Are employees really deemed not to be redundant no matter what, even if it will be unreasonable for them to take on an alternative role?

Thanks for asking! It is a really complex area so best to talk it through if you get in touch... but basically the person follows the work. So if the work is moving, the person goes with it. If the work isnt moving because it isnt required any longer then redundancy might apply BUT if the work is moving but the new employer wants it to be done by someone else that they already employ then they would be allowed to transfer. If too many people are then employed to do that particular job then normal redundancy applies but new employer would have to "pool" both people. Does that make sense? I told you it was complex!!!

Your new employer would need to become a sponsor employer so you need to enquire with them about whether or not they are already a sponsor employer - if not, they need to start the process quickly. You should be invited to a consultation meeting with your new employer - (or you should have a rep who is in consultation with your new employer) so ask them to raise it formally as part of the consultation.
