    Michael, I am very surprised you are not mentioning the EB1C option. The E2 business owner would open up another affiliate/subsidiary/branch business in their home country, hire themselves as an executive for that business, and then after a year apply for EB1C as an executive for their US business. No perm labor certification required AND a green card can be obtained in less than two years from the time of application. Am I missing something?

    • @1FighterX
      @1FighterX Před 3 lety +1

      Yeah, but nah ... sounds sketchy ... unless that another branch is genuine with real customers, suppliers, revenue, and taxes paid in more than 2 different countries; that’s when it truly is a “multinational” business

    my I-140 was approved back in 2015 and my I-485 has been pending since then. My employer revoked my I-140 in 2018 because of the length of time that has elapsed for the USCIS to process my I-485. Will it affect my I-485 or is too far in the process to be affected?

    I am married to a US citizens since 2016 we have 3 kids all US citizen and I have been on my E2 since 2019…. I also bought a house last year. It is clear that I would have no problem applying for the i-485 but my real problem to change my status to an LPR is the requirement they have added in October 31st 2020 which would coerce me to get the covid19 vaccine. I was hoping they would remove this once things calms down a little but it seems it will not be amended…

    • @AshooriLaw

      @@zerkalistic1840 Sure, the basic idea is the for an E2 visa, the business must be considered an active business (for example: a restaurant, mechanic shop, cell phone repair shop, etc.) Real estate businesses can either be active or passive, so its important to make sure that the business is active. A passive real estate business would be if someone just purchased a home and rented it to a family. An example of an active real estate business would be a company that buys, fixes, and sells multiple homes regularly (with a team of contractors, real estate agents, etc). The important thing is to make sure that the business is active and not passive. (Please keep in mind that there is more detail to this as well, which would be best to discuss over a call).
