  • The plaintiffs say they signed a one-year lease with the defendant, but she was a nightmare landlord. They had no hot water in winter and had to move out. Now she won’t return their security deposit, so they’re suing. The defendant says the plaintiffs left her high and dry, and she had to have everything deep cleaned because they were smokers.

    Landlord doesn't know what she's doing, as well as her lawyer. Trying to fabricate the lease that shows they would have to pay $$ for sewage, when it wasn't on the Defendant's lease.. 🤷‍♀️🙄

      Not just that, but the plaintiff had proof of having the carpets cleaned prior to moving, they did the walk through 2 days after they already moved out, so the landlord should've had their deposit back to them at max within 30 days, yet didn't & tried to use her bill for services 2 months after they were gone, and new tenants in, as reason not to return their deposit? That's another big problem.I wonder if the landlord spent their deposit & maybe that's why she was begging them not to leave.

      @Christopher Moore idk if all of the US has to, but I do know my state & 2 others I have family in, landlords have to put Deposits in interest bearing savings account & return it w/ any interest no later than 30 days from the final walk through. If it's not across all of the US it needs to be. I'm glad the UK understands that t h ere are so many bad landlords & renters should be protected.

    They are very blessed for Moving out and getting back their Monies. The landlord thought she could do whatever she wanted and keep all their monies by not fixing anything! She start with a lie and ending with a lie....

    Since the landlord didn't smell the smoke or say anything about the smoke odor when doing the walk through, she can't prove it was the plaintiff's after the fact. And the two contracts don't match? Something really fishy going on there - definitely a "loosey-goosey landlord"!

      yes, she can, if they were the last people in the place and smoked. Cigarette smoke goes into the walls and the stench stay there in the walls till the walls are treated and repainted.

      @@missy67 you are right I work in housekeeping and you can smell the smoke in the rooms if the guest smoked in it. Then they get mad when they have to pay the smoking deposit because they smoked in a non smoking room

      Totally with you on this one. If she can't smell the smoke herself, she shouldn't be the one doing final walkthroughs where things need to be pointed out that would cost on the security deposit. You can't come back two months later and prove it was their smoke.

      I had a tenants that tried to use their kids to avoid eviction. I was even willing to work with the tenants, offered to let them trade off by doing some painting, cleaning, etc. Their laziness made it more than easy to start the process.

      My family owned a carpet cleaning company. That smoke smell can permeate the carpet padding and even the sub flooring. If one does not paint with a product like Kilz before painting and scrubbing the walls with TSP that smell will leech out. This is true of cigars, cigarettes, pot, cooking oils.

    She has cast a shadow on true “law abiding landlords”. The moment I would have received her letter from her “attorney/family member” I would have immediately had my attorney draw up a cease and desist, how dare her..I’m sure she’s a new homeowner who chose to rent for the profit..regardless to her motives to nastily remove her tenants she has to do things by the book when documentation is signed and funds are being disbursed. My heart aches for this lady and the near deadly accident that could’ve claimed the lives of her two children. Listen, they seem financially stable for the most part, combine your incomes and invest that hard earned money towards your own townhouse. To rent and endure difficulties and hardship from your landlord, you don’t need this. Think long term, sign a mortgage, maintain your payments and eventually it will be your home. She tried to take full advantage, she’s legally supposed to make the place habitable for the next pitiful victim/tenant. Repairs, repaint, light bulbs, vermin infestation, leaks..all these things are required and necessary for you to uphold that “landlord” obligation. Get your own.

    When I watch these Landlord/tenant cases, I always pray that we never have to go through what the tenants are going through. I know it's 50/50 when it comes to bad tenants/landlords. But I hope these tenants found someone who treated them better. The plaintiffs seem like good ppl though.

      Too bad that is not how life works, when you’re down, you’re still accountable for everything. It’s called being a responsible, well adjusted, and resilient adult. Life doesn’t give you much in the way of allowances or a break unless you’re extremely wealthy. You can lose a home. The bank doesn’t care about your hardship, they’ll kick you when you’re down. They just want their money. Same thing with corporate jobs. They don’t give a shit about you, when you don’t perform they’ll fire you even if you went through a loss. There is no hand holding in life, it’s cruel and brutish. It’s not right but that’s the way a lot of American establishments operate: they’re unforgiving, merciless, and punishing.

      Can’t sue for pain and suffering. If you have trauma, you can’t successfully sue people just bc they were being jerks to you during a time when your life was hard. That’s just called life. Get over it and grow some thick skin. They were not the cause of your trauma, so stop blaming and displacing your pain onto others. You need to buck up.     I had a landlady that when I gave the 30 day notice she decided to up the rent for my last month.
    I had taken photos before the move in and I had that of proof of pre damages.
    Still she was going to charge me for things I did not do.
    There was mold in the bathroom and when she blamed me for that I called the city.
    Turns out she was renting an illegal basement apartment and was told to stop.
    It was also a fire hazard since the 2nd door that went to the house was locked.
    She was also told to pay a fine.
    Glad I was able to leave.

      It should be included in the price of the rent, like property taxes. Just because a landlord doesn't factor in all the expenses before the lease is signed doesn't mean they can change the agreement on a whim.

      @@jenerin905 sewer is a homeowner expense, it is in their name. just as property taxes are in their name & often part of the mortgage payment. neither should be paid by anyone but the homeowner. the only one responsible for those things is the homeowner. no one else. not a tenant, not a friend, not a neighbor...the homeowner. it's always been that way for legal reasons.

    Those plaintiffs were organized and smart. The defendant tried to be slick and failed. Probably had a fake lawyer write up that statement that the judge called "dead wrong".
