I'd add a couple more: 1. If they stop you ask "Am I free to go or are you taking me into custody. I do not agree to remain here on a voluntary basis". 2. If they want you to go to a secluded room, don't. Sit down where you are, and call 911. Do not offer physical resistance, but do so passively - just go limp and make them move you like a sack of potatoes if they want to haul you in. 3. Turn on you cell phone and start recording.
Correct, but unless it is a police officer, you can just walk away. Store employees don't have authority to detain you. However, don't try and walk away with items that have not been paid for. This could change the situation from shoplifting to a more serious charge.
@@THEFEDORALAWYER This is not true in all jurisdictions. What state are you in so I can review up the law there?
Sorry to hear that. But pass this along, maybe someone else will benefit. Also whatever you do don't plead guilty or just pay a fine at court. Get a lawyer so you can avoid a conviction. In most states if you get what is called deferred adjudication, you will not have a final conviction and you can expunge all records related to the arrest or ticket. I have a video on my channel explaining this. Good Luck!
If it involves a theft of under $100, the maximum punishment on conviction is a fine of not more that $500. Jail time is not possible for theft (shoplifting) under $100. But spend some money on a lawyer to avoid a theft conviction. Theft convictions are the worst convictions. In Most states, you are considered an adult for criminal charges at the age of 17. Hope this helps.
Store employees are not law enforcement officers. You have no obligation to talk to them. For police you do need to identify yourself but nothing further. I'm not sure if this answers you question.
A paper like that from a cop means nothing more than you are aware of the fact that you have been accused of something. It's like getting a traffic ticket. Cops make you sign them so you can't later say your were not aware of the ticket or the pending court date. Call a local attorney for help just to be safe.
Signing the citation if that is what it was is only an acknowledge that you know there will be a court date n the future. It is no an admission of guilt.
Hey, me and my friend were recently caught by loss prevention and were told to ID and sign documents , we were then arrested right after without being read our Miranda rights this was our first time offense also and the amount we stole was under 100 dollars also, we were booked into jail and kept overnight and released next day but I now have to go to court what do I do I don’t want this on my record
Sorry I missed this question and didn't answer earlier. It's a late response but you should hire a lawyer and found out why you got arrested for such a small amount. It may be possible that the combined total with what you and your friend took totaled over $100. If that is the case, they likely charged you and your friend with the same total. Every state has it's own laws. Hire a lawyer and find out what happened.
Yes you can call my office any time to discuss your case if you want to keep it private. My email is ajw6185@gmail.com. Send me an email with your phone and I'll give you a call.
Did you run from the police or just the people from where you made a big mistake by shoplifting? Your friend may provide them with your ID. If not, there is not much you can do at this point. If they don't find you, consider it a lessen learned and don't do it again. If you didn't actually get away with anything, meaning you ran off and left whatever you tried to steal behind. nothing will happen. In most places it is a fine only offense to shoplift under $100. You can't go to jail for it. And you can't go to jail if you are a minor either in most places.

Number 1, don't shoplift.
Don't shoplift in the first place is always the best rule. But my rules are for those who forget or disregard rule no. 1.
Dude, if its a false allegation such as overzealous receipt nazi, I AM LEAVING. Period.
You have every right to leave if you have a receipt. And you don't need to explain yourself to anyone.
