Is Home Distilling Legal?

- If a person wishes to legally distill alcohol, they have two options. The first option is to obtain a Federal Distilled Spirits Permit. This is the permit that industry giants like Jack Daniels and Makers Mark distilleries possess, which makes it legal for them to distill and distribute to the public. As one might imagine, this permit is very difficult to get.
In short, unless an individual is opening a distillery with the intention of selling their product in liquor stores, don't even bother looking into getting a distilled spirits permit; it's way too expensive and complicated for a home distiller to obtain. Instead pursue a fuel alcohol permit (which we'll describe next).

I’m just going to do it anyway. The government isn’t gonna tell me what I can do with expired fruit juice

Strongly recommend that you keep your basement well ventilated and keep that fire extinguisher handy. Our hobby doesn't need to be making any headlines, you know. "Let sleeping dogs lie."

It's one of the issues I have struggled with when learning to distill at home. While perfectly legal in New Zealand, the lack of other countries where home distilling is legal means there is way less info out there to learn from.
There are lots n lots of info on home distilling on the net . Go to Barley n Hops on CZcams to learn everything you need to know to get started .
You literally have the best youtube source there is for home distiling and he lives in NZ...... Still it
Welcome to Russia))
In US its all about money . They cant tax you if they dont know
@@Ineluki_Myonrashi I'm just going to post the names hipgnosis2 & Bearded and Bored & Barley and Hops, so that you can see there is a whole community and many others, here and elsewhere.
Not only is it legal to own a still in the state of Missouri, it is legal to produce up to 200 gallons per year per household of moonshine for personal use and not for sale.
We can also make it legally here in Arkansas. Not for sale but for personal use aswell.
Imma need one to make barrel aged hand sanitizer
Exactly!
What else would I be doing with all my lavender & rosemary at the end of the season 🤷♂️
I mean the gub'mint was the one poisoning shine during prohibition
I believe in WV you only need a $25 permit to distill your own moonshine, not to sell.
Just another way they can keep their hand in your wallet at all times..
What the Gov. don't know is best when it comes to what you're doing. It's none of their business.
There is a new bill in ohio indicating you can distill upto 200 gallons per year, but it cannot leave the state and you can't sell it.
You can absolutely distill your own liquor in some states. You’re aloud 200 gallons, per year, per household for personal use in my state.
1/2 gallon a day. I can make that work
This is very helpful, as I grow carnivorous plants which require distilled water.
hmm maybe thats why my fly traps always die..
@@patrickglaser1560 yup, they DON'T need much at all for nutrients but they're very allergic to all the additives in tap water.
Missouri allows distilling for personal consumption.
Confirmed. Not sure where this myth of illegality comes from.
@@samuelmorgan9691federal law
If you drop a quart or two of methanol into your mash, or more depending on volume, before you distill, it comes out denatured. Do your own math to make sure you hit the minimum legal percentage to be "Denatured."
You have now made perfectly legal Fuel Grade Ethanol.
It's legal in Missouri... 200 gallons a year per household
Spot on with your answers.
In CT if you register your home as a farm and buy a permit. You also have to grow 25% of what you ferment. See CT Committee Bill No. 5713 for more information
To clarify. In 2024 there are 4 states that allow the recreational distillation of alcohol. Missouri being one, missouri state law says a recreational distiller may not make or possess more than 200 gallons of liquor, and it may not be sold or distributed by sale or private transfer
For those wondering what other 3 states
Alaska, arizona, and Massachusetts
It's been legal to distill your own alcohol in New Zealand since a law change in 1996. Before then it was legal to make beer or wine at home and it was pointed out all distilling really does is purify what you've already legally made. You will find a Brew Shop in most cities where you can buy a range of stills, powerful brew yeasts, and flavours to turn your home alcohol into anything you want.
Totally legal in the UK to distil alcohol, but to sell it and avoid tax is illegal.
Tbh the government has no say when you are on your own land / private property. If you bought the land you can do whatever you please. But again, if it's not visible from a public road then the cops cannot do nothing. If they fly a drone inside of your land, then you have the right to shoot it down since it been invading privacy.
West Virginia just passed a law going into effect in April that you can distill up to 10 gallons for personal use per year
Virginia resident here. Can't legally own a still without a license. They don't care what it's used for. Licensing isn't cheap here, either.
Just build your own still bro
@@chair4174It's not a matter of not knowing how to make one or having the funds to purchase one, it's living in a small town where everyone knows everyone else's business. I want to still with the hope I might sell it legally later on, but the laws in this state are not encouraging at all.
Oh
What about medical alcohol? For disinfecting and cleaning purposes, does that require a permit?
Getting prohibition vibes when anything required permits/permission 😅😓 , this is why we can't have nice things 😓
Land of the free indeed
You can in Tennessee. Up to 6 gal for personal use
You can in Missouri.
As lord Sidious once said “I will make it legal.”
Literally just started fermenting rum only to find out from my dad that distillation is illegal in the uk without a license. I'm gonna do it still obviously and I beg any uk fed fed to stop me while I'm blind drunk on my shitty rum 😂
Your country needs far more of you. Just don't let Mohammed see it
You guys should send over a distiller for me to do a review video on
Here in the UK, home distilling alcohol is illegal without the proper permits and licenses. I think you can distill water legally though
Only if you are caught 😜
you need to send a fuck king George letter.. we did in 1776
Legal as long as u don't get caught 😉
I come from Norway. A country well known for Moonshine. It is illegal here to simply have the device. But there are politicians here who want to decriminalize making Moonshine . I hope they get to the point. Thanks for your site and all the info you provide. Happy New Year. 😁😁 New year and new opportunities. 👍👍👍
is it really persecuted, or is it just legally not allowed?
@@danieldanielson2650 It is not even allowed to have the Steel. A law the politicians brought in a few years back.
Idk it's legal in michigan just not federally and michigan likes keeping federal laws away from said land
The government can take a long walk down a short pier
I love distilling “essential oils” in my 6 gallon keg still
Canada....here, no permits or anjything else required...other then you cannot sell it legally unless you go through the craft distillery paperwork and have a few milion dollars to toss around.
it is legal to distill your own alcohol in Missouri. up to 200 gallons as long as you don't sell it
Land of the free
That ended pretty quick into the nations history. Prohibition and forcing young men to fight in foreign wars for government profits pretty much dispells that myth.

Question. Did a practice run of a a gallon of boxed wine, threw the heads out. The run gave me about 2 cups of liquor. Did a second run on the liquor I got out of the first, but was wondering if I need to throw the heads out of the second run as well?
Mmmmm yummy distilled water lol
Stupid laws we have in this country sometimes. You should be able to make whatever you want at home liquor included. Our government needs another reminder of the tea party.
If you're just going to distill water, say to have a clean slate for brewing, do you really need an elaborate setup? Or will a simple pot type still work?
I wonder if this is more efficient than RO. I get distilled water from the store but it would be nice to be able to do it at home.
RO is a step below distillation, both are great though the latter is best.
Just like the marijuana issue....some states may allow it..but it is federally prohibited.
(Permits exist but are difficult and expensive)
Untrue if you look it up there are a handful and Massachusetts is one of them
where did the government get the right to control the people I thought it was supposed to be the other way
I might be wrong but texas I think you can make 3 gallons.of whiskey a year. 😅😊 and 50 gallons of beer
O well do it anyway and its amazing
It's not whisky it's an organic food safe solvent
WV you can

Legal? What does that mean ?
I thought it was only illegal if you're selling it not making it for yourself?
Free men don’t ask permission.
Is that glen howerton?
I believe government with corporations does not like competition. Since this distiller dies other wirk like for essential oil and rose water which I am more interested. Are you trying to say government doesn’t even allow to make my own for cosmetic purposes ?
who cares ive bean doing it for awhile and no ones come knocking on my door about it
If I brew a Meh batch of beer, would it make a decent liquor you think?
"You can't legally..." Merca
Where does it say you can’t distill in the constitution?
actually 4 states allow distilling for personal use.
My household thrives on purified water and you can never really trust what your going to get 😂 who's the one they should really be watching anyways 😂😂
It's legal in canada
Woah really?... huh I thought that was why on the animated variant of a comedy show titled Cornergas they were hiding it... when making either ethanol or fuel etc
Ill do as i please... they dont own me...

Americans online: Freedom!!
Americans irl: its illegal im mos states
Just out of curisoity, is there any way to know how to make cuts based on timing vs by taste if someone is using something like an electric air still? If I was going to distill, My taste buds are not sensitive enough to taste the difference between heads, hearts and tails and need a way to go by times at least roughly. For example, "first 8 mins is heads, next 12 mins is hearts, last 15 is tails". Is there some sort of rough guess timing like this that someone with very insensitive taste buds can go by?
Half or little more than half of a jar which ever you prefer

Freeze distillation is illegal in the US.
That being said, what are they going to do, ban freezers?
@@imstupid880, I checked it with the ATF website, heat distilling is illegal unless for medicinal purposes such as alcohol hand sanitizer

Missouri let's you make a curtain amount for your own consumption. Buddy of mine chief of police near boliver
Entirely correct someone who is 21 years of age or older can make up to 100 gal. a year or 200 gal if there are 2 or more adults living in the home for personal consumption

Everything is legal if you dont get caught.
That depends on where you live at! over here equipment and distilling at home is illegal!

Yep, in the UK it's legal as long as its for personal and even then, nobody cares. If you sell it they care from a tax purpose, nothing to do with health.
Happy drinking !
Not true, home distillation for personal consumption is still illegal in the UK as the duty is due regardless, but there hasnt been a single prosecution in over 200 years, so its definitely not gonna get you in trouble.
people die ingesting improper heads of stills....
You are wrong the law states that you can legally distill spirits at home for home or family use. But the law clearly states you are strictly prohibited from selling your home brewed spirits. But it is perfectly legal to distill alcohol at home without permits.
For consumption might I add
Might want to check your sources on that
how you can grind your own coffee and pressure cook it you cant make ur own wine and do the exact same thing, basically. lame. you would think it would be safer. cleaner.
It’s about tax, not safety or cleaning😂

Please 😂 no one follows the rules I do what I want and I make liquor
Well just to be safe better make it soemwhere somehow for at least a little while for the purpose of testing out the waters... but not get in trouble for selling such as in one of the 5 states that legalize making moonshine... some with some limit on the number of gallons allowed a year such as 200 gallons of it or something but yeah oh and for Arizona it needs a permit and still registered with state but yeaj pick that or even one of the other 4 like Missouri for a most central location to travellers presumably if they wanna drive a few hours or so to reach the source or for a more probable to be greater possible and ALSO presumably crawling with potential customers then Massachussetts maybe for it is surrounded by several states so that would be possible potential for being full of the most likely customers of coming over to massacjussets for moonshine etc :D that is n9 joke probably a good idea I thought of..even though much more in depth thinking would be an obvious thing to do but yeah for not being a curiosity/thought of a potential idea of inventing various ideas I have had over time it still does sound like a nice idea... yeah oh and new york state and New hampshire state border it so both would be crawling with potential customers or also in Arizona to do so for people cming from california or really any play near arizona withing a feasible distance to buy moonshine for me...obviously only made for adults to enjoy as it would be not like one of those weird situations like how the rumour about apparently a charlottsville nc lady was said to have been found selling moonshine from her home/day care center or whatever she thought she was doing cause nah just **bruh facepalms** a daycare center like why expect that to be a place to market moonshine XD ykwis
Just walking out your front door in the United States 🇺🇸
You’ve just broken 6 different laws
But we get only what we vote for I guess 🤷♂️
Better to ask for forgiveness then permission 😉😉
U can in the UK 😂👌👍
Might want to check that again. Distilling (and even adding flavourings to existing spirits, "rectifying") is illegal in the UK. Even for personal consumption you need a license from HMRC.
Of course, in reality no one is going to know. But technically anyone going into this should know the laws.
They don’t have freedom of distilling water at home but can carry AK47 on streets. 😂😂😂
Comments that this is written by people from a "free" country))))
I wonder if there's any reason it's illegal other than Big Brother having to have his fingers in everything. Let's see how long it takes Stalin to take this one down.
