The distinction between character evidence and habit evidence isn't always obvious. What is (inadmissible) character evidence for one judge might be (admissible) habit evidence for another. It’s still strang , very strange to me how when your a criminal defendant that’s poor and you don’t have ability to know that in some instances 404(b) has to be only used as rebuttal to if the defendant testifies. The prejudice and double jeopardy the US Attorney can inject is monsterious from priors and incidents, a lot of it never proven, it’s just mere thought opinions of those making the arrest.
The strange park is the logic is not logical to decide this issue
