      @pepe According to Common laws followed in a vast number of countries, Couple living together for a long period of time are treated as married. What the definition of long is depends on country to country. Moreover, it isn't exactly normal to find a girl and live with her 30-40 years without marrying her. 2 years into living in, and everyone is gonna pressure you to pop the question

      @@krishna_o15 look quashing is not possible on the basis of settlement u need medical evidences such as medical report, presence of sperms etc so if the medical report and all that is by your side you can easily quash the fir under 482 crpc then u don't have to give money to the woman. What happens in 99% cases is men and woman have sex after that woman files a complaint so it is taken as rape otherwise without sex filing a rape case would not be of much importance it can be easily quashed

      Not all women, my aunt left her husband's house and never demanded anything. On the other hand, one of my maternal uncle's ex wife left in 2005 and he is paying her maintenance since then. Even when he did nothing wrong, she filed false cases against him. So the thing is it's not about women but about humans their morals. If I ever have to leave my husbands house I won't file any false case against him just like my aunt. But the matrimonial laws are absolutely biased against men. That I agree. And it's sooo sad that because of these false cases people don't believe the stories of women who actually suffered domestic violence. I hope the laws change for betterment of both men and women.

      Not all women. There are women who have self respect and would not like to take unjust money from another person. As a women I really feel bad for men who go through cases like this. So for me, I have decided to work and earn my money. Incase things to don't go well in my marriage, I can move out and earn my bread and take of my child.

    Majority of women leave their jobs after marriage for this very reason. They are already insured by marriage - one-third of your monthly income for life and half your assets, without any liablilites + child custody + child support will be granted to her any day. It's a sovereign guarantee - if this isn't the best financial scheme in the world, i don't know what else is.
    All the above can be availed, with just one day of "marriage" - and they still keep whining that women are oppressed, my foot.

      @@somu87i Most probably that will never happen in a democratic setup. When a freebie becomes a law in a democracy , over time the benefactors begin to treat it as their right and not a gift.
      No woman would be willing to let go of such benefits even at the cost of their self-respect. There are 4 billion women and all treat alimony as their right.
      Except for an autocracy or dictatorship, there's no way it might get revoked.

    So, if the woman is committing adultery then what to do?
    Secondly, there is a trend where the girl marries but then wants divorce after 2-3 months of marriage(honeymoon effect wears off), they threaten or go away while making demands.Even after asking for many days, if she wants to marry or not during the courting period , because nobody wants to go out there, suffer in courts just because someones else did not tell them that they did not want to.

    What if husband has evidence of leaving wife by her own wish, of course she will give reason by putting false allegation, so judge will wait for allegation to be proved or blindly allow maintenance?

      Interim maintenance will be awarded and the suit will go on. The only way to deny maintenance to wife is that she has deserted the husband or has been in an adulterous relationship outside the marriage. These are good reasons to prevent her from claiming maintenance under S125 CrPC. However, maintenance and alimony may still be claimed by the wife under the Hindu Marriage Act, 1956 or under HAMA or under the DV Act.The desertion has to be proved by the husband and it should be i think for a minimum period of 2 years immediately preceding the presentation of petition/ application by the wife.

      Prenups don't hold in Indian court but we can always sign on the dowry, Jewelry, List of items given to wife etc. This will help in case wife files false allegations during disputes.     He is absolutely right. I found my wife having illict conversations with someone, had a stroke becise of the trauma, went for intense medical tratement. Yet had to do an out of court settelment by paying 30L. She had ahigher net worth than mine. All lawyers told me that thr courts just dont listen to a man's argument and woudnt have cared much had i lost my life becuse of the stroke. The women should be taken care of no matter what she was upto.

    I paid 0 maintenance, got her arrested...all of this after she filed dowry, maintenance and other criminal cases on me & my family members.
    Divorce complete, maintenance case withdrawn, dowry case over 2 days ago 😊 and yes i also got visitation rights without any maintenance burden for my child too.

      I filed criminal cases on her. She got arrested because she tried to avoid summons and then court warrants. I used RTi and other tools to help the police to not engage in unethical practices / casual approach.

      If anyone having such s wife then she will be definitely going to torture husband throughout the life, so rather than facing harassment kill the wife and go to jail .. at least your mental health will not get affected; some time later you might get out of jail on bail or due to reduced imprisonment on good behaviour.

    I have personally heard of so many cases where wife asked for lakhs of rupees in the lieu of not filing a criminal case u/s 498a ipc even though there was no matrimonial cruelty

    1.Wife is entitled to her rich fathers property and money and also husbands property, but no liabilities.
    2.Even if man is a pauper still should sell his kidney and other organs to maintain wife
    3. Even if she falsely accuses husband of cruelty with no proof, then the aggrieved husband needs to fight all his life just to prove his innocence and be held at ran some by wife /inlaws and lawyers

    Sir the point you mentioned “wife can get maintenance if she is not able to maintain herself” what if she is well educated and able to maintain herself however not doing the job intentionally or left the job intentionally to get the maintenance. Does courts look into these scenarios and denied maintenance to wife.

    The fact that upon marriage, The care taking of a lady is transferred from Father to Husband is in itself horrendously stupid. A Women is not a Financial Asset that is to be placed upon A Man and he is not a Bank that looks after said asset for certain interest.     It seems, the courts are now not sticking to such marraige burden, especially for a failed marriage, to be borne by husband only for ever.. Courts are giving direction for maintenance for certain period of time , say one year, and asking the women to get into the earning sectors as per own capability , qualification...

    Always think like a criminal to deal with criminals. I would set up such a situation where I would prove that she has committed adultery before should could even step on to the court.     One of guys i know after divorce he was not on Job for several years while his wife was earning. Court rejected her case and allowed the ex husband for no allumni at all as he was barely able to afford his monthly bedspace rent and his own expenses
