Utah is a Stop and ID state. They were investigating and suspected him of disorderly conduct. They were within Utah law to request ID. Their investigation showed no crime was committed and they went on their way.
Audit dude needs to learn the 5th, talk less. His demeanor is confrontational in all his videos I’ve seen, it will do him well to dial the tone down just a bit.

An interesting challenge would be to find a way for the court to prove one, verbatim, "not innocent". There are truly *vile* semantics at work in the law. Because proving a negative is nearly impossible. It's part of the reason "not guilty" replaced "innocent" as a "plea", rather than an assertion or whatever jurisdictionally disfunctional wording they would have otherwise used if not trying to coerce with fear of authority.

They go there but disorderly conduct has requirements and according to Utah Code 76-9-102:
An individual is guilty of disorderly conduct if:
(a) the individual refuses to comply with the lawful order of a law enforcement officer to move from a public place or an official meeting, or knowingly creates a hazardous or physically offensive condition, by any act that serves no legitimate purpose; or
(b) intending to cause public inconvenience, annoyance, or alarm, or recklessly creating a risk of public inconvenience, annoyance, or alarm, the person:
(i) engages in fighting or in violent, tumultuous, or threatening behavior;
(ii) makes unreasonable noises in a public place or an official meeting;
(iii) makes unreasonable noises in a private place which can be heard in a public place or an official meeting; or
(iv) obstructs vehicular or pedestrian traffic in a public place or an official meeting.
(3) The mere carrying or possession of a holstered or encased firearm, whether visible or concealed, without additional behavior or circumstances that would cause a reasonable person to believe the holstered or encased firearm was carried or possessed with criminal intent, does not constitute a violation of this section.
I didn't see anything in this video that fits those requirements.
It's important to remember that filming in public IS LEGITIMATE BUSINESS.

The charges are bogus, lol, that’s why he cooperated. He can’t possibly be cited for disorderly conduct because he wasn’t a) loitering, as he had purpose to be there, or b) disturbing the peace, as he wasn’t trying to incite unlawful activity, violence nor holding unlawful public assembly. Therefore, there was no crime to begin with. Phone calls are not reasonable suspicion enough, as it must predicate a crime is, has or will be taking place. There was no evidence any crime had occurred, as acting “belligerent” is not a crime nor infraction. Essentially all the officer had to go on, as there was nothing that overruled his 4th amendment right. However, I can see why he gave his ID as the policeman was probably prepared to arrest him, and AP always follows the law, even if the order itself is unlawful.

I respect the way you maintain your composure, and the way you articulated everything and explained your position in a way that more than likely educated some cops who were on the fence about some of these issues. Disorderly conduct requires acts that breach the peace. Lawful conduct can't be disorderly. It's the most abused kitchen sink charge in the US via contempt of cop.

Its quite simple in black and white on the books. Anything you say can AND WILL be used AGAINST you. Nothing on the books about being used for you. It, in fact, cannot be used for you, ONLY against you as written. And an officer is mandated by law to not help anyone get out of being arrested at all. Not their job. Their job is to make arrests and let the courts work it out. In other words, Nothing you say to police CAN help you, it can ONLY be used against you.
I tell this to my two young grown children all the time. I tell them even if you are the one who called the police they are still looking for a reason to arrest you. their job is not to serve and protect it is to arrest people.

It doesn’t matter how many auditors I watch, and their all over the country, we’ve got some CRAAAZY ASS people in this country!!!
This is the same type of cop that would cowardly claim that he never detained you. He would try to claim that he never demanded ID.
Unfortunately though, he had the law on his side on this one. Utah §76-8-301.5 states that you have to id while being detained with RAS. I'm sure Jason knew this and thats the only reason he did. However, i think he could have verbally provided name and birthrate to suffice, not given his lisence. §77-7-15 was recently changed to include allowing them to ask your address, but the failure to id statute doesn't mention of being required to provide address. As with anything with laws these days, its tricky and you want to err on the side of caution, unless you're willing to risk the consequences.

@@MichaelSmith-xx6hr Jason admitted to threatening to use force. From that point until they show the officer the video that have RAS that it may have been an unlawful threat. As soon as he admitted it, I was like, they're getting his ID today.

I just wish that Jason had pushed back about the cop actually having RAS of a crime - because this would mean that the cop was relying on the false information that they received. Also, it would make it more difficult for the cop to try to weasel out of claiming that he never "required" Jason to provide it - which we've seen cops do. I'd actually like to see an auditor say "So, when you get deposed about this, you're not going to try to claim that you didn't demand my identifying information?"

How happy would you be if the surgeon just about to give you open heart surgery told you none of the operating staff was going to wear a mask during your procedure? The reason they want you to use `official` id is, because when you do, you are identifying yourself as a government employee and forcing you to UNDERstand the inferior authority of your trustees/public-servants.

....and you are correct. The only reason you design your own id is to show that you are in-the-private and NOT a government official (ie. not under city ordinances nor state statutes nor county by-laws etc.,)

Much different auditors than those of 2022. The auditor of 2022 would have never handed over his ID. Nor would he go on with diarrhea of the mouth immediately after saying “I don’t want to talk to you”. The videos of 2021 are totally different of 2022. Delete them. They are embarrassing.
The audits of 2021 are unwatchable. If you’re new here, watch the 2022 audits. There’s no handing over of licenses, nor fear of entering a public post office. These two are horribly green compared with 2022. It’s unbelievable that it’s 15 minutes after auditor said “I’m not talking to the police” and you’re still talking. STFU

I would’ve asked for another supervisor over the lieutenant’s head. Never hand over ID over an accusation. An ID would not show if either side was right
