Oh and one more question, how does the product ban process work? Does it spot a picture or goes it off the title, tags etc.? So if you would have a product that is completely unrelated to the brand, name... would it still get taken down since the name is in the title?
And reverse. So if you have no indication for any Brands etc. in your title, Tags... than is it "ok" to have it in your pictures/product? And if yes, does it have different effects how it is displayed in your thunbnail. I think this topic is kinda cursed (for obvious reasons) but still inportant if you want good SEO or CTR in some niches...
Not legal advice, but if you use the trademarked name in the title or product itself then yes they would have grounds to raise an infringement case against you, wether it's both instances or one or the other. This also depends on the type of trademark and copyright, some are for the design of a product, some are for just the trademarked terms, names and phrases.
It's a tricky subject to be honest, you'll see some sellers in clear breach of copyright selling on the platform for 5+ years with no infringement cases or shop suspensions, for others it takes just a few days to be caught..

For any SEO changes I'd say wait at least a few weeks before you make any judgement at all. If everything is done correctly regarding SEO, then it will give the listings that are good quality the best opportunity to be found and get views.. A listing that is still overall poor quality will still always struggle.
Question for Branded names: Example Tupperware, is it ok to use for Example "Tupper Box Ware"? Etsy spots the Tupperware for seo so there will be nore searches. But could it get you in leagl trouble? Idk if it makes logic😂
What I'm about to say is just my opinion, but if it was me I would be using the term in my tags (not titles). Trademarks are at the discretion of the owner to enforce and raise infringement cases against sellers, so if you use them in titles it is very easy for someone to spot. Less so in tags. I'm a seller/person who does take more risks than others though, so if you wanted to be completely safe just avoid using any trademarked phrases at all. Hope that makes sense :)
