    Took me 15 years to get 90%... Took me 12 years to get to 10% disability. Sometimes a change of Location where you refile and get seen by contracted medical providers get you approved like I did. Moving out of state helped me. (California) Good luck and thanks for also serving everyone.

      I got out in 2003 at 20 percent, took until 2021 to get to 90 percent. Your not alone.

      Those 15 yr + 12 yrs, are very bad after you gave your best! Well, I too; rode on that same slow bus with you... Applied in 1980, rec. O % in 2014 I was awarded 60 %, today 90 %>>maybe after death I'll get that 10,%...Mario Housie...

    Even though this is a couple of years old, it has so much information that I found very valuable . I recently as of last year retired from Naval service , and I had no idea these things were possible. Throughout my 5 reserve deployments to the Middle East , no one has even mentioned filing for service connected issues. And like most Vets, I was reluctant to seek medical at the time of most of my issues.

      Same. I knew there was something wrong. Dramatic weight loss, psoriasis on face and scalp, skeletal degenerative issues, chronic pains, obvious immune disorders, fatigue...etc..etc. I went to one civilian doctor 3 years after discharge and they avoided responding to me when I started getting specific. So, I just "sucked it up" and went though years of issues, job losses. A few years after that I went to a VA outreach clinic about neck / spine degeneration and pain, and not one mention of filing for service connected issues.
      Pathetic.

      Yep, thats what they do, i was seeing VA psychiatrist for years, not once did any of them say i should file, its all BS, go to a private firm, they know how to get what you deserve, you have to pay them once you get rating, but if you dont do it youll get nothing

      I have cervical spine stenosis. I have mri, ct scans and x rays... I've had 2 consults with a va neurosurgeon. I need to have neck surgery. I'm dealing with chronic pain. Anyways. I was a 11c in the Army. I packed a lot of very heavy Mortar gear around my neck.... How can I prove service connection..

      The military won't provide any help, you have to look outside of Uncle Sam to get real help. They aren't going to tell you how to take money from their defense budget, lol.

    Absolutely don't wait if you are getting out or are recently separated. I waited and even with medical records showing injury to knee, I was denied. Now I have to appeal with additional info.

    Very helpful explanations without a lot of fluff involved, thank you. I was exposed to a Toxic Chemical and hospitalized over night for it. It is doc'd in my VA record and I have been having issues that my doctor outside of VA recommended I see them to work it out. At about 10 minutes in and further along too, the description offered in the video was very helpful for me... hopefully the VA will recognize the obvious connection even though I was not in those military areas or times.

    I am an (officially) Retired Military Veteran who served from February 1982 to February 2002. From 2002 to 2009, I did not address, connect with, nor submit for any VA benefits of any kind - including basic VA Medical Healthcare benefits - nor did I submit or file for any physical / mental disability claims. However, in late 2009, I finally connected with the VA for medical healthcare benefits and was eventually ("slowly") authorized and accepted into the VA medical healthcare system. Then, several months later in late 2010 or thereabout, VA Mental Health Doctors diagnosed me with:
    - PTSD
    - MST
    - ADHD
    - OCD
    - Depression
    - Anxiety
    While much of my case - my overall wretchedly poor physical/mental health condition; and personal life situation as related to one's quality of life is not being explained and described in full graphic detail here - however, I will add that sometime around 2010 or 2011, the VA awarded me 80% service connected disability, along with TDIU which then positioned me into a 100% payout category. Now, at this point in my situation and story, this sounds and appears to have been a good thing which it truly was.
    Now, though, after severe struggles with my ongoing battle against significant, long-term Depression and Anxiety for about 25+ years or so - I recently (8 months ago) experienced another severely traumatic event in my life which could be perceived and observed buy some mental health professionals as C-PTSD (which is NOT in the DSM-5, though) ... and, as this traumatic event seemed to have laid down the foundation or groundwork for my now more recent ineffable physical/mental welfare ... the VA Mental Health psychologists & psychiatrists expeditiously moved toward and jumped past this recent traumatic event by going to their "quick place of plastering and laying upon me a new title and tagging" of now having Bipolar (mental illness) disorder, and sending me the very strong signal and implication that I will be in this lousy, undesirable condition for the remainder of my life.
    Hopefully, if you can imagine, my brain and mind is not in a good place nor in any real, decent working and functioning order, especially since if, in fact, I am Bipolar (mentally ill) and only a few of my hereby mentioned symptoms that I am having entail me to being in a near 100% leaden paralysis (i.e., near complete & total inability to care for myself on the most simplistic of daily Life sustainable functions and personal care hygiene, etc., activities).
    Currently, I'm being highly pressured and strongly influenced from the VA doctors and case managers that are pressing upon me to take another Neuropsych Testing for RE-verification of my current mental health status, for which I can easily imagine and understand this would help me in the short run, for the most part, whereas to receive the best mental health care: (psychotherapy and medication management support) once they can solidly confirm what my true and accurate final diagnosis actually is.
    Conversely, however, I am very, very mentally ill and in a near 100% non-functional life sustaining condition, whereas I feel like my body and brain is literally withering and breaking down, minute by minute, hour-by-hour, everyday of the week, all throughout the entire month - month after month. THINK: A human vegetable-which cannot take care of himself on the daily, everyday of the month-And, it feels as if there's literally no light at the end of the tunnel. Now, in this utter state of desperation and a dire need for wise counsel from someone, as well as a safety net of sort since I feel like I'm at the edge of a Cliff. . .
    ♦ What is your best and wisest council as to what I should do-in the near days ahead-since I am not someone who can really afford a major drop-down and significant reduction in monetary Compensation Benefits if, in the worst-case scenario, my new diagnoses of "Bipolar" might in [somehow or some way] wipe out or take away from the original mental disorders that were initially assessed and misdiagnosed upon me by the VA Psych doctors themselves?

      I told person behind me I’m gonna stand over (closer to 3d window) here so they can c us n start calling us That didn’t happen. When my turn cane n I stepped up the clerk said I need to stand in line. I told her I did ask him He was behind me. I stood over here so y’all could c us n call more people She refused t check me in n I refused t move for her t check anyone in After literally a whole min or two my psychiatrist cane out to call me. He knows I have low tolerance but I just as Danddy as COTTEN candy.

    There is also another way to get service connection for disabilities that you had prior to service or potentially even that you got after your service. I would suggest that anything that you did while you were in the service which permanently aggravates a pre-existing condition or even something that you got after service will be covered. As an example if you have spina bifida and the military let you in and you join combat arms and your service permanently aggravated spina bifida it will be service-connected. Moreover you have issues that are presumptive service-connected disabilities in which case the Nexus has already been proven.

    I asked my primary VA doctor if I have a deviated septum. He wanted to know what and I told him. He ordered a CT image of my sinuses. Turns out I have 1/4 inch off ceter deviated septum and a chronic bilateral sinius infection. Get a CT Scan if you have Sleep Apnea.

    My DD214 honorable discharge document was deliberately altered by unknown military processing personnel omitting critical information indicating the type and severity of injuries causing a 100% disability rating. What can be done to resolve this grave travesty of justice which resulted in +50 years of lost disability compensation? If I had altered a DD214 to unfairly acquire benefits, one year in prison would be served for each infraction, yet it appears the VA is not subject to punishment for indisputable proof of criminality. Why?

    Types of documents that I found helpful and that I’m certain others will find helpful your DD 214, and if you can get a copy of your units history and combat… IE… Where you were and the things that you did, battle roster number, all of these things can help you prove what you did and who you were attached to. A place where this might be of help is with the Cavs me a bunker site that was blown up with hand placed explosives during the first Persian Gulf War having the units history battle roster number all of that was super important

    I had to request my records from a specific hospital to present my evidence. The SF-180 is what you need. Takes 2 months to get it back. It’s worth it. It shouldn’t be like this, but unfortunately it is.

    Yesterday, I was only able to refile to get my disability raised and and was unable to refile to get my back pain rated again. The service representative said because I didn't appeal the last denial for my back issues related to a nerve stimulator implanted wrong then took years to get it out. It was implanted for my service connected disability of the right taylor fusion of the right ankle. How can I get that connected even if it was denied. The VA subbed out the extraction of the stimulator and have yet to receive those records. It is not in my records I requested from the VA.     What if they don’t tell you that you had an in service injury or disability when you discharge. Thus eliminating your ability to file or prove the injury or disability actually exists?

    I am applying for direct service connection for memory loss and essential tremors due to mercury poisioning as a dental assistant in the 1970's. I just recently discovered mercury is likely the cause. I have the following evidence
    1. Testimony by a Navy dentist I worked with that we handled mercury in what is now known to be dangerous ways. The CDC states this handling procedure resulted in CONSIDERABLE EXPOSURE.
    2. Current diagnosis of both medical problems
    3. CDC statement that this mercury exposure can cause permanent brain damage that can result in both problems.
    4. Statement from the dentist that he witnessed my essential tremors start after we returned from Vietnam.
    5. Medical nexus statements from a VA Neurologist and the Navy dentist that they conclude that my current symptoms are MORE LIKELY THAN NOT and AT LEAST AS LIKELY AS NOT the result of the mercury exposure.
    Any advice? Predictions?

    Can a Chiropractor's diagnosis of degenerative disk disease in the lower lumbar and neck be submitted as evidence for a back claim to the VA?

    This is very helpful, in the aggregated portion is their a limitation of when I should have tried to file. I tried to start a VA claim and I was told I was not considered a veteran, this was in 2015? I am on disability for my back also.

    Ok, I had an incident when I was stationed in Italy where we were moving a large container inside a shipping container. That was a common thing for us to do. As a joke the other 7 people moving the container after we were at almost a full run stopped pushing which caused me to bounce of the container like I ran at full speed into a wall. After that I became light headed and could not stand up. I was sent to the doctor on the post then to a hospital off post. I had a very difficult time explaining to the doctor that I was feeling dizzy and my back was just in pain because he didn't speak English and I was only able to speak a few words in Italian. I also started to file for a claim when I first got out but was unable to get to the appointment and it was really not a situation that caused me to not be able to work but I was told to set up an appointment because when I was ask I said I was having minor back pains on a frequent basis but they where not restrictive. I also served during the Gulf War. I now have arthritis that I believe started with the incident that occurred. The fatigue had started shortly after I was discharged but again had very little effect on me until several years later. In the past I have not wanted to try for disability but between the arthritis and fatigue I find myself easily aggravated and sometimes just angry for no other reason than I am so tired even after getting a full nights sleep. The agitated state I am often in now has prevented promotions.

    Question I got out in 1995 and I was diagnosed with major depression before I got out of the military but when I got out the VA gave me 10% disability. I recent refilled and the VA bumped it up to 50%. I’m am also trying to file my sleep apnea to the mental health. Is there any chance I can do that?
    I was there anything I can file or if I served in Desert Shield started in Aug 1990 till Nov 1990

    I had two Arrithma surgery and second one was successful. Problem is lately I have had three hospital admissions due to elevated heat rate. 150 above, 138 to 145. Last was 120 which lasted six hours. A IV corrected last visit. I am trying to connect this to military service. I’m also bricardia. That was told to me while in military but the problem is I cannot find it documented in my medical records. My cardiologist said that if I am bricardia it could lead to Arrithma. Any advise from anyone appreciated. Thanks

    Hey guys, great informative video. Can I make a suggestion on your recording. Please Isolate your mic from the table. Every time your guys pound on the table it reverbs and I keep finding myself jumping and turning around and becoming a bit jumpy. Just a thought as you are speaking to vets who may have PTSD.     Is crazy I have 12 diagnosis plus an extra four that they find out thru MRIs been dealing with va for 5.5 years and the same automatic denied letters.When they denied I can tell that they never applied benefit of doubt,duty to assist by how they explained the situation very vague and ambiguous statements of the case etc.Now I'm at BVA level and hopefully something might come to light to show what the CFR law means and when it should be applied instead of using VA law to Railroad all veterans.

    What are the legal statutes for getting your rating and benefits retroactive especially when the Nexus records were not ever obtained by the VA until 5 decades later, after having been requested upon discharge, which led to a finally getting a 100% rating for PTSD! Also getting your tdiu retroactive to the date the VA stated the veteran was eligible, even though they refuse to give him service connection and only pension? Those court cases and statutes concerning these issues would be greatly beneficial!

    YES I AM A VIETNAM VETERAN AND CURRENTLY GOING THROUGH TREATMENT FOR COLON CANCER AND LUNG CANCER TWO DIFFERENT CANCERS. MY COMPENSATION IS RATED AS A TEMPORARY CONDITION, GIVE ME A BREAK HAD SURGERY BACK IN 2018 THEN AGAIN IN 2022 FOR COLON AND LUNG CANCER.

    I tried all the avenues you have suggested in the past and still have been ignored by the VA. Until they finally did get the Nexus records I had been requesting for five decades in 2020, but then only gave me my 100% service connection starting the date they acquired the records I had been requesting for five decades! Again ignoring all the suggested avenues I employed in my claims! In all the prior claims they refused to give me C&P exams as well and finally did give me the c&p exam they should have give me a 1970 when they receive the records finally in 2020!

      Because of the nature of my assignments mainly in Laos and Cambodia coming in through Vietnam at the dates I was assigned in Laos and Cambodia my service records DD214 only reflex 11 months foreign Service and does not state where that service was! The VA denied my claims stating that we were not there in Laos and Cambodia during those times early 69 through mid 70, but we now know that the United States was involved in those countries on the ground during those times! Still the VA refuses to give retroactive benefits! When the VA denied that claim stating that we were not in Laos and Cambodia at the time they tried to say that that foreign Service was shit board. When I refuted this stating that nobody keeps better records than shipboard duty and tell me where that duty was if so, they simply denied the claim for an entirely different reason instead of arguing the point and showing where that foreign Service could have been other than where I stated! To my knowledge it's not legal to deny a claim for something entirely different when you've refuted the point and they refuse to continue the argument!

    it's helpful, regarding...frustration?...to remember that the VA is not a monolithic organization (kind of insinuated here). Yeah, the regulations are, but contact is made to specific individuals who may or may not be up to date on what the current regulations or lawsuits might be. Yes, it can extremely frustrating but last I checked no one in the VA system is omniscient. Don't give up, but be ready to cut folks a bit of slack when interacting with them. Kindness costs nothing.

    I served in the U.S.Navy from April 1980 to April 1984.During an overseas Westpac before making port in Hong Kong our ship came upon a boat of refugees(20 or more)that was in the process of sinking.onbo ard there were a few dead peo ple,including a woman holding a dead blue child.or ship took the survivors onboard and used the 50 Calibur to sink thi er boat.and took them to Hong Kong where they were in board ed.i received a Humanitarian s ervice medal for it.But i still have flashback memories of it upon certain water,boat/ship,military movies and show s,and of dead people.and still have dreams/nightmares toda y-- 43 years later. Am I eligible for PTSD disability rating from the VA???

    Presumptive SWA: Must have a current diagnosis with aligned diagnostic codes. Recommend six months+ of treatment from a real Doctor. Any med, save all receipts of fills, refills. Going through this now for IBS presumptive primary. DD214 states two SWA tours. Wish I saved orders with precise deployment dates. Note your yellow card shot records document a date of all the shots you must get before deploying.

    So I served 10 years in the infantry I had a right ankle surgery on active duty and now my left knee is going out I was 17 when I enlisted it’s the only destructive job I have ever had how can I prove that my knee problems are due to running and walking with heavy gear and Rick for 10 years

      Honestly, go to a private sorce that specializes in getting ratings for Veterans, NOT a VSO. then get a DBQ and a NEXUS, they will be able to file all the correct forms, schedule DR. appt. ect.

    OMG. I was stationed at Camp Lejeune, right out of boot camp (August, 1975), up until I went to Okinawa (roughly March, 1977). and lived on-Base in the barracks. Since then, I have had a kid that died of SIDS, (Sudden Infant Death Syndrome),1983, and have a BI-POLAR daughter, born in 1981 (40 now, living with me), and on May 10, 2020, I went into the VA Hospital with Gangrene, almost died, and now have a colostomy bag, attached to my side, and actually have a tooth that has dropped out of my mouth. Not sure if I qualify for this stuff, but...

    This has been helpful. I had a claim for toxic exposure denied because of the nexus letter. You said that I could claim in other ways. I was exposed to PFA's while in the Navy 1974-1979. I have service records of training for fire fighting and ship deployment that also fought fires with AFFF foam. IS there other help for me?

    During the Vietnam War I served in the Army Security Agency as a high speed morse code intercept operator O5H20 stationed in Augsburg, Germany. I developed tinnitus and hearing loss from my military duties. I have had this condition for 46 years, since 1974. I have been to two VA Centers and spoke to clerical people and have spoken to a local Veterans Service Officer and to a Disabled Veterans Service Officer to obtain a copy of my service medical records. It has been a couple years and
    I have not had any response from the Veterans Records Office in regards to my records request. Am I still eligible for help for my condition? Steve Karkkainen

    Was wondering if a comp and pen examiner should be pushing and pulling on your neck while during the range of motion after you are already at your painful point and them measure it with their tool. When they know you have three pinched nerves and spinal stenosis. It's all service connected Now have a hard time moving my head and neck

    I am service connected for diabetes. I had back surgery when my A1C was over 11.5. As a result my spinal cord became infected and I lost the use of my left hand. Medical practitioners at the VA told me but for the diabetes. Can you help?

      Charles, a claim is made online, at the VA.gov website. It's a very easy thing to do. And you can go at your own pace. At the very least, open and stake the claim which produces a start date that they can back pay to.

    What sort of a legal stand do you have when you requested your medical records upon discharge and the VA only obtained partial records missing the Nexus files and you requested those Time after Time and the VA never explained why they did not obtain them but did finally obtain them in 2020 5 decades later?

    Where would our entrance exam be. I have never known we had recorded. How do I get a copy of it? I have requested a complete copy of all records in my Navy records , a copy of my National Guard records. I was in the NC National Guard for 2 years & had a hearing loss by tank firing.     Referring to 1151 claims. During service I sustained a fr actured jaw. Years later during dental work by a civilian dentis t,I found out that my bite was crooked with a gap on one sid e(left).I had an infection in my gums resulting in 65% bone loss of my jaw bone.needing tooth removal and a lower and upper dentures plates. It gave me correction of my bite allowing me to chew food properly. But apparently the naval dental doctor did not set my jaw correctly at the time. Is a 10% rating given by the VA for disability to me adaquate and right??

    Diagnosed with Multiple Myeloma at age 35. General belief is it was related to my service. I was in a tank crew during the first gulf war. However, I never was sent to the gulf. Had I step foot in theatre Id get presumptive 100%. Being in Germany handling and riding around in Depleted Uranium gets 0%. Any one out there get Myeloma and not serve in gulf?

    I had surgery in San frisco va hospital they shortened my leg 4 " by major in service I cant walk without back injury I wasn't in service 30 yrs after its ruined my life I missed the 2 yr time.limit partly because of what the chief if surgeons did to my hipi should be able to get 100% Help??

    I had filed a new claim for depression and did the C&P exams two weeks ago, I am service connected for a bad right hip and lower back already with other lower extremities' issues. in retrospect I should have filed it as secondary. will my RO change it to benefit me if granted ? And if they do, will they back date the claim to when they rated my hip and back both service connected ?Thanks.

    Hey guys, question: ARE YOUR SERVICES TO ASSIST THE VETERAN FREE? Because if not, there are several organizations out there who can assist the veteran to receive their service connected disability for FREE. Such as the VA, VET CENTERS, DAV, AMERICAN LEGION, VFW and vet organizations who will assist the veteran for FREE. I know someone who got a lawyer without this knowledge and PAID a lawyer just to receive his disability benefits. I think you need to try some of these FREE organizations FIRST before you pay an attorney. That's my opinion.

    What if all of your Medical Records while enlisted Active Duty are completely lost?? No Active Duty Medical Records or Files aren't currently available or can't be found either to support any claims? I'm so completely Discouraged or even to try to appeal any more!!

    The VA rejected my claim for Agent Orange because they could not find any records indicating that the ship I was on was never in the Blue Water off the coast of Vietnam

      That is correct. This is where aggravation would come into play, and VA would establish the rating by determining a baseline level of disability and subtracting it from the current disability rating: cck-law.com/blog/va-service-connection-aggravation

    Veteran used VA Community care Dr. That VA sent him to. Neck Surgery went wrong nerve damage Left Veteran paralyzed both arms, and Breathing Problems From nerve damage too. Can that be new Disability VA set the surgery up with this Comunity care? Neck is not yet service connected.

    I was exposed to Ionize Radiation,( I worked on Special Weapons) it is in my Medical jacket/record, My VSO officer, says i don't have symptoms and he didn't know how to file that type of claim. What do I do and who do I talk to, I do have a degenerative back, and had lumbar surgery on L4 and L5, but the surgery happen tow years after I separated from the Navy. I am currently going to Acupuncture and Chiropractic care through the VA. Please HELP.

    In my secondary claims for my physical debilities, injuries I sustained in the service, after fighting those for about 50 years also it was finally found that they did not properly consider those and it was remanded over a year and a half ago almost a year ago I took all the examinations they requested and there's still nothing being done on that! How long would you think it would take for them to come up with a decision since they've had all the information requested many months ago, almost a year?

    I was discharged 6 months early for emotional / behavioral issues. With honorable discharge. . There were a couple events in the service that disturbed me greatly and I have had issues of depression and PTSD, Sleep apnea and use a CPAP todate . I was not stationed overseas but witnesses death and close to death experiences at work and while on base. How does one dig up proof of these events from 1973-76 if they are not in one personal records?

    I now have left hip shorter than right hip left knee bows out from arthritis doctor says needs knee replacement and seen for depression for constant pain since being diagnosed from 20’s been on pain meds every since 8 months for Rt hip replacement 6/15/10 left hip 5 months 5/15/15 VA dint give proof as why my nexus letters and doctor’s treatment ignored

    So in my initial claim I was told the VA could not find evidence of injury or treatment to justify chronic back pain, primarily lumbar pain. When I received my c-file is was a complete mess, so you could assume they did not make an effort to look through it. I filed again and was denied. Filed an NOD with about 100 pages of past and present evidence to include a line of duty determination following a motor vehicle accident while on active duty. I provided a spreadsheet with 80+ medical encounters listing dates, facility, provider, page in c-file, and copy of the note. I was notitfied in va.gov I was receiving a statement of the case. I was ask to get a C&P prior to the COVID19 events, the request has been cancelled. I had a nexus letter from my VA provider. But as a VA employee I could not have a C&P exam at the local hospital. They had nothing, I provided years of medical evidence. Why did they decide to deny again if they are suppose to give the benefit of the doubt to Veterans?

      @@dubreeves6246 it never hurts to gather all your evidence, past and present, and resubmit your claim. It took me 11 years from my initial claim to figure out the VA puzzle. What made it hard was I was a VA employee at the time and very few VA providers would stick their neck out to do any Nexus letters. Request your C-file from the archives and go through it. Look at all appointments in your VA chart. I found I had appointments with Drs at out of state VAs that performed chart reviews, normally just notes, and wrote them in a way that seemed as if they performed a face to face physical exam. You can contest these notes. You can also challenge the level of expertise of the examiner i.e., a M.D. over a PA or NP. A Specialist over a General Practitioner. I hope this helps. Keep on fighting for what you earned.
