      They also accuse him of initiating a confrontation, when he's just going about his lawful business and its them who both initiate the confrontation, and act illegally during it. No cop who spoke in this clip is qualified to be a cop. They were unprofessional. unknowledgeable, incompetent, and violated a citizen's rights. Ample grounds to dismissal in my view. Until cops are punished for this behaviour they will continue to engage in it.

      Worse, they don't respond to many calls due to staffing. Our emergency communications (BOEC) used to have a fast call answer time but now you're often left on hold for lengthy periods, consistently 1/2 hour, or longer. Many don't bother to call because they've learned it's a waste of time. This is part of the reason the city/county is an dumpster fire. Unfortunately, when you have incompetent people in charge of LE & other municipalities, you end up with horrible employees.

      As mentioned in the video it could be enough to warrant a terry stop as one could reasonably believe that filming inside of the cars rises to could be an action in furtherance of an actual crime. However, nothing beyond that is warranted and when investigating you ask questions not make demands. These cops were clearly in the wrong with how they approached it but responding to concerning behavior is important. As mentioned the best course of action would have been observation and if the individual tried to physically access the car then intervene.

I had a neighbor call the cops on me for filming her as she ranted in the street and both the 911 operator and the officers that showed up told her I was doing nothing wrong. There's a local auditor on CZcams, too, and he doesn't bother to do 1A audits, he just cop-watches and does 4A audits.

      I have no problem with them investigating and asking him questions. That's their right. It's the combative and instigatory nature they approached with that was the issue, as well as stating that he isnt allowed to film the interior of cars that was the issue. That was an overstep.

    • @Bacteriophagebs
      @Bacteriophagebs Před 2 měsíci +2

      @@penezu Mostly no, but sometimes yes. Even if you're in a public location, it's still illegal to film places with an expectation of privacy, but only certain ones. For example, it's fine to film through an open window into someone's home (though in some places like NYC you're not allowed to use telescopic lenses to do so), even though there's normally an expectation of privacy, because the people in the home left the window open. But it's still illegal to film someone else's bathroom even if they left the door or window open. At least if you _know_ it's a bathroom, anyway. Same for locker rooms and changing rooms. It can also be illegal to film up skirts in public, but only if there's a statute against it. Such statutes have been upheld in various federal courts. Otherwise, police can initiate a consensual encounter any time and _briefly_ detain for questioning if there's good reason to suspect the filming is in aid of a crime.
