    People are getting out of hands with social media. I have seen patients pulling out videos during minor surgeries or while nurses are collecting vitals. People are so entitled. There is a wait in the hospital. Its a holiday, all doctors office close so thebget overflow of emergencies and people coming in for colds and sore throats that's not Er appropriate.

    While working in a county hospital ER, no one was recording people in the waiting room. It's private property, just like in a store, in Ca you need the party's consent to record them. Tiktok is the platform for every person to record everything, she could have recorded something on the computer screen, you can't do it.

    It's been long waits since Covid. Now it's time everyone stop acting slow. The world knows we short on staff, help, essential workers, patience, and plain decent customer service. So complaining about a ER time is dumb. You should go with the intent of sitting for hours everybody short. Don't care where you go and don't care what service you getting.

    You can’t record in the hospital. She should have been removed and kicked out of the hospital that’s it. If she failed to leave police should have been called for trespassing.

      ​@@ChandlerGaming205I work as a hospital security officer and I can tell you right now the hospital I work at has a zero tolerance policy on recording inside the facility, We will automatically kick you out of the facility and criminal trespass anybody that's recording and press charges regardless if it's a sensitive area or not. The hospital can't take any chances of a HIPAA violation.

      Depends on the ER. 5-hour wait time is for the inner-city ER. The last hospital I visited don't have a wait time.

    In an age where we are constantly inundated with social media, we need to establish clear rules on what is acceptable use in a healthcare setting. In this scenario, where there are other patients present but no obvious healthcare information being recorded, is it alright for the TikTok user in question to be arrested secondary to a HIPAA violation? I would argue that she is violating the privacy of the other patients present. People are in the office waiting for medical attention, and they have a legal right to receive care without the release of their protected health information (PHI). HIPAA is our hard and fast rule enforcing this right. PHI may include patient name, identifying information, contact information, medical records and test results, and demographics. By posting a video where other patients’ faces are clearly visible in the emergency room, this is a form of identifier that violates this rule and takes away those patient’s rights to privacy. We need to be mindful of what we are posting on social media, and while the response to detain her and have her arrested may seem extreme, it is reasonable to deter this behavior in the future and to protect others’ rights.

      Non-covered entities, such as patients should not be expected to follow HIPAA or even understand HIPAA guidelines because they are untrained. Instead, they should use due diligence when deciding to upload videos online. If they fail to do so, it should be under the social media services discretion to remove the video if PII or PHI is identified

      Of course, hospitals should and are legally allowed to ban recording in their facility to prevent patients disclosing another patient's information (most do), but patients should not be subject to the consequences of violating HIPAA. Hospitals are also able to kick someone out that's recording if they have that policy

      If you have not signed a HIPPA agreement you cannot be held accountable. Sorry but HIPPA is only there to keep patient information fro.being disclosed. It includes healthcare workers, other hospital security and not individuals

      ​@joey.99 hospitals generally are public property so as she has every right to film or photograph. As long as she's in a publicly accessible area and their policy has to be in line with what the United States Constitution states in the First Amendment. If its not then the policy doesn't have to be followed bc it's unlawful

      They did MUCH more than that! They erroneously indicated she violated HIPPA laws, falsely detained and kidnapped her, refused her treatment, etc. This entire situation was wrong and they should ALL be sued, charged, and fired.

      actually they did not kidnap her. Kidnapping requires the element of removing a person from a location against their will. They did not have grounds to hold her but refused to let her leave freely so it would fall under false imprisonment since she was not allowed to leave but was not removed from the property.

    Interesting. The security team was in the wrong. It is not a HIPPA violation for someone to record in a hospital. So you cannot be arrested for recording.

    They are a trip, their worry about a video… The reason why I say that it’s because my grandson has Cancer and that is the hospital that’s taking care of him and one of the staff that see after him stolen his iPods as he has fallen asleep and they won’t look into it SMH… they try to play him stupid and he’s 17 years old the attendance nurse on afternoon /nite said she saw him sleep with them in his ear but dayshift said they can’t find out Where they are &his phone indicated that they were in the building🙌❤️

    If I was in that room I would’ve thrown you out my damn self. You may not have violated HIPPA, but you definitely violated the privacy of others. Above all, it is highly disrespectful, particularly to that Muslim woman who is covered. You’re in Dearborn for God's sake. Where are your morals!? And speaking as someone who personally endured domestic abuse for many years, I wouldn't want to be on someone's stupid social media video when I'm trying to protect myself because my safety is in jeopardy. Hospitals are supposed to be the safest place to seek help and protection (which I once had to do). It's an ER ( Emergency Room) - people are sick or have an emergency!! You’re an adult.     The activity is constitutionally protected but whoever 2 things happened 1 she recorded the nurse doctor and pregnant women if that video show up on a stream one out of the three can go after her civilly and secondly the security officers should've advised her that this is private property and this type of activity is not allowed while she in any of thier buildings. And i knew Dearborn pd wasnt going to touch it.

      I work in an urban trauma center. People like this are just looking for confrontation and looking to sue an institution. They deserve being booted out and given a specific restraining order on ever re-entering that facility. Don't ever feel sorry for these people.

    This hospital needs further education on HIPPA. Any information about a patient cannot be disclosed by the hospital staff. Hell, they have security cameras in every hallway. This hospital cannot press charges on a private citizen for uploading a video made in a waiting room. Now as a courtesy i would ask permission from the people filmed and blurr identifying information but you dont have to. Jesus people are thick

      @@sportscarman5 Actually the county sheriff in my area has told me it is legal to record YOUR visit to the hospital. It is NOT illegal for you to record YOUR OWN INFORMATION. Actually the sheriff told me he encourages recording because they get so many complaints from patients that have to go to the hospital around her about mistreatment from staff. AND the hospitals THEMSELVES record with security cameras and they do have audio, so they themselves violate HIPAA

      @@nsgamingallen1308 Actually you are wrong, they cannot stop us from recording OUR OWN PERSONAL MEDICAL INFORMATION and that includes doctor visits or ER visits. The reason they dont like it is they have no control over the recording
      Its exactly why the cops dont like you recording them, its because they have no control over the recording
      However in this case, she POSTED the recording on TikTok which IS illegal but simply recording while you are there for a LEGITIMATE MEDICAL REASON such as for treatment or a doctor visit, they cannot stop you.
