    Kila is being funny. The Judges went far to establish their verdict with the long readings. Don’t forget you hear people saying “All Eyes on Judiciary” So the Judiciary gave you all you needed to clear your doubt. That’s why you had 12 hrs judgement delivery

      Prof Kila said the key thing about substance. Obi’s lawyers did not do their homework properly. And funnily, they still want to go on appeal for a case that is so watery.

      Don't mind him. If the judges did not read the judgement extensively, he will still not be satisfy. Am very sure he will be part of the lawyers saying 25% in FCT is compulsory to win the Presidency. Imagine him saying the Law should not be bigger than justice as if the law is not the mechanism to get justice. Honestly, some of us that study Accounting, Finance, Engineering and other Science courses would have done better than some of these so called if we had studied law as a course.

      @ibrahimmuhammad1569 Před rokem

      What do you mean by "justice shall not be killed because of presentation and Law"? Presentation simply means demonstration of facts (ie,what transpired during the election and declaration of results); while Law means positions of the Law of the land against the background of the facts so demonstrated to see if they match each other.
      In the instance matter, the petitioners are required by the Law of Evidence and procedure to put in place the particulars of their allegations against the Respondents (INEC, APC and Tinubu) and present credible evidence (oral and documentary)to support those facts pleaded in their respective averments contained in their petition papers.
      Note:It is settled position of the Evidence Law that there is a presumption that whatever INEC declared is presumed to be correct and in substantial compliance with relevant provisions of the Electoral Act and the constitution of the federal Republic of Nigeria. The burden of rebutting this presumption of correctness and substantial compliance with Electoral Act and relevant constitutional provisions on the matter always lie on the petitioners who made the allegations.
      The presidential Election petition Tribunal found that the petitioners have not been able to rebut the presumption of correctness and substantial compliance with relevant Electoral law and provisions of the constitution.
      As the Elder statesman Robert Clarke,SAN, rightly said, the court (Tribunal)has no burden to go on voyage to fish evidence for the petitioners to discharge that burden place on them in order to succeed. You understand?

    Baba Clarke got it all wrong about the candidates that should have gone for a "run-off"; the "run-off" should have been between Bola Ahmed Tinubu and Peter Obi.

      @@joshuafrank5838: First, two "run-offs" are being provided for by the electoral act/procesd.
      The prerequisite for the first "run-off" is the candidate with highest number of vote cast (in this case Bola Ahmed Tinubu) and the candidate that won majority in most state (in this case Peter Obi).
      According to INEC Presidential Election result declaration, Bola Ahmed Tinubu won majority in 8 states, Peter Obi won majority in 8 states, Atiku Abubakar won majority in 5 states and Rabiu Kwakwaso won majority in 1 state.
      Note that majority means winning 50% and above of the vote cast.
      What I have written here is not a claim or insinuation from me, it is the provision of the electoral law and the result declared by INEC.

      When does a run-off election occur?
      The constitution addresses this specifically in Section 134 for the presidency and Section 179 for governorship elections. While the first requirement is getting the most votes, the second requirement involves receiving one-quarter of the vote from two-thirds of all constituent units-states in the case of a federal election and local governments in a state election.
      A run-off election happens when no candidate can fulfil both of the requirements explained above. In that case, the winner would be determined by a run-off, a subsequent election between the top two candidates when no candidate wins in the first instance.
      Two candidates would advance to the next stage-the candidate with the most votes and the candidate with the majority of votes in the highest number of states. The second candidate might not necessarily have the second most votes but performed strongly enough in enough states.
      There are provisions for two run-off elections. The first still requires the winner to receive a quarter of the votes in at least two-thirds of the states in the federation or local governments in the case of states. However, if no candidate can deliver on that point, the next election is won by whoever has the most votes.
