    The Victim Mr.Ajay could have been successful, if he follows the foot steps below mentioned:
    1.) Agreement of sale deed in cheque payment.
    2.) TDS to be deducted based on the sale price.
    3.) Publishing the New Paper notice of sale to avoid future litigations.
    4.)Video recording of the entire sale negotiating procedure.
    5.) Not leaving the property until registration is completed.
    6.)If people comes to fight call police and act in self defense.
    7.) Always fight for others so that cheaters never dare to think cheating others ( You're in a society).

      @@sachinnayal Very Simple take loan against such a disputed property just like Vijay Malya and don't pay to bank. When the bank will come for recovery then the possessor will fight the case and suffer. You enjoy your life.

    It seems like dealing with police to get justice is a bigger problem in this country than the legal troubles that people face with other people everyday, because many times, it is a crucial aspect in how a case turns out.

    I don't know if i would be on point but i could pull these lessons from this story -
    1. Never leave the physical possession of disputed property, keep some security or servant if the place is inhabitable for you.
    2. Remove all the valuable possessions from the disputed property if you are leaving its possession, even if you think it is temporary.
    3. Do get the FIR done first, even if you have to persuade the SHO by some ungodly means.
    The last thing i do not understand why he couldn't get the electricity or water back by pressurising or maybe paying off the society people and making them turn to his side. Or would have just put immense pressure, legally, etc on them.

      @@sv1500 Cheap bastards will do. When you aren't at the property vicinity society jobless bastards looking for a buck will do all this. They will coerce and misguide the water authorities when they come there etc,

      @@sv1500no, society cannot tamper with electricity connections, it is depriving a home dweller with his rights. There are provisions which can be invoked.

      Civil suit for specific relief,injunction, damages, recovery of movable prop, malicious procecution and cost, whereas criminal suit for theft, criminal intimidation, hurt.

      Kabhi bhi koi chiz sell karna ya kisi se lene ke pahle Dhyan do ki agreement mein ho aur registered ho aur currently force mein ho.. ye nahin ki samne wala aadami bol raha hai ki aap agreement bad mein kar lijiyega abhi Paisa de dijiye kuch bhi ya kisi ka property /item tab tak mat lo jab tak agreement force mein na ho..

    Grand father has given all his property, pension, retirement fund, land, to his 3rd son and now he also needed 4th share in great grand fathers prop. To make his 3rd son share more among other 2 sons. Can he do so, i means there is no equal sharing then. Due to his love likes he make other 2sons on road side. We having small amt of prop.

    I am trying to connect dots
    1. When buyer pays the amount to seller, buyer and seller makes a written bond letter
    even its small account
    2. When goods got stolen in apartment , of course there will be cctv footage
    3. Only when seller receives the full payment, then the seller will come forward to make the sale deed
    4.How can seller come forward for sale deed , if buyer pay 1/4 th of money.
    I am so vexed

      When you pay some amount of money you make an agreement to sell, which is different from Sale Deed.
      In agreement to sell you show your wishes you have to sell the flat but not have done the mandatory requirements for the same and when the money is paid in full you come and make a sale dees which is final to transfer the possession.

      @@chandreshraoa-6052 isn't the agreement enough to show proof that buyer has given the money. I think in this case, buyer didn't pay full amount n seller didn't come forward for sale deed. But going beyond to this extent, I don't know what went wrong

      @@raghavendranagaraj8676 Well it will depends on the facts of the case. An agreement to sell only displays the intentions of the parties to sell the property and not necessarily it should contain the money paid. Per Contra, parties were freinds and i highly doubt there would be any agreement to sell executed by the parties. Per contra, FIR has been registered for physical abuse by the other party therefore, i am assuming there is no CCTV footage but that is complete different footing. He is in Jail because allegedly he has done physical violence and now its up to court and the advocate to prove that the complaint is vexatious.

      1. You are correct but if one person is weak and then he will not completely execute that contract until and unless he gets the part of net contract or full in his favour
      2. Not necessarily if that particular flat in the apartment doesn't have any CCTVs and the goods are just shifted from one flat to the other maybe some walking distance from corridor.
      3. Correct this should which kept in mind for both the parties.
      4. If seller/buyer want to do any mischief, he will atleast receive a part of the contractual payment

    The major lesson from this story which I have learnt and also which was the base or starter or this complex litigation is that NEVER EVER HAND OVER YOUR MOVABLE/ NON MOVABLE PROPERTY OR MONEY OR TAKE SOMEONE ELSE'S WITHOUT THE AGREEMENT IN WRITING AND IN-FORCE !!!

    Unless a sale deed is signed why pay any money at all, and pay the final payment only at the time of registration, also always take a lawyers help to draft all documents, if you follow all legal steps you can avoid all this.

    In practical experience I've found that physical possession is half the "property right" when it comes to these kind of cases... Your local police etc are useless if rowdies come and squat in your vacant site/house with some flimsy paperwork and later they can get a stay order claiming that they were always in possession and you should not disturb them, it becomes a civil case and you will be running to court for decades.. So apart from all the legal issues and work it's also important that you maintain physical possession of the property by what ever means possible (may be you need to hire your own team of 'stronger' ppl to physically stay at the site).. Don't expect the police or the courts to safeguard your property for you...

    Why does diffrent suits needed to be filled each time if it's proved in the court that one party is wrong and the other was right, then automatically damages and consolidation has to be paid by the other party if both accept the decision if court.

      Don't pay. Never. Ask them to go to court. You can easily convince the judge it was an accident.

      U should pay because lets say court find you guilty so there will always be a case written under your name that you accidentally killed a dog, this is the sqme reason why we bribe traffic cops so that there is no bad records under our name for that particular driving licence.

    That's why i have been shouting & crying a river to Modernize our legal system best-in-class to the ever changing circumstances. We saw liberalization in all sectors except in Judiciary because execute can't sustain independent Judiciary. Only ray of hope is a peoples revolution to Change our Justice system. 75 years of Independence still our justice system can't bait the baiter.

    My father divorced my mother in 2009 and only gave 1 site in Bangalore(self-acquired) for me his only son and my mother 1-acre land out of 16.8-acre land he has. This land was my grandfather's property. Grandfather divided it into 2 sons( my father and uncle). My father remarried and has 2 kids a boy and a girl.
    In 2009 I was a minor now I am 26 and can I ask for a fair share of his land? Can he deny it? He has not paid alimony ever. Even though court-ordered to pay 4000per month. She married my mom when she was just 15 and left her when I was 1years old. He has never come to see me all these years. People say I look exactly like him but I have never seen that man's face.
    My problem is that he never looked after me or my mom but he is living very luxuriously. The site he gave is worth around 30 lakh so is each acre in our village. He is enjoying nearly 5 crore property giving us only 60 lakh worth and this site he gave had litigation too for which I spent 2 lakh to clear.

    Hi Amish, I have a problem. This question is on behalf of all aggrieved renters. Perhaps you can make a video on the same
    My previous landlady is refusing to give me 70k of my refundable security deposit. This is even after I have vacated the premises post the mandatory lock in, given due notice and followed everything written in the contract. She has said that we can go ahead and do anything we want, including filling a police complaint. The thing is that we got to know later that she's done this with all the previous tenants at the property. She knows that this is a civil case and perhaps people won't go through the trouble of filing one. Now, we went ahead and became "friends" with the local police station's crime branch chief and filed a complaint. I got the acknowledgement signed from him as well. No FIR has been filled yet though. He has assured us of criminal action. My question is-
    1. Can this be considered fraud/cheating and can police take criminal action?
    2. Can I send her legal notice when police investigation is going on? How much time do I have to give her? Post that if I have to contest this in court, what could be the time in which this will be resolved?
    I have all the requisite proofs, including cctv footages from society. The society is on my side as they know her past.

      No this is a civil case.. you have to file a civil suit particularly money suit/money recovery suit... Aur meri salah mano agar writing mein nahin hai proof ki tum usko security deposit diye the to uspaise ko bhul jao kyunki jitna Paisa Tum wasoologe usse jyada litigation mein kharch ho jayga.. vahi baat hai 9 ka lakdi 90 kharch... By the way if you don't mind may I know what steps did you take?

    My sister force FULLY took my mother' and filed complaint against me that I had kicked my mother
    She filed criminal complaint against me in police and made registered will from my mother' in the property she owns

    My father purchased a piece of land back in 2005,since then we kept it as an asset and not an active property that we work on. Yesterday my sister went to the tax office to pay for the due taxes and there she was informed that the tax is due past 7 years and that the land was sold to a couple by my father on 07/12/2020, my father who's the legal owner of the land has no knowledge of it. The online govt record shows their name as current owner and my dad's as past owner. I had no such knowledge at all, what can we do about it?

      But you have paid him 1/4th money and without possession it would be very difficult to show that you had the intention to stay there and hard to recover the said money.

    Need some legal advice.
    I am staying in a dda flat from last 34 years.
    My neighbour flat is lying vacant from last 27 years. No one had even came once to visit this flat, electricity meter, water meter both got disconnected in the year 1998 due to non payment of dues.
    I had tried my best, went to the dda office, sdmc office, sub registrar office, but all efforts gone into vain. Actual owner is not traceable.
    *who will be the new legal owner of the flats whose actual owner are not traceable*
    *Is there any process to know the actual owner of this flat?*

    The story was definitely Awe-inspiring however raise a couple of questions due to bewildering and Anecdotal Facts. This is support an important Part that as an advocate, You would know only 1 sided Narrative which can be False.
    1. Why was the possession offered without settling 100% Consideration Amount?
    2. Why client was interested to go with the deal when his former friend disagreed? A. Did the disupte arise due to remaining amount not being paid as per agreement? OR B. Former friend had got a client at a higher price to what your client had agreed to.
    A lot many time people cheat and live with False Narrative with their Advocate creating mess and harassment for others.
    I would appreciate if you reply here.

    I was not aware that mutation is incomplete and I submitted pattation of my ancestral land bearing mutation no6855 in the month of November 2022 and tehsildar issued order for pattation order in the month of June 2023 but due to error in said mutation my brother stayed in sdm office

    If Ajay had lawful possession, how was the lock changed by Anti-Ajay?
    Hadn't Ajay done the paperwork while taking possession? If yes, it becomes fuzzier.
    If no, Ajay had it coming. Serves him right.

    Indeed. Today a good family friend told me that his tenant has filed a complaint against him for harassing her minor daughter only because he had been continuously asking for rent which she had not been paying since she and her children shifted to the property (December, 2020) and her son also picked a fight with him because their electricity was cut. 1. He never received his due rental income. 2. He has been continuously following up for payment. 3. Now he has to apply for a pre arrest bail for no fault of his. 4. Despite getting a police verification done, he has to lose 6 months' rent and possession of his property. 5. The biggest flaw here is that the lady might do the same with another landlord and might never have to pay rents and hence, nobody could ever harm her.

    I am in a family dispute as well my grandparents property their eldest son and wife go behind there back and get land title while me and my siblings living on the property never knew there will go illegal and have that property which that he was falling apart I takes care of my grandparents on bed and my mom foot was amputated I was there to take care of her as well and one of her brother is a disability I takes care of him and I renovate that property until I get a court order to move I spend millions on that house the only thing I take out of that property is the zinc which I buy all now my uncle wife wants to take me to court saying bi damage the property don't know what to do her husband which is my uncle pls pls advise me❤❤❤❤❤❤❤❤

    My father can claim property of my grandfather only if they have same address on my father aadhaar card as grandfather has or C/o (grandfather name is enough) to claim property right.?????
    If we have shifted to city and change address to new place instead of villages so whether my father can claim property or not ??????
