I don’t see any mention about where to interview. I think it’s inferred that if the beneficiary is outside of the US then the interview has to be held where he/she resides.
It's on question 61 and 62. Buddy if we tell them they made a mistake and we did state we want consular processing outside US. Can they correct it so we don't have to pay that form 824 fee?
I am going to file marriage based greencard for my spouse who is residing outside of US abroad in Canada. Our home country is Nepal: about native written language is Nepali but we do use English. So we should include that information in that section ? Also, for section 62.a which country we should mention as he is living in canada right now in work permit since 3 years but we have citizenship from Nepal.

For those of you wanting to speak to a live person at USCIS, try these keywords or otherwise you will just go in circles with the robot. Try saying UPDATE CONTACT INFORMATION. I have no idea why they make it so difficult because if you don't say the proper keywords, they robot will just say send you a link via email or text for more information. I hope this helps.

Hello Ksenia, this is the case: The husband submitted a Family Petition of a wife and stepdaughter together. The mother process was admitted, but USCIS did not send the I-797 Notice Action of Form I-130. The wife received the Forms I-797, Notice Action of I-485, and I-765. All the Forms of the stepdaughter were rejected. Now, he is worried about the answer to Form I-130, page 8. Part5. Item 1. Have ever previously filed a petition for this beneficiary or any other alien? The answer: Ye, because his wife I-130 was admitted, but he does not have the date filed due to USCIS did not send the Notice of Received. What can he do about this? Also, he has doubts about the question. "If you are also submitting separate petitions for other relatives, provide the names of and your relationship to each relative." Relative 1: Does he write down the name of the wife again?. So, the wife and daughter can have the process at the same time and on the same day as the interview? Thank you for your answer. Gladys

Hello Kseniya, I'm wondering if you have a video explaining in more detail GC holders petitioning for their over 21 sons/daughters, my concern is if you have more than one son/daughter over 21 do you have to file separate I-130 petitions? and if they were under the age of 21 is there a difference? I think they were updating their system around the April 25-30 timeframe because whenever I log in to update it would give the error: We were unable to retrieve your form. I tried using another browser and also creating a new account. I spent so many hours on this and now have to start all over. I even tweeted and tried calling USCIS but no help from them. Has anybody encountered the same issue? I do see now the online form has changed a little so they definitely were in the process of changing something.

My husband is the petitioner, and as what I've watched from your other video I can still use my husband last name even if it isn't listed on our marriage certificate or I didn't do a name change yet because my states doesn't allow it. So I'm about to do that to put my husband's last name on all of my forms, but what about in this form i-130 and i-130a should I still use my husband's last name or should I use my birth name?

He doesn’t have to adopt them as long as they’re under 18. A U.S. citizen petitioner must file separate petitions and pay a separate fee for each family member

Hi! I just read that submitting a petition 90 before your entered in the is a red flag towards your green card application. Unfortunately we submitted form I-130 but we decided to wait until I have 90 days in the US. My question is because I have already submitted form I-130 will make things worse? You do not, however the entire sibling case takes more than 15 years, so by the time they can apply for a green card, the children will already age out.

Rejected does not mean the same thing as denied. If the forms were rejected and asked to resubmit treat it as if they’ve never been submitted.

@@KseniyaInternational Thanks for your prompt reply! the petitioner and beneficiary on I-140 filled years ago is me. After the approval the I-140, I filled I-485 and my ex wife and I got the green card together with the approval of I-485.

He doesn’t have to adopt them as long as they’re under 18. A U.S. citizen petitioner must file separate petitions and pay a separate fee for each family member

Hi! I just read that submitting a petition 90 before your entered in the is a red flag towards your green card application. Unfortunately we submitted form I-130 but we decided to wait until I have 90 days in the US. My question is because I have already submitted form I-130 will make things worse? Is it wise to wait before submitting form I-485 adjustment of status or should I just send them all?

I am filing a petition for my brother who is currently outside of the US. He has 3 children under the age of 20 years. Do I have to file a separate petition (I-130) for his spouse and 3 children?
You do not, however the entire sibling case takes more than 15 years, so by the time they can apply for a green card, the children will already age out.
