The writers wrote it that was so that she could come back anytime she wanted. They can always make a loophole even if Kai said that was impossible. Let's not forget that Damon supposedly burned Elena alive. I don't think Tyler would've ever let Damon really see her, but if it's true that he really did burn her alive, then the writers probably just wrote it that way to soften the blow of her leaving. However, I really don't think that Damon killed her, I think that he was still hallucinating. The reason I think that is because towards the beginning they showed "three years from now," when Stefan woke Damon up and got the "I told you not to wake me up until Elena is back" response. So I don't think she's really dead. I don't like were the show is heading though, I'm honestly hoping that something happens that makes the three years from now nonsense implode.
