our verbage might be a bit different, but we are derivative of English Common Law. (not a lawyer but of all countries in the world, I'd like to think the USA is most similar to the UK. I personally call USA "English 2.0" both linguistically and legally.
we changed colour to color and certain concepts we made into our laws due to certain events of the colonial era.
otherwise, England was our rubric for how to base our laws fundamentally.

My wife and I "Pinky-promised" on our vows at our wedding! Now we have a wedding license, and we're 10 years strong into the contract. But our preacher had us "pinky-promise" right before the kiss. I think we're bound to more than just a legal agreement here. ❤😂❤

That’s adorable! My hubs and I got our marriage license and a week later went to the courthouse. We used the standard vows. We had been together for ten years so we figured we would make it official lol been together (in October) 27yrs, married (August) 16yrs married this year. Using my cousins wedding this September to have a sorta second honeymoon.

It's true. I sued a dealership. I used the text messages and their ad for the car stating it's their business conducting business from their property. I won the case without a lawyer lol

I am in California, and during my job interview I told them I would accept the job offer on one condition that I would take a specific mode of transportation since it was the safest and easiest way to get to work and if that mode of transport was canceled because of holidays and other specific times I would require the day off. It was brought up in an informal interview with a few other managers present. It was never put into writing since the company was large and the forms were generic. A few months later all those people quit and went to other jobs. All the new managers come in and saw my situation and said we don't agree with this and we won't accept any verbal agreements. I have already been written up twice with the new change including not working on the clients holidays where my site is closed, that don't align with my company's holidays. And a verbal warning for taking lunch too early where I would come back with more than 5 hours left in the day.

Ugo's long-form content is seriously underrated. I know he gets the big views on the shorts, but these longer form videos are genuinely worth watching. I'm not even American, I just love the way he educates us, it makes me want to learn their law despite not living there. His energy and enthusiasm is really enjoyable too and definitely keeps me coming back. Of course the cherry on top is the addition of comedy.

Just an FYI- In my family (my Great Aunts & Great Uncles), they conducted all their business with a handshake. All of them were very religious & ethical/moral codes were a way of life for them. If they told you they would do something, you could 'make book' on the fact, that they would follow through exactly as they promised. Boy, have times changed.

Brilliant content as usual! This video helps me with a step family member who begged to borrow money to avoid losing her home. I documented by text that she asked to borrow the exact amount and that she agreed to pay me back before sending her the money. I also made a point to make her admit that she understood that it was not a gift and that I expected to get my money back. I made her confirm that she understood all that before I sent the money by Cashapp. I also documented the purpose of the money transfer in the note of the cashapp transaction. But of course she did not pay me back. Anyway again, this video helps a lot. Loved your content, even before this one! Have a great weekend!

This is great info to start my research. I have an oral/text msg agreement with a company to replace a door at a certain price. They emailed me the contract, BUT there is a stipulation that I cannot or dont know how to fulfill. Texted my issue of moving washer/dryer from the room. I have not signed the contract and I havent heard back from them yet. Really need a door, but I am waiting to see if I could legally go with another company. 🤔 🙃🤪😮💨 ok let me listen to this video again. Thanks

Little known part of Contract Law. If a person has a Guardian, the contract is unenforceable IF the Guardian doesn’t validate the contract.
Time for an example.
A 29 year old adult with severe schizophrenia takes a Payday Loan of 700 dollars. They agree to the repayment structure and during the approval process for the loan, this person mentions they have a guardian and the contract would be unenforceable. The employee still processes the paperwork and hands over the money.
A day later, the person’s Guardian realizes what happened and refuses to validate the contract.
The person taking the loan and has the guardian, does not legally have to pay back the money. The contract is unenforceable.
If the legal thing ever gets rocky, Ugo could have an amazing career in horror movies with that wide-eyed gaze of dramatic emphasis. Can you imagine. The cosmic horror monster emerges from around the corner, and his eyes just get bigger and bigger... Just epic. (Don't even get me started on whether Ugo seems like he could scream with volume and feeling.)

I did that and when i loaned someone a piece of music equipment that they refused to return and then try to deny that they had it. I just walked into court and played the video and walked out paid...🤑

Just took contracts 1 for a masters in the study of law (for a lawyer adjacent profession!)…. Wish you had been our professor! Or that you had these long form videos to reinforce the concepts! But they are still super interesting so I don’t forget the concepts! 😂

Sometimes enforcing such things can get you in trouble. A guy I knew struck a dynamite deal with his job and it turns out the job tried to back out months later. So he brought it up so he could get paid what he was promised. Well they waited for him to make a simple mistake and fired him.

Re written agreements being better than oral: From a legal perspective, this is correct (a written agreement will always leave you in a stronger legal position), but it is often impractical. For example, if I walk into a store, grab an item off the shelf, bring it to the counter, hand them the appropriate amount of cash, and leave, that is an oral agreement for the purchase of goods, and (assuming the price was below $500), it's valid and enforceable. Nobody in their right mind is going to pull out a pen and paper and try to sign a written agreement with the cashier (especially since most places will give you a paper receipt on request, which provides most of the same protections as a written agreement would).

I saw caveat on the thing about paying with legal tender. EG paying off court costs with dollar bills. Ordinarily yes you can pay off your advocated payments with any legal tendwr. however; in one particular case a judge was frustrated because a plaintiff was repeatedly paying off multi-$1,000 payments with dollar bills. So the judge ordered the defendant to only pay the bills in denominations of $10 and above. No one or $5 bills. As it was a waste of the courts time to have to count the payments since it was pretty obvious that was the motive of the defendant.

A topic that could be interesting would be about collecting money from a civil suit that isnt enough to afford to hire an attorney. Like wage theft from employers (& in my case, restaurants). I won a default judgement and there was no way to actually collect it. And I paid the court fees!!
Collection is always the hardest part of litigation. I will look into doing a long-form video on it! (unfortunately, jurisdictions vary widely on this topic b/c it's a procedural issue, but let me see what I can do! 😅)

What about emails? Back in 2017 I had made a deal with a guy to buy a trailer home via email conversation. I was first to look at the place in person. Since other party was not there, I replied to said email conversation saying I'll buy it and asked when to meet for title and cash exchange. He replied back telling me 3pm. This was around 9am. About 130 I get another email from the seller saying it was no longer available as he sold it to someone else. Thoughts?

Yes, it absolutely could, but there needs to be a legal concept known as "consideration." Simply saying, "I promise if I win to split it with you," is not enough b/c there is no consideration. But if two people each put in $5 bucks and promise orally to split the jackpot if they win, that's legally enforceable!

exactly! our memories fade after too much time and two parties could innocently remember things differently. So 1 year is the cap for oral agreements!

Judge Judy ruled in favor of oral contracts. Granted, we all know the show is arbitration rather than an actual courtroom but as we also all know, arbitration is legally binding it’s used all the time and the way she explained it she looks at the facts of the case. She looks at all the evidence, and then she’s able to concludethat it’s obvious to anybody with a pulse that there was in fact in oral contract
