A big controversy has erupted in Andhra Pradesh over the recognition of YS Jagan Mohan Reddy as Leader of the Opposition (LoP). While the ruling National Democratic Alliance (NDA) maintains that he cannot claim the position as the number of seats that his party (YSR Congress) won is less than 10 percent of the strength of the Assembly, Jagan wrote a letter to the Speaker urging him to accord LoP status to him, asserting that there is no such rule to disallow him.

Mr Umesh Chandra needs to read the law carefully. The 12 b of the 1953 act of the Andhra Pradesh pertaining to the salaries and the pensions of the legislative members had explicitly mentioned that speaker would be having powers to decide the leader of the opposition if more than one parties acquire same number of legislatures. But the sections in this law were specifically silent on the current scenario where we are having only one opposition party. But the explanation of the law had clearly stated that the leader of the opposition should be given to the leader off the party which has the greatest number of legislators apart from the parties in the government.

The speaker of the legislative assembly or the chairman of the legislative council is there to verify the claims of those who are requesting them to do so. It's a pity that advocate Umesh Chandra doesn't know the difference between 'conflict' and 'unrelated'. Here the section and explanation are unrelated due to poor drafting. There is no conflict. Since definition was given in explanation it will hold. I feel order of precedence is Section > Explanation > Convention. Kudos to Prof. gar for tolerating their arguments without losing his composure.
I am very much sure if Mr Jagan goes to the court, he shall be easily be prevailed in this matter.
Section 12 is inherently mentioning of Opposition leader and explanation also mentioning about it, I think murthy is very wrong in the state act interpretation.
EVEN PROF SIR IS ARGUING WITH LOW VOICE BUT SIR ANALYSIS IS CORRECT.
If you look at the aspects in the law, you can clearly understand that there is no conflict between the explanation and the section. As Murthy had mentioned, the section will prevail over the explanation if there is a conflict between the two. But there is no such conflict over here.

There is no meaning discussing about issues I this media. Even the moderator speaks about law and explains the same to the analyst and the lawyer remain silent as they are favouring to one party interests.
