    Great video Kerry, I have always been advised to use a Independant Lawyer/Notary!!!!
    If you're buying a property in Spain it's crucial that you instruct an independent Spanish lawyer/Notary early in the buying process to ensure that your interests are protected. You're chosen lawyer should: Be independent -This means your lawyer/Notary is not linked in any way to the vendor or estate agent.

      Hi Keith, that's some good advice for sure. You have to know how to find a lawyer you can trust. This company has some lawyers that are used to handling foreign transactions. That's quite important, so they know the process already. If you simply select a lawyer out of the phone book, you are simply rolling the dice. Thanks.

      The same" phone book" you find an Estate Agent you can trust, but both should be independent of each other and all you want is that both parties to act in the interest of you the Buyer! ask Yameley if my advice is wrong.

      No one offers the asking price.
      Never ask the estate agent to recommend a lawyer. The only people who can tell you if a property is legal and has all the right building permissions is the local town hall.
      Don’t bring a car over as it can be an expensive hassle to re-register it. If it’s LHD it could be worth it. Used cars in Spain tend to be more expensive in Spain but they are usually in better condition as it is dry and there is no salt on the roads.

    Good stuff man. Just a general warning to all - if you DO own a property in Spain, make sure that it's being looked well after if you're out of town or abroad. Neighbors checking in daily, alarms etc. There's a very serious and unique situation in Spain where people looking for a home (squatters) may enter a place and if they change the locks within 48 hours and the police isn't contacted by the owner, they may end up staying there for a long time or even indefinitely. You'll at that point need a court order (which can take months!) in order to re-enter your home and even if you bring the police and confront the occupants they won't be able to do anything without said court order.
    DO learn about this stuff before buying a property in Spain.
    There's a lot more to be said about this but this happens to a lot of people so do make sure that you're not victimized by this behavior because if it does happen you're in for a lot of stress and a legal nightmare.

      Hi Rebjorn79, that's great information that anyone who owns property should be aware of. It's a good idea to have cameras installed at your property for that reason today. So you can monitor them while away or have someone check up on them. Luckily we have not had many issues with this happening here in Málaga. There was something going on like this in Marbella.       @@TravelAddictGuy Glad you didn't have any issues. This thing might be more common in some regions than others but I do know that it happens all over Spain. I've read/heard many stories and I've personally witnessed this happening on more than one occasion. Not to be taken lightly.

      @@rebjorn79 There're called "Okupas" it mostly happens to bank owned properties but could happen to any one.

      @@j.m.b5441 Yeah. Many who do this prefer to occupy bank owned property because there's less of a chance that there'll be an immediate stress situation for them because private owners are more likely to take immediate action and put more pressure on the occupants.
      Since the financial crisis banks have taken control over more and more properties and many of them are just sitting there empty. Still, it absolutely happens with private property as well.
      Where I lived in Barcelona there were okupas everywhere and even friends of mine participated. It's definitely something that happens a lot in Spain and it can cause a lot of grief for private owners.

    Hi Kerry good info but not fair on a buyer if they change their mind as they loose the deposit but seller can and loose nothing as said in video just hand back deposit.so think that should be addressed as buyer beware still.no joke loosing 6000 deposit because you change your mind and see a better deal or a better property or a better area.so be real sure a word of warning to buyers.

      HI John, I think you misunderstood something. If the buyer backs out, they lose their deposit. If the seller backs out, you get your money back of course. Everything is drawn up in legal documents, with the help of a lawyer. Otherwise, yes someone could just decide not to sell and keep your money.

    I sold a house i had AEG and car parking space i had Benalmadena on Ebay Uk.If you put all the properties on Ebay Uk you will be inundated with emails and calls. I may contact you guys when i manage to sort apartment to rent Torremollinos. Kerry you are going to be brilliant at this. Spainish banks will not allow you to buy blind which i think is the right thing.

    Me and my wife would like to retire in Spain in a few more years, this has been really informative!
    Do you know if one can have a mortgage payment in Spain while still working in the US?
    And once you buy a property how much time is someone allowed to live there in a year?

      Hello, she told me that you are allowed to stay here in Spain if you own a property. You will need to apply for temporary residency, if you want to stay for longer than 3 months at a time. She has contacted the bank and has yet to hear back from them about the mortgage situation. That really may depend on your financial situation and is more of a question for the bank.       Hi M, Yes I have temporary residency here, because I work with a Spanish company. I have not addressed this topic because it's a difficult one and the answer is different for anyone. Normally you have to apply for residency, before coming to Spain. If I can find a lawyer to interview in the future, I will make a video, otherwise It is very hard to give advice. I am glad that you are enjoying my videos.

    It's better to be free , travel the whole world rent as much as you stay and leave without any headaches.
