    A usufruct is, according to law, a right of limited duration on the property of another,
    We see usufruct often in . When a married couple acquires community property in their name, and one spouse dies without a last will, the surviving spouse, pursuant to intestate law, inherits the usufruct of the deceased spouse's half of the community property. The surviving spouse's intestate usufruct last until the surviving spouse either dies or remarries.When the usufruct terminates, the heirs (or, naked owners) of the first spouse to die become owners.
    The rights and obligations of the usufructuary vary depending on whether the usufructuary owns the usufruct of consumable things (like money), or of nonconsumable things (like land, houses, shares of stock, vehicles, and furniture.

    What are your thoughts on when a usufructuary must file a fiduciary income tax return vs when a usufructuary can report the income from the usufruct property on their own 1040 like a common law life estate?

    Enjoy your videos. Thanks for what you do to educate the community. If my investment accounts (i.e brokerage, Roth, traditional IRA, whole life policies) all list my spouse as primary beneficiary), do those funds then become my spouses funds upon my death and are therefore not funds covered by the usufruct provisions of a will?

    Why would you want someone to have usufruct of a consumable such as cash if they have to return it when the usufruct ends? Does a usufruct have to be accepted by a party to be legal?

    How about if my father is the naked owner and died first? And my grandma is the usufructuary?and it has stated that usufructuary must be in her lifetime

      Yes! This!! My uncle and Dad were naked owners and both died before Grandma (usufructuary). Uncle never married and no children. Property would be separate property as it was prior to Dad's marriage to step-mom. Dad had two biological children and specified in his will his bio-children are to get his ownership of house. Am I understanding correctly that Uncle's naked ownership went to Grandma at his passing (so Grandma has 3/4 ownership) and Dad had 1/4 ownership. But Dad died so his 1/4 is now my 1/8th and my brother's 1/8th and then when Grandma died a small succession affidavit, of the under $125,000 estate, would divide Grandma's 3/4 of the property among brother and myself?

    My question is this let’s say your parent specifically left you their home in the will but is still alive-who is responsible for any repairs to the home until that parent passes away

      They can always change the will at their last moment. If repairs need to be made, many times contractors will only do the work if the owner signs the orders, unless you have a power of attorney. Also, the city will send the owner the bill if there is a code violation...and not whoever is going to inherit the property. If the parents are in a nursing home and you are certain to inherit if there is anything left, you would just want to keep things up for yourself.

    Can't it be summed up by saying Usufruct is use of the estate property? If it wasn't given to you, then you are the trustee! The beneficiary of the property is the naked owner.

      ⁠ hello Sir I am a French law notary, and I find it hard to find resources about the usufruct in your country. can you let me know if according to American law, you have to tax the usufruct (from the naked owner) when the usufructuary is dead?
