The federal law then says that if you get a written warranty then by operation of law, you get the implied warranties in your state. Warranty of merchant ability is one of those and it would be a four year warranty, every court I know of has held this. I know of no court at all that has issued this contrary to this. • @ronaldburdge5932
      @ronaldburdge5932 Před měsícem +3

      It’s federal law. The three day warranty from the dealer that you handwrite on the sales contract is state law. Federal law says that if anybody gives you any kind of a warranty, that is in writing, then you automatically get the applicable state law, and plague warranties. That would include the warranty of merchant ability that virtually every state gives. Another words, state law says if you buy something from a seller then you automatically get that implants warranty (four years) unless the selling paperwork, denies it. Federal law says if anybody gives you a warranty then they cannot deny the state law and pride warranty. Getting it in writing from the dealer, makes it a written warranty, and because it is handwritten on the printed sales contract, it legally overrides the printed “as is” words on the sales contract, and, at the same time, you have the federal law saying they, the dealer who sells it to you, automatically gives you the state law implied warranty. It is a little confusing, because the legal analysis in several different directions to get you there. But the bottom line is you get there!

      Because the piece of paper is handwritten and says three days, that wipes out the part of the printed language on the sales contract that says you don’t get any warranty at all. Federal law says that if they give you any written warranty of any kind, and that is what that three day warranty becomes, then you automatically get any implied warranty under your state law and almost all of those are for four years along.three days can equal four years for you.
