    Go to court and have a judge throw out all the fines on the grounds of extortion. Then sue the HOA for the loss you have suffered because of their actions.

      I can't seem to delete this channel. - the thing about that - people who had their HOA sell their homes had it happen because they don’t fight it.
      Reality, it’s not their property to sell. Legally they have no authority. Until a home is paid off it belongs to the mortgage company.
      I saw a story on you tube where the home owner was going through bankruptcy, had not filled or gone to court yet.
      They told their mortgage company and they sent their lawyer to court to stop them. It was, for the reasons above. Lawyer was interviewed and said no one has the right to sell another’s property to collect fines or due to lack of payments like HOA dues. All they are allowed to do is place a lien on the home.
      Then said an individual can sell the property if the monies owed exceed the cost of the home - before all fines for none payment and lawyer fees. They have to go to court to get permission to do so first.
      They cannot claim that the lawyer fees will exceed the price of the home because most lawyers for HOA’s are on retainer.
      After a sale because the owner failed to act - the HOA can only take the dues owed, no additional money such as fines. Just like in forecloses it’s the industry standard. You take the home of someone who couldn’t pay for it means they can’t afford the fines so they are dropped.
      The HOA can only take what’s owed and the rest of the money goes either to the mortgage company or the old owner.
      A lot of people think they need to hire a lawyer to file their cases with the courts or are embarrassed and don’t fight it.
      That is the reason why HOA’s have gotten away with this stuff.

      @@djlowtek Not in my world you buy new construction without HOA you just have to shop around, and if you compare old construction against the new you can see that older homes have much more solid build than their newer counter parts, specifically to building materials. Besides most of HOAs properties are cookie cutter style and who in the hell wants to live in that, give me a home with some character.

They are out there it just takes time, effort and a little bit of luck 😊. I was determined to not buy a home without anHOA. Plus mowing a half acre every 3 weeks is good exercise lol

      The unit owner is responsible for the acts of his guests, visitors, tenants and guests of his tenants. How is the HOA supposed to know that the people living in the unit are not tenants or relatives or guests of the unit owner? Why didn't the unit owner call the police or initiate court proceedings to regain possession of the premises through eviction? The HOA doesn't own the unit; the HOA has no legal standing to evict a squatter; only the unit owner can do that. You clearly don't know WTF you're talking about.       Bobbi Klein I rented a home in Las Vegas run by a hoa. I worked in the office and to do inspections on homes. I heard what fines could be and it was outrageous. Never again. The offense wet so ridiculous I could not believe it.

      The problem is they are backed by the government. In a free market, everything in an HOA would have to be voluntary and consensual, so the rules could only be changed on a specific property within the association, if the homeowner agrees to the change. The only purpose of them in a free market would be to segregate communities based on various preferences, so very few people would belong to one.

      Is one of them. I live in California where grocery bags now cost the consumer and I will still now ask for help out to my car even for a gallon of milk. If you're making me pay 10 cents a bag you can pay your employee 10 dollars an hour to carry to the truck of my car.

    They don't send you the notices on purpose. They waited 3.5 years to send me a second notice of late fees because I paid late in 2014 when I got stationed in Germany. It racked up almost $500 in "admin" fees. Funny thing is I continued to pay on time every 6 months not even knowing I had a late fee. When I confronted them about it they told me, "oh well we sent it to the real estate management company, they never let you know?". So that was supposedly the first notice and then the second notice came 3.5 years later when I moved back to try and sell the house. They do it on purpose.

They elect from among themselves a board of directors to manage the property owned in common by the HOA. If the homeowners don't like the way the board is running things, they can remove them and elect a new board. Most HOA boards hire a professional property manager to advise them, hire contractors that provide services to the HOA such as landscaping, painting, accounting, billing, etc., and run the daily operations of the HOA. The dues paid by the homeowners are used to cover the operating expenses of the HOA and maintain reserves required by law to pay for the repair and replacement of roofs, streets, fences, and other HOA property. The members of the board are all volunteers and serve without pay or compensation. None of the dues go into their pockets, contrary to your ridiculous claim that the HOA is engaged in "scam ripoff legal extortion." Furthermore, any fines collected by HOA goe into the operating budget, not into anyone's pocket.

      Wrong. You don't know WTF you're talking about. The directors on an HOA board are unpaid volunteers elected from and by the homeowners. All the assessments and fees that are collected go into the HOA's operating and maintenance accounts, not into any board member's pocket. These are corporate accounts, not personal accounts. Typically, an HOA board hires a professional property management company to manage the day-to-day operations of the HOA, issue monthly invoices, keep the books, and advise the board. By law, HOA accounts are audited annually and the auditor's detailed reported is distributed to the homeowners. So you're claim that HOA boards are lining their pockets is ignorant bullshit.

    This is EXACTLY why I've never lived in an HOA and never will!     Not only is the homeowner criminally violated by the squatters, but also by the laws that required him to go through a formal eviction process AND he's being criminally violated by the HOA. Seems like the HOA can arbitrarily assess fines without telling the homeowner about it. In this case, there are two HOAs attacking him.

      If only the HOA actually did something about squatter prevention to begin with... Which would make sense in regard to neighbourhood security and property values. But that's expecting an HOA to act in the interest of their neighbourhood and not just their own wallet.
      I bought my home out from under an HOA at a foreclosure auction. So the bank who owned it, sold it directly to me. The HOA isn't anywhere on the notarised paperwork. They have no authority about anything with regard to my property, but that sure doesn't stop them from trying.
      I don't even bother sending a copy of the deed and purchase papers to debt collectors or the court. I just flat out tell them that the HOA needs to provide evidence that I have a contract with them. Which they can't so the stuff just goes away for a while.
      When eventually someone at the HOA "discovers" that I haven't paid dues or other shit and then it all starts again. It costs their members thousands in legal fees just because the HOA keeps on screwing up. Much like they did at the foreclosure auction.

      You need to understand why police cannot evict these people. This is a court case that a judge must examine the evidence of who owns the property and who has the right to live there. Many squatters produce fake rental agreements and the cops don't have legal authority to validate legal documents, a judge must do that.

      Trespassing is not a crime unless you have been given notice of trespassing and refuse to leave, or return to the property after such notice. Simply wandering on to private property does not give anyone, including the police, the right to arrest someone, even if there are signs posted.

      No board member on the HOA makes a salary, it is legal for them to do so. All money collected is used to pay for the upkeep of the neighborhood and common areas and to pay for insurance, contractor work, lawyer fees, etc. The only way for HOAs to go away is for 100% of Americans to boycott them. If you live in an area where 90% of homes are in HOA areas, then relocate to another State or city.

    People need to understand that there is no difference between squatting in an owned home and home invasion. Put a couple bullets in them and they won't be doing anymore "squatting" and if your aim is good it won't happen to anyone else.       Even though he owns the home, he established residency elsewhere where laws actually changed. I own a house back in Ohio, but I've lived in South Carolina for the last year. When I called the police to have them check on the home that I own they explain to me that they cannot just go to the home any longer since my legal residence is in South Carolina.

    Fines are not a lien. They're simply a claim against a person, not against his property. To enforce collection of the fines, the HOA would have to sue you and get a money judgment. However, if they get the judgment, they can enforce it just like any other judgment creditor: they could record a lien against ANY property you own, garnish your wages, and levy on your bank accounts until the judgment is satisfied.
