care about being a moral person who doesn't wish to die on their death bed knowing they just spent their life hating others instead of helping them.

      Le Fedora Lord - The law is a thing created by humans. People shouldn't be punished for wanting better lives for themselves just because they broke some construct to get it.
      Inorganic Vegan Okay, I'm getting increasingly more and more annoyed at people who say "I'm part of x minority, and I think [insert opinion that says that no discrimination is happening]" It's okay for you to have that opinion, but your minority status is not a credential when 95% of the people in that minority group with you are disagreeing with you and it's obvious your life experiences are unusual.
      As for your point about the SAT- what are you even talking about? Blacks don't get 300 extra points. You're literally making that up. Also, Asians don't get -50, seeing as there are plenty of Asian students who get perfect scores.
      If you're exaggerating the role of affirmative action and are saying you're against it, let me quote Lyndon B Johnson:
      "You do not take a person who, for years, has been hobbled by chains and liberate him, bring him up to the starting line of a race and then say you are free to compete with all the others, and still just believe that you have been completely fair."

We addressed some of this in our Equal Protection episode , but we understand it's not just an historical issue. This stuff is happening now. This video is about giving an overview of some of the remedies we've put in place for discrimination. The takeaway from our videos on discrimination is that we still have a long way to go to address these problems. -stan

      +Inorganic Vegan Discrimination against anyone based on color of skin and in some cases nationality is still racism. Whether the group being singled out is African-American, Caucasian, Latino, Asian, or Middle-Eastern, it's always racism.

    I'm glad these explanations of discrimination are done (mostly) unemotionally.
    if someone uses illogical or ad hominem attacks while trying to defend their argument then the opposing side stops listening and merely shouts back their own rhetoric.
    These videos are presented really well and attempt to avoid making judgements themselves so I think they get the information across way more successfully than other people who shout and scream

      +Jacob Shepley Well, even if this method is 10 times more effective, 0*10 is still zero. Reason and argument are very very overhyped, sadly. On the whol,e aside from the rare exception, humans are not a reasonable and rational species. That's why even well made arguments like this video have very little effect on how people see the world.

      +1234kalmar I think you need to think about how the effectiveness is measured. I don't think that Crash Course is trying to push some political agenda despite their affiliation with PBS who're pretty well known to push an extreme left viewpoint.
      If information is conveyed then the videos are successful. There's been nothing in any of these videos that would make me change my political stances, but there's lots of information, and it helps to get a better understanding of the political context.
      What these guys are doing is great. I know they're politically left leaning, but they're putting a good effort into not letting that get in the way - it'd be a shame to see them take a walk down propaganda lane like a few similar channels have done.

      1234kalmar No of course that's not what I meant. The extreme leftist idea that's pretty prevalent in internet celebrities is mandating peoples behaviour. No need to name-call over that.
      All I said was that I'm glad that the Crash Course guys don't taint their videos with their political opinions. The fact that I can only recall a few videos where the political alignment of any of the guys from Crash Course is a great thing. It allows me to consider them an unbiased source of information - this is a compliment to them.
      And using reason is the only way to convince people. Yes some people can't be convinced, but I'd hardly even be an individual if not for some very reasonable arguments from who at the time I thought were just trolls on The Internet.

    My school has seriously failed at the thing about the language. There is a boy in my grade who cannot speak english very well, and instead of using something like google translate, my teachers just constantly get angry at him. He does break obvious rules that he can even understand often, which pisses me off, but the fact that my school is so mean to him also pisses me off

      +R3Testa I think it's that they're not an illegal immigrant, but they're an immigrant who immigrated illegally.
      It's semantics, but basically the person themselves isn't illegal - their actions were.

      The same logic applies to anything a person might do illegally, so what doesn't "make sense" is to apply the word to the person rather than the action. Forcing everyone to change the short phrase "illegal [actor]" to the tortuous "[actor] who [acted] illegally" is just an attempt to disguise the illegality of the action through changing language, and makes as much sense as requiring that a sentence never end with a preposition.
      SAYING it "doesn't make sense" is trying to hide that illegality through ridicule of people using the established convenience of the phrase.

    As other have noticed I am somewhat surprised that there was no mentioning of the African Americans population. I am aware that the history of violence committed against them extends far beyond discrimination, but it still seems worth mentioning Jim Crow or something along those lines.

    This year the Arkansas legislature passed a law prohibiting anti-discrimination ordinances. This month the biggest city in my region passed an anti-discrimination ordinance. So the ordinance should stand and the legislature shouldn't have done did that?

    I didn't actually know that statistic about disability. It's actually incredibly depressing because I'm disabled and looking for work after graduating. I know that my girlfriend, who is also disabled, has definitely seen this kind of discrimination already but I thought it was a lot smaller scale than that statistic implies.

    At 1:00 Crash Course describes how the 14th Amendment protects citizens from discrimination. As an example of how "that being said" certain ethnic groups have been targets of unfair treatment, the video then cites laws designed to exclude immigrants from particular ethnic groups. I think it should make it clear that such laws didn't violate the 14th Amendment, if that Amendment protected only American citizens, and not foreigners, from discrimination.

      The constitution, and it's amendments, are seen as the most basic rights, and apply to anyone within the U.S.

      A. E. Cooper But they don't, do they? If I visit America, I can be deported, I can't vote, etc., which an American citizen cannot. Now, in America, I have the right to due process, and to have no discrimination in relation to my race, sexuality, and gender - but I can be 'discriminated against' as a non-citizen, and I can be 'discriminated against' as a citizen of a specific country. For instance, if the US goes to war with the UK, and I'm in the USA, I can be deported, or interned.

      I think it was brought up as a point of debate as to whether they should be protected because this is heavily debated and is worth discussing.

    A well regulated Militia being necessary for the security of a free State, the right of the People to keep and bear arms shall not be infringed. What people don't understand is that it says Right of the People in contradiction to the Militia and shall not be infringed meaning nicked away in any part.

    As a disabled person I think society has a long way to come until we are properly included into society I’m from a town in the uk and not a lot of buildings are accessible this is against the equality act but no one seems to care I can’t access a specific night club and banks and other buildings it’s time to make a change people and be more Inclusive of minority groups

    Supreme Court essential created legislation from the bench in the gay marriage ruling, I believe that it should have been up to the states, as marriage laws have alway been decided by the states. It is called federalism, some laws are made by the federal lv and states keep some of sovereignty as established by the 9th and 10th amendment.

    Stan, You used the full four letter LGBT acronym and cited several examples of sexual discrimination precedent. You missed the fourth letter. Trans people are discriminated against far more than GLB people and far fewer laws exist to protect trans people. That would have been a stronger message.

    In regards to disabilities we must realize that those with disabilities are often unable to do jobs--and thus aren't hired.
