If your NDA is a cover-up, in other words a conspiracy, to cover up a crime, I don't think that can legally be enforced as legal if one of the parties later changes their mind.

I dont believe she was oblivious. I think in 4+ years of employment, she knew what was going on . I think this is damage control.
