    Strike Out Applications
    I recently had a phone call from a distressed lady who had brought a claim against a hospital and they had responded by making a strike-out application. This was BEFORE the claim had actually been officially allocated to the small claims track and so they were exposed to costs of losing. This prompted the video.

    Hi, great channel. I have a pending case which I opened for damages 9k, the defendant opened the counterclaim which is not related to my claim and is claiming the same damages from his side. On the top of that he opened the additional claim which is exactly the same as the counterclaim....the only difference is that he added my partner to this new claim as the second named third party (he called us 20 part defendants on additional claim application). I had a hearing yesterday for jurisdiction and I raised up the duplicate claims...judge wasn't interested that topic...is it normal ?? Res judicata doesn't apply here?

    What if you get a ccj by default can it still be struck out and legal costs claimed

      Hi John - go to www,smallclaimstrack.co.uk which explains the process of getting help from us :) We can speak on the phone for £150 + VAT if it is a small claim, but I usually find I need 2-3 hours as there is often a lot of documentation so if you can email is the story of your case and all relevant docs as a PDF attachment and we will tell you how much it will cost and what we can do for you. (Ie. what you get for that cost.)

    I watched many CZcams videos including yours. But feel that having now lost a case that most of this advice is useless. Why? I will list some reasons here.
    1. No mention of consumer rights act 1974 (if you didn’t sign a contract including terms and conditions you might as well give up asap) I know you will say I should have known this but surely some of you legal experts should have seen failures based on this alone.
    2. No mention of huge amounts of time involved in prepping these cases. (Time is money in business better to carry on with your business than waste time trying to pursue non payers) after all you don’t get paid the amounts legal professionals get paid.
    3. Most of these advice videos are so poorly constructed that they fail to include advice to defendants on claiming costs ( this was the only thing I came out of court laughing about the defendant had not brought any invoices for his costs and the expert opinion had not provided a reinstatement cost for the rectification of the supposed problem) this cost the defendant at least £1800 in the end he got back the £400 he had paid me for part payment and £80 court fee)
    Be careful everyone remember that these videos are to win legal professionals work and the system is for legal experts even though it’s called civil claims. When I mentioned to the judge at the end of the hearing that there was a lack of information his reply was “if you want to improve the system YOU email the court system” interest on the judges part zero. It’s just a job. YOU HAVE BEEN WARNED!

      aye, these are nothing more than marketing/advertising videos made ( as can be heard in the background) on the piss, or in the bistro, it wont be a cafe as these vampires dont stoop that low).
