    A Promissory Note is an important loan document typically executed between a Borrower and Lender when the initial loan proceeds change hands (in the case of a real estate transaction, this would be at the time of closing).
    A Promissory Note is a legal agreement between the Borrower and Lender that lays out the specific terms of the loan. It should include all the basic details, such as:
    - Loan Amount
    - Date of the Loan (including the first payment date)
    - Interest Rate
    - Payment Amount
    - Number & Frequency of Payments
    - How the Loan will be Paid (e.g. - principal & interest, installments of interest-only with one lump sum on a specific date, or due on demand)
    - How the Note will be secured (e.g. - by a Deed of Trust)
    - Whether the Lender can sell or transfer the note to another party
    Often, it makes sense to include an amortization schedule with the note to make it abundantly clear when each payment is due, the amount of each payment and what portions of each payment will be applied to principal vs. interest. This can help avoid any confusion between the borrower and lender about what is expected.
    Once the document is signed by all the appropriate parties, it can act as a legal document that can be used in court if the lender ever needs to demand what they are owed from a defaulting borrower.

    Both explain the Creation of Money which the Promissory Note actually Is.
    Beware of those who tell you anything deference. In the above Video, he is telling you half truth which then become a lie.

      @@audunjemtland8287 When you tender (offer) payment of a debt, the debt is discharged up to the amount of the payment that was tendered even if the creditor rejects the payment. Which means that if you had a loan for $10,000, you could tender payment with a promissory note (or some other instrument) for $10,000 and the debt must be discharged whether or not the lender accepts the payment. This is stated in UCC 3-603.

      They do as they always do. Just dismiss it.
      So you PAY with the promissory note? Of what amount? It's so simple yet so complicated.
      How would you write it. And where would you turn it in? The receiver practically wouldn't know what to do with it.
      When the private person gives a responsibility to power, they do not take it. Only the other way around.

    Because the Promissory Note is one transaction; and, the 'MORTGAGE'/'DEED OF TRUST' (same thing - depending upon particular State) is another, 2nd transaction - obligation.
    At Settlement/Closure there are two independent transactions taking place where the purchaser is typically unaware
    A 'MORTGAGE' /DEED OF TRUST is the purchaser's 🎁 gift to the alleged 'LENDER' from the alleged 'BORROWER'.

    Seth, Awesome content. When you close ANY deal, do you put your personal name on the documents or your company name? Is it "Kosher" to use your "brand name" if its not a LLC, INC, etc?

      Thanks Kyle! I think it just depends on whether you're doing business personally or under a business entity. I've always put the legal name of the business in these contracts (not the "brand name")... as for what you're allowed to do, that's an attorney question - but I've never used anything other than my personal name or the exact name of my LLC.

    Seth Williams - Some of the commenters here are people who have a misunderstanding of the nature of a promissory note. There are many CZcams videos in which people are told that they can create a promissory note and use it the same as cash. They think the note itself is required by law to be accepted and they can create one and use it like money even if they have no collateral of any type, no credit record or even if they don't have any money.
    You are explaining what a promissory note actually is and since they have been told something else, they think you are wrong.
    Good luck. Just a heads up to let you know who you're dealing with - in case you haven't already figured that out.

    Generally when purchasing a house through a bank, the bank would produce a promissory note for the borrower. What are the advantages of making one for yourself in this situation?

      Seth Williams what is considered "Lease Agreement" which is signed by both parties, and why is the "promissory note" needed and only signed by the purchaser ? (i.e. - buy a car, get funded through a bank, why does a promissory note have to be signed by just "me" / purchaser , but lease agreement which states my "duties" to pay aren't signed by bank?

      You can use a promissory note for any financial obligation!. Do not use this one though, if they are charging you and have rubbish in it like (options for the lender to take action in the way of higher interest) it’s bullshit. This particular one is just this guy and his lawyer mates to make money off people and put them in a bad position!. Make your own and it costs you nothing!.

      You don't technically need to register a promissory note with the state. However, you usually would want to record any connected security instruments with the county (e.g., mortgage, deed of trust, etc). Rocket Lawyer will not record those for you; you would have to handle that on your own.

    well since there is no lawful money in circulation and all that can be used is tender so creating your own notes...and modern money mechanics as well as professor Richard Werner's Imperical study prove all banks do is buy your note and trade it thus fufilling the obligation...so in all reality all you need to do is use notes and i.b.o.e.'s to keep paying

    The "value" of a promissary note is dependent entirely on the financial standing of the issuer. In the case of someone like you it is quite literally not worth the paper it's written on.

      Jordan, you are WAY off on this.
      How promissory notes work in the real world: I loan you $1000 at 10 percent simple interest so you can buy a used motorcycle. I create a real basic contract which says, "I, Jordan Guess, have borrowed $1000.00 from jmowreader on June 21, 2017. I agree to pay $100 per month for the next 11 months, until the total of $1100.00 (10 percent simple interest) has been repaid." We both sign it, and you send me $100 per month until you've settled the debt.
      How they work in the mind of a sovereign citizen: I loan you $1000 at 10 percent simple interest. When the first installment is due, instead of $100 you send me a different promissory note. But since I was smart enough to have you pledge the motorcycle as collateral for the loan (this is a problem for the business community - creditors aren't taking this necessary step, and it's biting them in the butts) and I was also smart enough to perfect the debt, I can simply call a repo man and have the motorcycle picked up and auctioned off, and then go after you in court for the difference between the $1100 you owe me and the $300 I got from selling the shit-box bike you bought with my money.

    People don’t understand that the type of promissory note you are talking about is usually executed by two private people. Say you lend a friend or relative some money. Or you sell a car to a friend or relative. It becomes a contract between the two individuals of” I will lend you this money, and you will pay me back under these terms!” You can not use a promissory to pay off a debit, that already has a signed promissary note, or in case of credit cards, where a contract exists that the borrower agreed to when they applied for the credit card.

Most of the comments on this video are either from individuals who believe you can walk into a creditor’s office and purchase a car, house with your own promissary note. Look up Christopher Fleming he tried to buy a house that way. Or they insist they can pay off their existing debt, by issuing their own promissary note and telling the venders they can sell their promissary note as a security to get the funds. The other comments are from individuals who know The above theory doesn’t work, and evidently assumed you were just another scammer, and not just educating people what a promissary note is and how it can be used

      Once you’ve sent through the note and the debt is paid the title is yours, as the debt is paid in full

If not, the debtor may look like the debt was never paid off unless people contact you to attest. There is a specific format for this letter.

    this is not a real promissory note that for example that banks use between each other, real promissory notes are a legal instrument that has value and can be purchased like shares on the stock exchange a bit like bonds. They are generally used for banks and government bodies only as it is like a perpetual deferment of the loan banks hide this from individuals to make money from the scam that banks work with, they are more complicated than a loan contract
    This type of document is really just a loan contract not to confused with a real promissory note or instrument.
    Seth has a vested interest in selling this type of loan contract, he admits this

      No, it's a real "promissory note". You see private deals between individuals where someone is owner-financing a house or car purchase. Other than that, you wouldn't really need to use this program.

      Yes has been for years, its called cash, but clearly states "I promise to pay". A cheque is the same thing all that does is put numbers in a bank account which you get more promissory notes out. It is a scam. Take your promise to pay to the bank and see what you get for it. Oh yes another promise to pay.

      Because it's up to the seller whether they want to offer seller financing or not. Most of them would rather just have cash now, hence the reason for mortgage companies.

    Think you're a little confused. The supposed lender isn't. The real creditor is the one purchasing the home or car. The lender puts no money into anyone's hands. In fact, the supposed borrower's signature creates the so called money, or credit of which the lender, the bank, credits itself 11x the value of the mortgage. In essence the bank or the lender is a liar. You are the real bank. Same lender then sells the mortgage documents within 90 days or less and gets another return in credits. Don't know who taught you this crap, but it's completely backwards. Funny how when a lender loans it never falls on the debit side of their accounts ledger, but on the asset, income side. Further proof they lent zero and acquired 11x the amount of the loan.

    What a load of bollox, it's one thing to create a Promissory Note, it is a total different ball game trying to get your creditors to accept it as payment. What you should be doing is showing us how you successfully used it.

    How dumb, when you come to use it, they treat you illegal, they need to get rid of promissory notes, that's illegal to treat somebody so disgusting before he could get his payments situated as seen in ex. clip from Wells Fargo promissory notes, & if you noticed the banker there didn't even know what it was and treated Carlos with no decency or respect, after helping him and I noticed before he gave him the money tender never did discuss with him the interest rate or when to start the payments , and to acknowledge, to understand if the money was to be paid back to the car dealership or to the bank, I mean it was just totally misunderstood and no communication as to the details of that P.N. that it's ridiculously stupid!!!!     This sounds like something a scammer could use to make fake transactions . So with rocket lawyer you can electronically sign so no identification is required on either end . It’s not notarized also . So all someone would need is a little information on someone who has money and their email. So you’d need a third party with access and someone could get scammed out of a lot of money . Not sure this would really hold up in court because it looks to have so many loopholes ? Am I overlooking something ?

      In most cases, the note isn't the only document you would have signed. In any kind of real estate transaction (for instance), you would also get a mortgage, deed of trust or land contract signed *and notarized* , so even if someone called the note into question, it would be a lot harder to poke holes in it because you'd also have a signed, notarized and recorded lien instrument on the property too.

      No, Suni. There are two kinds of promissory notes: ones that are used in legitimate banking activities and obligate the signer to pay back the money he or she borrowed; and the bullshit ones that supposedly are required to be accepted as cash and are paid back by money conjured up from thin air. Seth's notes are the legitimate kind.
