Perhaps if *that woman* had gone with the recommended attorneys in lieu of Elaine Bredehoft, she would've prevailed in court. I imagine her feelings are bitter sweet right now. A LOT OF REGRETS!
@@m.w.976 I highly doubt Heard's lawyers would have won her the case, if she'd taken her insurance agency's choice. It just would probably not have been as big an embarrassment as it was. I mean, JD's team had the evidence. And Amber Heard still would have acted the way she did. Her lawyers might just have been a little more professional.

AH should definitely have to pay for her own attorneys. I don't think JD got his litigation payed for by insurance. She basically committed insurance fraud. She knew that she was gonna write this oped and got insurance like a year before the defamation case was filed. I feel it's no different than getting car or home insurance knowing that ur gonna destroy the car or home just to get the payout. She brought all this onto herself and wer'e all expected to feel sympathy for her.
@@scottpullman3608 I believe she did. It was home owners insurance ur right about that., I'm pretty sure the policy was taken obtained 8 months before the oped came out
@@scottpullman3608 Pretty sure defamation protections in a home owner's insurance policy are add-ons, not just built in, so you have to ask for them.
@@scottpullman3608 Only travellers was home insurance. NYM is not, it's general insurance that she sought out. Still fraud with travellers as the defamation clause was an add-on.
I'm just curious about one thing: how exactly did Elaine never get sanctioned with all the unethical and fraudulent BS she pulled? And now that we have documentary proof that she elicited false testimony from AH about "paying 6 million in attorney fees", plus repeated and reinforced that false testimony in her closing argument, shouldn't she now face discipline from the bar if nothing else? Not like she didn't know who was paying her outrageous bills.
As far as her (Amber) paying her attorneys they can argue she is paying insurance therefore paying her attorneys. But I swear with the amount of perjury from Amber herself n her attorney like you pointed out makes me lose a lot of respect for our court system. Apparently everyone can just lie under oath without any consequences.
@@Ania-cd2sh at first I thought that, too but then I remembered that both Amber and Elaine said multiple times “she couldn’t pay the charities because she’s had to spend over 6 million dollars being sued by JD.” So they both went with “AH is paying us *herself* out of pocket” route fully knowing that was all a lie
Sadly most of the time things won’t be looked into if it’s not reported through the proper channels. Maybe they are and it’s moving slowly but we won’t know unless something happens
In closing arguments she can say whatever she wants even that Santa was a witness for AH . :)
@@sweatshirts623 Even when there was a ruling by the Court that all discussions about legal fees were blocked? There was a motion in limine that ruled the insurance company and legal costs couldn't be mentioned by anyone.
Amber to her new lawyers: “ohhh of course, I’ll definitely pay YOU guys, it’s just the other ones that I’m not gonna pay. Just keep filing, just keep filing..”
I’m pretty sure Travelers has paid it all and it trying to recoup.
How the hell she got the insurance company to throw themselves onto this particular grenade I have no I idea.
@@sallycinnamon5370 very strange alright. typically need a period of grace after taking out an insurance plan before this kind of thing actualĺy goes 'live' if i'm correct. at least here it does (6 months) or could activate immediately prior to using it. then of course, there is also the 'mallice' element 🇪🇺
@@sallycinnamon5370 it seems kinda easy, she took defamation insurance policies (two as far as I know) for a year just before she published her op-ed. She got sued for defamation when she was insured for it = they had to insure her.
Now they're suing her because there was a clause that she can't maliciously defame someone. Am I understanding everything correctly?

Also - I love that you're examining the insurance issues - as a paralegal who has spent some time in this field - there's so much tea that we learn on coverage related issues. It's fascinating yet frequently, left unreported.
Siobhan, that must be fascinating! To see all these workings and arguments behind the scenes is quite an insight, people wouldn’t normally think that about insurance but the amount of manoeuvring that can go on (not to mention fraud) is wild!

I still find the brangelina details to be confusing, maybe it’s too early, but I’m tentatively invested
Traveler's (Pamela Johnson) has shown they can't be trusted to be honest. There has to be a reason the cap was raised from the insurance liability. NY Marine should get their $650,000 back and be released from all this sh!t storm. I don't see AH will ever be held accountable to pay anything or be punished for many accounts of perjury. She has dirt of important people and is shielded.

I don’t think Amber has dirt on people. Justice just takes a loooong time. If she can’t pay there’s other ways that she can be forced to pay up. But the fact she’s out of the country concerns me but that just means she won’t be able to step foot back into Hollywood if she keeps dodging US sanctions.

@@pamjohnson1668 Pam works for travelers insurance and was in the courtroom everyday, she claimed she was extremely needed in court and she was able to get a jd witness dismissed (Gina deuters) which was a lie, she also rented the $20,000 home to live in for herself and ah during the trial lol

The trial itself was just insane. It was crazier than several movie trials we've seen >< the sheer....craziness of Amber Heard, and several of her witnesses. Some of the cross examines by JD's lawyers were stuff that was on par with Tom Cruise's performance as a lawyer.
If they remake this as a movie, they NEED Doctor Spiegal to be played by someone whose played a serial killer or insane asylum escapee before. And the scene with the "pledge versus donated" cross needs like....multi cameras to show the reactions of people across the world, like literally gasping. Showing the scene when the world truly realized as a whole, just how wicked Amber was.
As the jury leaks said, they said when they were debating the verdict that the Pledge cross examine was the moment they realized they couldn't believe a word AH said.
Sadly, I feel that a movie made will probably be leftist drivel trying to pretend that AH got a wrong verdict.....and they'll likely completely cut all the donated versus pledged stuff, Doctor Speigal stuff, the changes in the story, the TMZ confession where they KNEW which exit she was coming from and that she would stop and pose for the camera so they could get the "bruise" mark. Etc.

Isn’t it a little damning for Travelers that the didn’t include New York Marine in communications when they are being accused of freezing out New York Marine’s attorneys. Kinda seems like proof that they were complicit and are continuing that behavior.
All of this, all of it, set in motion by one central lie. AH’s contention that she was abused by JD. Millions upon millions of dollars. Endless hours of testimony and reactions by the online community. National news specials and reports. Now there’s a movie of the whole sorry mess. Because of a lie. If you’re not directly involved I suppose it’s entertaining in a horribly salacious fashion. Thanks for shining some light in the darkness Emily. I appreciate it. 😊

The only thing I'm entertained by is Amber Heard going down in flames, and only because she brought it on herself by trying to destroy an innocent man. I really would have preferred Johnny Depp not having to go through any of it - her physical abuse or her abusing him with the media and by making him take her to court.

You do such a great job of explaining complex legal issues. So many fascinating questions for this retired lawyer … 1. Seems obvious that the intentional tort exception should apply so that NY Marine won’t have to insure Heard against the $15M judgment. 2. I assume NY Marine had initially agreed to pay costs of Heard’s defense under a typical reservation of rights letter? 3. Does Travelers have similar arguments against Heard - so that Travelers could (theoretically) recover from Heard the legal defense costs that Travelers paid for? 4. Was Heard’s counterclaim on a contingency fee basis? 5. If Travelers and/or NY Marine do have to pay the $15M, I assume they don’t have any right to set off the $3M counterclaim? 6. I assume that Depp himself won’t have to pay anything to Heard; instead his former lawyer - who made the defamatory statement - will?

Is AH's jumping around outside of USA (Israel, Spain) her attempt to not pay court sanctioned penalty re: JD defamation trial?? She is still liable no matter where she currently resides, yes??
And what is going on with Australia matter?
She is still liable BUT taking the legal action required to force payments is another matter altogether. Not many people realise that, even if they win payment from the other party, you then have to get them to pay. If they refuse you will have to take them back to court and even then you're still not guaranteed to be paid. The judge could decide they only have to pay $1 a month if they claim to be broke. It's a real pain in the bum.

AH was served by NY Marine on 23rd September (acknowledgment of service is on Court Listener). It had to happen via her lawyer Kirk Pasich because she is still out of the country.
It looks like AH is staying away so she can’t be served.
@Cricket exactly my thoughts. And the pictures with her "baby" is to "advantage" in case they come after her worst then she never imagined. She needs to be made of an example of someone who cried "fire in the theater" gets caught. But doesn't want to pay because "someone else" insurance company is supposed to...say's Amber Heard 🤦🤷

Correct me if I am wrong. Travelers wants to consolidate, saying both cases share common topics. MAGIC does not want to consolidate (saying dirty hands, prejudice and Amber is not a party to the first case) or wants to delay consolidation until Amber responds to second case. Amber's lawyer is unsure if they should consolidate, since they have not been served, both cases represent money for her defense, and does not know the effect of prejudice on her case, plus she is appealing the JD verdict. What am I missing?

Emily, did you see that The Umbrella Guy is suing Amber Heard? Yep. Her minions even called CPS on him and stated his girls were being kept in house with no running water or food. She’s come after him and so have her minions. Are you going to do an update on the Rust movie? Hutchins husband settled with Baldwin and will also be an assistant producer when filming resumes in January 2023. Have you had time to go over Duggar’s appeal? Same crap his lawyers objected to during the trial, to no avail.

@@joshn1678 Yep! Sure is! It sounds tacky because it IS tacky, in my own opinion. Must’ve been one heck of a settlement from Baldwin! Must have been why Baldwin sold his huge house and acreage in Connecticut or Vermont or wherever it was. I’m also thinking, just my own opinion, that Baldwin might have given him an obscene amount of money and give him billing on the film as a producer if Hutchins would just settle. No way would I want anything to do with an actor who killed my husband on a film set, let alone settle a lawsuit just to be an associate producer on the film that my husband was killed while filming. I truly can’t believe filming is resuming. I mean, why? Does Baldwin really think that the movie will earn enough money to cover the cost of filming and all the negative press associated with the movie and Baldwin? I’m just at a loss for all of this.
When did he decide to sue? He was in Natalielawyerchick a few days back and said he wasn’t interested in litigating. Doubt it was Amber Heard specifically that completed that report so I doubt that he would have any success.

I have questions. I thought that the malice standard can be met if if you have knowledge that the publication was false or if there was reckless disregard of whether it was false. Since the jury didn't have to decide in their jury instructions which one of the two criteria was met, doesn't the insurance company have the burden of proof to show to the court that this case has met intentional damages exclusion? If it was knowingly false, it was intentional. If it was recklessly disregarded, it wasn't intentional. Am I wrong?
Not sure if you covered this but what happens if AH just hides overseas doesn't reply to Anything?
I suspect she is hiding and where the heck is the money (she doesn't have) coming from?

How will they argue against NYM saying they 'conspired with Bredehoft et al' when they already said they were so enmeshed. Interesting.

Does Travelers have a business model that anyone's been able to detect? There's an old Eddie Murphy skit where he plays a reporter doing an expose that involves him disguising himself as a white guy, visiting different places where people interface with the government or finance. The scene at the bank has the loan officer take him into an office where he suddenly becomes all smiles. "Pick a figure. Would you like cash? Pay us back when you want -- or IF you want! *laughter, backslaps*"
That's Travelers if you're Amber Heard. I want to see the Travelers v. NY Marine lawsuit televised. Specifically the part where auditors walk into the offices at Traveler's regional headquarters to find Rocky Pennington, Eve Barlow, and Michelle Dauber emptying out a safe with unconscious clerks strewn about the office.

I think the jury was absolutely wrong to give Amber that $2million. It's ridiculous. What Adam Waldman said didn't "de-fame" her at all. It makes me so mad that they did that. I hope she gets punished for EVERY terrible thing she has done. Including perjuring herself in court. So many many horrible things.

This case should not be delayed b/c AH wants to hide out in Europe. The way it is phrased makes it seem like she can give her lawyers the authority to accept it all on her behalf, so why the delay?
