- The plaintiff claims the defendant knowingly sold her a damaged vehicle, so she’s suing for a refund. The defendant says his mechanic told him the vehicle was just fine before selling it, and he believes the plaintiff is trying to take advantage of him.

@@raymondmerchant988 Bought my oldest son a Chevy Cobalt for his first car over a year ago and it's been impressively reliable - He hasn't complained to me or his dad about any repairs other than normal brakes/tires and we had to help get the A/C recharged once while he was away in school.

By the way, I work with people who do auction all the time and they can patch things up goog enough so it breaks after its sold. There is always a trick in the trade and what they do when they patch it up is to make sure it is not driven as much and goes in short test drive and not hit the highway . Now, for her to prove that would be tough but it can be done to anything that it falls a part when someone else has it. This isnt rocket science. Her biggest gripe would be that the mechanic gave her the green light but since the transmission is power train , he wouldnt have known unless it blew infront of him
kaykepop is absolutely right. We buy used thinking we are getting a deal, because we are cheap, or we just can't afford new but doing this means we take some responsibility. No one has a working crystal ball and if you want a full long term warranty, it will be included in the cost of the new car. Believe it or not the warranty is figured into the cost. Maybe the mechanic missed something or maybe it didn't reveal it's self until later as a sudden failure of some part. Yes, I would be just as upset as making a bet at a casino and loosing but that is life in the gambling world and buying used is the same. Win some loose some. @@bjvu9460

Clearly the plaintiff believes that the judge sided with the defendant unfairly, and she's failing to understand that the judge's verdict is based solely on the contract and the law that supports it. It does suck though, so I can't blame her for being disappointed.

But if the seller knew something was wrong with the vehicle and didn’t disclose that information then it would depend on the judge’s ruling.
But in this case, both of them created Fraud because of selling it for $3450, but only claiming $2K.

She took it to a mechanic before purchasing it and he didn't find anything wrong with the transmission. There was no trickery here by the defendant. When you buy a vehicle, every part on it has a limited lifespan. After 100K miles, stuff starts to wear, break down or plain shut down. People will tell you that they have 200K miles on their car and they have no problems. These are the absolute exceptions, not the rule.

@@grizzlysounddj Unless the transmission showing signs of slipping, you'd have to spend thousands to tear it apart to look for wear and tear, which no one is going to do unless it's not working. Unless there's a written warranty, used vehicles are purchased as is. And I mean written. They can tell you anything, but unless there's a written warranty, you're out of luck.

Harvey, if plaintiffs can sue their mechanics because they missed something on a pre-sale inspection, there's very little incentive for them to take the "$100" when they might be sued for $5,000 on something undetectable.

It's a hard case to prove for sure, the plaintiff would have to show evidence the mechanic was negligent in a specific way. But nonetheless it's a possibility.
Home inspection works the same way. Many things can’t be seen to the naked eye and you can only check so much without tearing the place apart.
Doesn’t mean they can’t be negligent or lazy. But it is what it is. Just need to be careful

@@rockobill7637 She didn't seem like the impulsive type that would filter out red flags given to her - I'd bet it was a car that didn't have a transmission fluid dipstick so couldn't be checked, but even if that was the case a "good" mechanic should point that out and give a warning.

If that car is sold 20 times, the city/state gets many times the sales tax of a new vehicle.
I've only bough 3 vehicles in the past 30 years, so the city/state doesn't get much from me and 2 of those vehicles were tax free, since I bought them overseas with the military and went to a state that the sales tax was exempt for us.

The fact that the plaintiff doesn't understand the basics of buying a used car is embarrassing. It'd be one thing if she didn't know before coming to court (though if you're buying a car you should make sure you know your rights as well as the rights of the dealer/previous owner), but to ignore everything that Judge Milian said about to try to educate her is just...oof. Her behavior in the hallway was embarrassing as well.
People complain that the Judge didn't waste time listening to that which does not matter.
She literally has a 0% chance to win this case. It is as is, and her own mechanic stated it was in the condition listed by the seller. That there was an 02 sensor issue.
It does not matter if something went wrong the next day. That is a chance you take with an as is car purchase. It means you have no warranty or recourse against the seller, unless you can prove a material known fact was hidden from you, and that is going to be very very rare.
The judge and all of listened to hee repeat the same thing 5 times. She had her opportunity to speak and she was just a parrot. Even just repeated what she had already said in court to Doug. 🙄
From her opening statement, the plaintiff seems to think that the defendant is responsible for anything wrong with the car no matter what. Even her mechanic couldn't find anything wrong (not that mechanics are or should be perfect), so why should the defendant? Sounds like she wants an implicit unconditional warranty. The biggest indication that something might be about to break is the mileage on the odometer -- which is a common and valid reason for the owner to sell the car. Caveat emptor.
Indeed, buyer beware. A little preparation can help you buy a good used car. Don't be the plaintiff in this case.

They should make it mandatory in school for students to understand basic law. Dealerships should make it a point to fully explain what it means when a buyer sign a contract "BUYING AS IS" This means once you pay for a car and the timing chain breaks in the dealerships driveway on the way out or the engine falls on the ground, the buyer is out of luck........period. You also can never change and interpret the law to suit your needs..

If her mechanic test drove the car and there was an inherent problem with the transmission he would have noticed something and then access service and maintenance history of the vehicle, thats the first flag for any experienced mechanic after visual inspections and diagnostics.

Lemon law in every state is only for new cars. It never applies to used cars. Can you imagine if every used car had a warranty the courts would be full all the time with just car cases. Plus Lemon Laws I think in every state require the auto company to pay the attorney fees of the customer so that is what makes the laws so good. In the US most of the laws make you pay for your own attorney making it hardly worth while to sue.
Too many people love calling old cars "lemons" when they do what every old car does and expecting compensation or reimbursement for them smh.
Lemon laws absolutely do apply to used cars, the judge just said that in New York the lemon law applies to cars with less than 100,000 miles.

143,000 is almost the end of a car's life.
Plenty of cars make it 200,000 miles on the original drivetrain but this one probably had 140,000 miles on the original transmission fluid - If you don't maintain all the major components than something is bound to fail.

I get why the plaintiff is upset, she had the car inspected but sometimes stuff happens that was not discoverable beforehand. Buying a car with that much mileage is a roll of the dice.
Sometimes a transmission fails without warning, other times it will show symptoms like slipping out of gear. Trust me, I've had enough 80's-90's Fords 😅

Oh yeah, I went through a few Fords from the 70's to 80's! I had bought a brand new Ford Escort in 1983. That piece of crap car threw timing belts constantly! The last time was on the 10 freeway going to work in L.A. during rush hour, in the middle lane, and I could not get over! It finally just came to a stop! I am surprised nobody slammed into me! The highway patrol had to finally get traffic stopped and we pushed it to the side! I NEVER drove that car, or another Ford again!! 🤣🤣

I get the plaintiff is mad but that doesn't change the fact that there is no way to foresee most problems that will occur. As for the transmission, if you are mechanical you will understand this. A transmission can operate completely normal and show zero signs of any problems and then in an instant a splined shaft or clutch plate can fail and it will be completely inoperable. The only way to see this problem before it happens would be to disassemble the transmission and inspect every part. That is why it is a good idea to purchase a drivetrain warranty from a reputable company. Many transmissions will last 250-300 thousand miles. But many will fail at 143k miles or even much less.

With transmissions, you don't often know that there is a problem until it blows up. Unless the defendant had a crystal ball, there's no way he could have known that the transmission was going to blow ten days after she bought it.
Whenever someone comes in saying "i bought a used car and it isn't working" i cringe! Look up the law first before taking them into court

We as a family have taken many used cars to a mechanic prior to purchase. It doesn’t matter, they always end up needing repair not long after being told that they are good. It’s the nature of a used car. You don’t know how it’s been driven or taken care of and especially with 100,000 + miles you should expect issues. You just have to hopefully find the one with the least issues.
What is the point of taking a used car to a mechanic if it always ends up a problem after they say it is good??

When I grew up we drove 1960's and 70's cars everyone of them had well over 100,000 miles and kept on running and running. They were easy and cheap to work on new cars are so complicated and the fancier the plumbing the easier to clog the drain. Todays transmissions have a lot of electronics wired into them it could have been a simple sensor causing the problem and the mechanic stiffed her for a new tranny. They told my Mother she needed a new tranny I changed the oil and filter and added a can of tranX tune she never had another problem
As far as cheating on taxes, judge should see both are persecuted for this theft. Maybe the car dealer will not do it again.

Simple to have the car inspected, request diagnostics tests, being certain to use a well qualified mechanic who stands behind his work. Don't expect a cursory glance to expose problems. Remember most used cars are sold "as is" and if you're entering a contract read it thoroughly. Don't be the plantiff in this case.

She is clueless. Must be her first car as unless you're into cars, it's a learning process with knowledge. My second car had a dying engine. Problem didn’t arise until I drove it on big trips, the people that owned it, old couple only drove it to the shops and back. Dealer did right by me and apologised. Took car back and I changed the car, full money returned. The thing I had WARRANTY.

A tidbit of good advice for young used car buyers:
Some things NEVER change, so young people should ask one question when their cars start to have '"Check Engine" light issues. If it was made any time after the late-'80's, the first thing you should suspect and check is the oxygen (or O2) sensor, mentioned in this case. Why?
Because as a long-time professional automotive refinishing and mechanical specialist, starting back in the late '70's, I've had more than my share of run-ins with bad O2 sensors, beginning in the mid-'80's, and especially in the mid-'90's when they were much more prevalent in the used car industry, due to being required by Federal law with their new regulations involving exhaust emissions in new cars made back then.

The plaintiff is spoiled and needs to grow up. The guy may have told her that the only problem was an O2 sensor but there is no way he can know anything else that is getting ready to break down. That is the nature of buying a used vehicle. The best mechanics in the world can only see what's wrong at that moment. They have no magical way of telling you that a certain part is about to give out. She really needs to be taken to a vehicle and explained that there is no way to know when a problem is about to happen. You can go out every morning and inspect all your hoses but there is no way to know if one of the hoses is going to give problems the next day or the next week or even the next month. All you can do is say that the hoses are old and you may want to replace them just in case.
