    DR:
    Attorney Menchaca, what are the requirements to apply for an E1 visa?
    GM:
    The E1 visa is an import export visa, it’s part of the investor visa family so to speak. There are three main requirements number one that you import or export products or services between your country of nationality and the United States.
    DR:
    Okay so does this mean that if I import or export anything I can qualify?
    GM:
    Anything, so some people import software for example things you can't touch, that would be called a product some people purchase insurance products and that would be like a service so products and services both qualify
    DR:
    Okay and what would be the second requirement.
    GM:
    The second requirement would be that the value of the your imports or exports be substantial, be large. The law does not specifically say how much that means I so I recommend a minimum of a hundred thousand dollars a year.
    DR:
    Okay what would be next?
    GM:
    The next requirement would be that the flow, of which the regularity in which you import or export products or services between your country nationality in the United States be continuous, okay, so as opposed to a one time thing.
    DR:
    For example, let's say I come to the United States every few years to buy computers, does that qualify me for an E1 visa?
    GM:
    Doing imports or exports once every few years is not what the law is looking for. We’re looking for a continuous flow so what I what I have with most of my clients as I have clients who import or export things on a weekly basis or on a monthly basis, even every two months, or every three months. I have clients who do purchases like three a year, but they're you know good size value every four months and that that works. What the law is looking for is continuous, the idea is this look the government says the US government says look business between your country and the United States is of a benefit to me, so I want to help you do more, so if you already are involved in a business that imports or exports between the two countries then I want to give you the visa to help you do more. So the idea is I'm going to give you the visa, so you can do more but if you're one time purchaser or a two time purchaser, they’re going to say, well I may give you the visa, and you may not buy anything again, right. So that the government wants to feel comfortable that you are going to repeatedly keep buying more.

    There are a lot of business where annual trade volume can be lower than $50k, in that case will the issuance of visa be refused? The Govt. has not mentioned any amount though.

      Hi. Good question. I don't present applications with less than 100K because I believe the risk of a denial of the application would be significant. 100K as a minimum is my recommendation. Good luck.

    Thank you very much for such an informative video. I am from a treaty country. And I am giving IT services to a USA Company for last 3 years and I am paid on monthly basis. And now I have contract with same company of 7 -10% commission their total sales in result of my SEO services. which is estimated around $4-6k monthly. More over I am also exporting them packaging and goods. And I am importing from same company too. Wherein total transactions cross $50K but do not touch 100 k . Although, volume of total transactions is like 14-20 transactions every year. Would you consider filling my E 1case?

      Hi. I think you are on the right track, but if you are not at 100K USD in the last 12 months, then I recommend you wait to start anything.

    We have a simple question about the E1 visas. We do not have a company in the USA at the moment, but can we apply for an E1 visa since most of our online trade is with the USA? Our company is in our own country and is currently doing online trade with the USA. It's trading for one and a half years is 200k dollars. Is it needed to have a company in the USA before applying for an E1 visa? And is it needed businness plan for this visa? Thanks.

      Hi. Yes, you can apply for the E1 using a company created outside the USA. You are not required to have a US company. No business plan is needed. Good luck.

    Thank you for clarification in terms of services and amount. If I am as a self employed IT professional holding my corporation in treaty country as a citizen and having a contract with US based IT firm to provide my service which goes beyond 100K, in that case am I eligible for E1 visa? I have a long term contract with them and it will never end probably.

      @@InmigracionAbogado Thanks for replying. I am a Canadian citizen and living in Canada. One more question, do I need to hold this trade for quite a long time to show my eligibility or it can be just few months should be fine? Once again thank you for your replay.

    I'm planning to put up a mini Hostel business in New York soon and I'm the owner and the one to manage it. Currently, I'm on B1B2 Visa. Does the hostel business consider under E1 Visa?

    I would like to ask a question, I am from a treaty country. If I find a software development job in a US company with a salary of more than $100k, can I apply for an E1 visa to work in the US?

      Hi. Sounds like the E1 visa is not the way to go. The E1 is for people who trade between the USA and their home country, as opposed to using it to just get a job in the USA. I think that the H1B is more appropriate for you.

    Would having an adult care facility be consider as an E-1 visa?

      Hi. It sounds more like an E2 visa, than E1. Unless the adult care facility is located outside the USA and its clients come from the USA. Otherwise, a E2 visa is more fitting. I recommend you see my youtube video on the E2 Visa Requirements.

    Can I offer financial services to recover debt to US companies to qualify for e1? And where am I supposed to find clients or to show that I ll make 100k per year?

      To qualify for an E1 you need to do international trade. So say that US companies hire your company outside the USA for some financial services, then that would work. You do the work outside the USA. The clients in the USA pay your company outside the USA for the services. That's how that would work. Good luck.

      Hi. My apologies for the vague answer. To be more clear: to qualify for an E1, the applicant must have the nationality of a country with a trade treaty in the USA. Permanent Residency in any such country does not help in the absence of possessing the nationality of a country with a trade treaty in the USA. The UK has such a treaty with the USA, so yes is the answer to your question.

      Hi. The focus is more on how much the business imports/exports between your home country and the USA, and less so on how much you make.
