- Actor Alec Baldwin has asked for the court to dismiss the charges of involuntary manslaughter after the 2021 deadly shooting of 42-year-old cinematographer Halyna Hutchins on the set of his movie “Rust”. Baldwin was indicted on one count of involuntary manslaughter back in January. The film's armorer, Hannah Gutierrez, was convicted of involuntary manslaughter and faces up to 18 months behind bars.

Would Alec had checked the gun if the scene called for him to point it at his own head?
I do agree with you and had he pointed the gun at someone else's head, he probably would have checked it as well. Just the carelessness of it all. He needs to be held accountable.

@@avpubynf He knows the difference between the rounds. He demonstrated that knowledge when he was interrogated by the police on the day of the shooting. If he had insisted the armorer load the gun in front of him, he could've seen the live round, however, gun check or no, he still should never have pointed the gun at anyone.
always assume a gun is loaded #1. Always point it in a safe direction #2. Following these 2 points there would never be any accidental people being hurt.
I was told once, a long time ago. If you ever point a Gun be prepared to shoot. He was a cheap skate bully who didn't give a Toss. There was complaint after complaint on this set before this tragedy happened. He's not 'immune' to the Law ! Do the Crime, pay the time. If he isn't charged this whole case is null n void, especially for the beautiful young woman who died, her son and her husband and family. He's always been a bully. ( I 'did' like some of his movies tbh)
right, there certainly was negligence, maybe not intent, but its at the very least manslaughter.

Accept reckless endangerment to point a gun at someone on the streets not in a movie set. If what crime would Alec be responsible for? They never proved Gutierrez put a live round in the gun.

A gun is always loaded no matter how carefully you check. This was ingrained into my mind by my parents and grandparents before I was even allowed to touch one. They are no joke.

I do not believe the gun "accidentally" discharged. I believe Baldwin pulled that trigger believing the gun was empty. Does the charge fit?
Why do people have to announce their "bathroom breaks," since that mental image is so unpleasant? A break is a break. Just be courteous and leave it at that.
We don't know what he "believed" but he pulled the trigger (or made the gun go off somehow) while pointing it at someone, which is negligent, so the charge fits.

He is guilty of involuntary manslaughter because he didn't check the gun himself. If the scene called for him to put the gun to his head, you think he wouldn't double check the gun to make sure he was safe? Of course he would. But since he was only pointing the gun at others, he was careless and didn't check.

Even this could have been mitigated IF Baldwin didn’t point directly at a human. Baldwin pointed a gun at a human and pulled the trigger . His fault, her fault, their fault and anyones fault a negligent discharge that harms a human is avoidable by practicing simple gun safety rules. ( BTW-Baldwins own father’s job was a high school firearms instructor when marksmanship was legal as a sport in school. He passed away 1986) He was raised in a home that his own father drummed gun safety at all times.
It wasn’t his job to check guns! Thats why a team of 3-4 gun people are hired!
The only question is whether the actor has a legal responsibility to check the gun themselves or if that responsibility is the armor and safety officer. That’s going to be issue, because it’s not obvious.

Evidence talks...like at the "armorer's" trial...Baldwin gets handed a prop gun that he had a reasonable expectation was safe..and that loon had live ammunition in it..
All I am hearing is blah, blah, blah. What I believe is, Yes the Armourer should be solely responsible for securing a weapon on a movie set. but it is the Executive Producer and the production team that should employ an Armourer fitting of the movie and the amount of weaponry being used in the movie. The Rust movie armourer was employed as Props Assistant, and then appointed Armourer, she was required to fulfill two jobs on this movie set. A lot of cost cutting was done on this movie and this lead to many safety issues on this set. Alec Baldwin, was the Executive Producer and he was one of the main people that got this production off the ground along with the Director. He is responsible for the death of this poor woman, regardless of whether he was peacocking and stroking his ego whilst brandishing a loaded weapon at people when he knows the rules. He has apparently bee involved in movies where there was weaponry available to him, he should know the rules. Stop wasting court time and try Alec Baldwin.

The prosecutor is 100% correct.
The actor could have chosen the non-working exact replica which was on that cart but he insisted on choosing the fully functioning weapon.

He was told by the amourer or the first AD that the gun was "cold". Those are the people responsible for the safety of guns on set.

True, but you could break it down even more. The bullets, by way of the damage they cause, kill people. This case is very nuanced as it involves a movie set, which the majority of the public has little knowledge of. It borders on its own society and a closed one at that. One could even argue, for both trials, that to have a jury of your peers that needed to find a jury of at least half industry people. An important take away, if your state has a stake in the film industry you should have a training programing on how to handle a crime scene at one. This whole thing is horrifying and paints some of the trade in such a bad light. That being said I feel he should've taken a deal and be paying her family. Her child should want for nothing for the rest of their life.

You can’t get away with murder just by blaming a young inexperienced armor that your rushing and bossing around like a lap dog. You’ve clearly not watched the videos. Alec didn't know whether his gun was safe for target shooting at the crew but that didn't stop him from firing his gun at the cinematographer, at close range. It's hard to understand how his careless, reckless and deadly actions could be considered using "due care."

Genuine question: I was watching Law & Order and there was a scene with multiple people standing around one person, all pointing guns at the guy in the middle. Because it was a tight circle they kinda had guns pointed at everyone. Some people had their finger on the trigger itself. I know they used working guns at least before Hutchins died. In those shots, are they all replicas? I don't know weapons well enough to tell what's real or not, but I've definitely seen lots of guns pointed directly at people on tv. Stargate SG-1 did this constantly, but again, maybe they're all replicas/not working?

This judge is so minimalist. Didn't handle the recent trial proceedings properly. Did nothing. Should be intervening more, but too passive. Do your job, lady.

A BASIC GUN SAFETY COMMANDMENT-- Alec Baldwin has 100% responsibility; but $$$$ will tip the scales of judgement in his favor ( today and in the future). Alec Baldwin should be held accountable for his recklessness in the death of Helena. There is video of him pointing a gun and shooting it recklessly around the set like an 8 year old playing cowboy. A woman is dead, and he is partially responsible!!

I agree there is some culpability here...I mean, if a jury determines that he isnt responsible at all, then thats how it goes... But for it to never get to a jury to even decide? Baldwin should have been scared about safety on set (including hiring a professional armourer) as much as he is obviously scared of being held responsible.
Defence is so upset about the indictment because they know that Baldwin will *not* prevail at trial. If they were confident in the innocence then there is no risk at trial.
They know he is guilty of the negligent discharge which caused the death of a person. They would strongly prefer their client didn't face that charge - which is appropriate and proper advocacy... but Baldwin should face trial, conviction and sentencing for his actions.
The guilty person is already behind bars.

But Baldwin is 100% guilty of pointing the muzzle of a dangerous weapon, a firearm loaded or unloaded directly at two people, manipulating the trigger and hammer and by negligent discharge of an 'unknown' live cartridge caused the death of one and wounding of the other. But for his actions there would be no negligent discharge or it would occur in a safe direction.
Two different crimes, two different responsible persons, two different convictions and incarcerations for their part in this avoidable death, that was *caused* by the actions of these charged persons.

initially when this case began, everyone said alec baldwin was innocent 100%… glad people have finally figured out how gun safety and the law works.
Who here checks the engine, brakes, steering etc before they drive their new car off the lot? Exactly! No one. We trust that the people did their jobs properly before giving it into the hands of consumers. This was the armourer’s job
And that’s exactly what the prosecution argued when they put away Gutierrez read!
Once you drive that car out of the dealership, any accident is your responsibility. It comes down to the driver. The same thing with taking your car after a service. If you are not sure the dealership is exemplary then you go to a better dealership. If you go to a shonky service station, expect problems with the car. Your faith that the car is in order comes down to you, not the dealership. Hutierrez was overworked and inexperienced. Anyone with a brain would want the gun double checked after she gives the go ahead. It is down to Baldwin who knew her limitations and ignored them. For money sake, foe expediency foe power over his staff.
But you do have a responsibility to do those checks. Your negligence, being based on the negligence of others doesn't actually remove your duty to ensure your vessel is a safe and competent one, with all necessary (MUST) requirements correctly followed, and you are responsible for avoidable error arising from those which are obligations (SHOULD).

@@micheleh5269 my understanding about a grand jury is for prosecution presents their case and the jury determines if they they have enough evidence to go to trial. The defense doesn’t present their case for the grand jury because the fate of their client is in the hands of the criminal trial jury.

Why does Baldwin believe he never pulled the trigger? Witnesses reported that when Baldwin grabbed the gun from the holster, he kept his pointer finger pointing straight forward beside the barrel during the entire firing of the gun.
Baldwin goofed, and put his middle finger inside the trigger guard when he grabbed the gun from the holster. Next, he aimed it at Hutchins. He pulled back the hammer with his thumb. Finally, he released the hammer with his thumb.
Baldwin expected the hammer block to stop the gun from firing, but with his middle finger inside the trigger guard and gripping the trigger the hammer block was defeated.
Normally, he wore a ring on that right hand. The trigger felt the same, so he was not aware of holding down the trigger. Afterward, he immediately put the gun down on the pew before looking at his hand to see the middle finger inside the trigger guard.
The real problem was that Baldwin had no permission to aim the gun at anyone at that moment, but he didn't care. He thought that straight pointer finger would make it impossible to fire the gun. No. He needed to go through the standard safety process to get permission before aiming at people.
If the judge doesn't stop saying um, er, and em, I'll blow a gasket. 😡

It's rather fully how people form their opinions based on how they want the trial to end, and not on actual facts. This special prosecutor is a well-known and well-respected ciivil rights and criminal defense attorney.

for those who are saying that Alec should have checked the weapon: It is not the Actor's job to check weapon's onset as they are not weapon expert's it's not their place. firearms are provided for use on set under the guidance of professional firearm experts who are directly responsible for the safe and accurate operation of the firearms.

Baldwin isn't the first person unintentionally shooting and killing someone. It happens about 500 times a year nationwide. The most uttered sentence after an unintentional shooting is: “I thought it was unloaded”. It never works in court.
Kinda like the mac miller case... Hes famous, so they hunted down his killer within a few days. Millions of other people die everyday from overdoses. Where is thier justice?

The prosecutor didn't do anything wrong . She waited for the expert witness to answer the question not the lead detective. This was during the grand jury . The defense will say anything to manipulate the system so don't believe them. I want the charges dropped but prosecutor is doing her job.
She cut them off or stopped them, when she didn’t know what the answer was going to be or when she didn’t think they were going to answer the way she wanted…. Or that’s how it came across, anyway.

I think she means that Alex Spiro misrepresents and twists things around and she's right. If you search his name online an article from "The New Yorker" will come up, "How Alex Spiro Keeps the Rich and Famous Above the Law" and that article will tell you a lot about his style. When Elon Musk slandered someone Alex Spiro twisted it so much that people thought Elon Musk was the victim and he was found "not guilty". He also represented JayZ and Kim Kardashian in the past. Miss Morrissey will really have to be on her toes with him.

Then prosecutor takes things personally, which is a tactic in its own right, but it won’t play well if she goes to trial saying things like “these people”. This 1st defense lawyer is distorting facts and regulations. The gr. jury had the right to request the material mentioned here by this defense lawyer, and the prosecution had provided it to them, telling them they could ask to see it. That's all in the record. . The grand jury also had the right to decide they do NOT need to see such material, if they had already seen enough to decide the case should go to trial. Nothing was kept away from the. The defense lawyer is intentionally wasting the court's time, hoping to generate false headlines by falsely blaming the prosecution for the gr. jury's decision. A grand jury is NOT required to look at everything -- they only need to decide whether or not the case should proceed to a real trial, where all evidence will be shown to the jury.
That judge is so poor in communicating that she does not seem intelligent to me.
I think the judge will, in an abundance of caution, dismiss the charges without prejudice. Curious if the state will indict him again.

The defenses argument seemed very persuasive. It would give the prosecution, the ability to re-file, I don’t know how long that would take, but the judge seemed to side with them as well.
@@tomwallen7271 Not to me it didn't, they are usually saying 'we objected, the prosecution had to do the right thing, the thing happened, but this is still error which should result in dismissal'.
He will have the full opportunity to have a vigorous defence at trial. Where I am sure his lawyers will again raise all this nonsense - I don't blame them, as there is no defence to the negligence charges-

There are other concerns about the safety regime on the set, but they are not strictly necessary for the reckless dangerous but lawful, or unlawful negligent discharge to stand on it's merits.

Famous saying, never point your gun at anything you do not intend to shoot. What is implied is that you have a loaded the gun and you are ready to shot. The same applies to anything that you plan to point a gun at and you do not intend to shoot at. That you as an individual know for sure you have loaded the gun with the proper blanks.

Actually, not legally at all. She was the primary individual in charge of gum safety on the set, as is every armorer on every movie set in the country. The actor is not "just" as responsible; at least not legally.
What if...now this is a crazy idea, but what if the actors, as part of protocol, were required to point the gun at their temple and pull the trigger first before they pointed it at another figure and pulled the trigger??

She had no intention of presenting anyone. This was a very short grand jury presentation. She did not bother to contact any of the witnesses ahead of time to let them know there would be a grand jury and would they be available in the event they would be needed. She failed to follow the very specific instructions laid down by the judge and therefore the indictment should be dismissed. If she wants to put together a third grand jury ant THIS TIME do it right, that would be perfectly acceptable. But she needs to do it right. Both of these grand juries were held incorrectly and the first special prosecutor had to be dismissed because she wrote multiple emails ahead of time bragging that if she indicted Baldwin she would her Republican primary nomination. That is why the first one was thrown out. She wrote those emails even before she started the job and even knew what the evidence was. Already just rubbing her hands together about winning her state Senate primary if she indicted Baldwin. That is not how the law is supposed to work. I don't care if he's indicted or if he's convicted, but it should be done fairly and according to the judge's instructions whether the person is famous or a person completely unknown to the jury.
there was no grand jury for the charges brought initially. Only one grand jury brought by the special prosecutor. the DA brought charges w/o grand jury. The DA left the case and assigned Morrisey as a special prosecutor. The errors committed by the DA are harmless errors since they are no longer on the case. The judge has decided Morrisey did nothing wrong. The first charges brought by the DA were not thrown own. Special prosecutor Morrisey agreed to DROP charges while they sent the gun to the FBI for testing.
@@Kay__Tee She was forced to quit because of the dozens of emails she wrote that bragged that she would win her primary if she got an indictment for Baldwin. That is a fact that would have come before the jury had she not quit and a different prosecutor assigned.
