  • Tensions between the Philippines and China have escalated over the last two years, mainly over two disputed territories: Scarborough Reef and the Spratly Islands. In the latest flare-up, on 23 March, the Philippines accused the Chinese Coast Guard of injuring its personnel in a water cannon attack near the Second Thomas Shoal - another disputed territory that is part of the Spratly Islands.     There is really no dispute here.
    The islands are only 90 miles away from the nearest Philippines island.
    While over 900 miles away from mainland china.
    The law if the sea dictates, anything 12 nautical miles from your land, it is your territory.
    Anything below 201 nautical miles is your economic zone. A right for you to explore for your economic gain.
    THAT IS VERY CLEAR. CHINA IS THE SQUATTER OF THE SEA.

China is hypocritical on their claims of all the seas up to the legal bounderies of the Philippines based on UNCLOS ( united nations convention on the LAW of the SEA) Whereas china is also part of this convention, not to mention they're one of the primaries who ratified UNCLOS

      UNCLOS is a universally accepted convention adopted in 1982, which sets out rights and obligations of states in the ocean space.
      One of the most intractable issues in the South China Sea is which state has sovereignty over the disputed islands. Some or all of the Spratly Islands are claimed by China, Vietnam, Malaysia, the Philippines, Brunei, and Taiwan. The Paracel Islands are claimed by China and Vietnam. Territorial sovereignty disputes are governed by rules of customary international law on the acquisition and loss of territory, not by UNCLOS.
      the underlying dispute between the claimant countries since 1945 is one of territorial rights over the SCS islands. After oil was discovered in the SCS in 1969, Philippines started to challenge China’s claims of territorial rights over the SCS islands, after having kept quiet for 25 years prior.
      And UNCLOS is not the proper forum because it does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory, which can be decided by the ICJ ONLY. No jurisdiction means no power to define the sovereignty rights over the disputed islands. If Philippines were serious about its claim, it would have commenced proceedings with ICJ and not a powerless UNCLOS tribunal.
      Besides, China had already opted out of arbitration by lodging an article 298(1) UNCLOS declaration in 2006, just as more than 40 signatory countries have done.

    Not only the WPS is invalid China's claim but the entire SCS is invalid because their claim of dashline or 9 dashline according to their own drawing on their map is not accepted.
    According to them that their drawn 9 dashline is a proof that China owns the entire SCS including the WPS.
    If the dashlines are the basis of the territory or claim, does that mean that the entire Gulf of Mexico can also be drawn by Mexico along with the EEZ of the US?
    Does that mean India can also draw a dashline in the Indian Ocean and claim it?
    And even the Arabian Sea can be drawn with a dash line and claimed by the Arabs?
    Even the entire Persian Gulf can be drawn as a dash line to be claimed by Iran?
    None of them made such a dashline because they knew how far they covered and especially now that all countries have to comply with international law or UNCLOS

      Because the named China Sea it means it belongs to China? No it doesn't mean it belongs to China we have the Law of the Sea on which your country which is China was a member of that UNITED NATION CONVENTION the LAW OF THE SEA and China was one of the signatories of that convention, so why China did not follow the rules especially the 209 Nautical Miles starting from the landmark of every country. The Philippines claimed only which is belongs to them which is EEZ (Exclusive Economic Zone) but the China doest have bases and made their own claimed which is hey called it HISTORIC RIGHTS, you know what we have very very old map of the Philippines which is more more older to your claims and we submitted it to the HAGUE, NETHERLAND where UNCLOS established, we won the case and China doesn't have historical rights and it's just fabricated by them.     The Philippines backed its historical claims from the 17th-century map, where the Scarborough Shoal First Appeared on Maps of Philippine waters in the 1750s. On the night of Sept. 12, 1748, the British East India Co. ship Scarborough struck the now-famous reef of the same name while on its way from England to China.
    As a result, the name Scarborough Shoal first appeared on maps of Philippine waters by English cartographers in the 1750s, according to research by a member of the Philippine Map Collectors Society. It also appears in the Murillo Velarde map in his 1749 book under the name Panacot or Scarborough Shoal, both terms refer to Bajo de Masinloc.
    Going Back to the 17Th century, the Hydrographical and Chorographical Chart of the Philippine Islands was one of the First versions of the Philippines map. This magnificent map of the Philippine archipelago, drawn by the Jesuit Father Pedro Murillo Velarde and published in Manila in 1734, is the first and most important scientific map of the Philippines.
    The Philippines was at that time a vital part of the Spanish Empire, and the map shows the maritime routes with captions from Manila to Spain, and to Mexico known as New Spain, and other Spanish territories in the New World.
    Currently, the Philippines based its claims on the legal Victory on the 12th of July 2016, the United Nations Convention on the Law of the Sea. The Arbitral Tribunal in the South China Sea Arbitration between the Republic of the Philippines versus The People’s Republic of China, which issued a unanimous award in the disputed waters in the South China Sea, was largely favorable to the Philippines, which was rejected by China.

      The Americans reminded the Philippines at its independence in 1946 that the Spratlys was not Philippine territory, both to not anger Chiang Kai-shek in China and because the Spratlys were not part of the Philippines per the 1898 treaty Spain signed with America.

    There should not be a dispute, those islands/shoals/seas belong to the Philippines only. China has no right to whatever basis she has. By law and sovereignty, they belong only to the Philippines. It is China making all the problems and conflicts in the West Philippine Sea.

      Those islands have been part of Chinese territory for centuries without contest. This fact was acknowledged both by the UN and Japan after the WWII. It was only contested in recent years by others. However all other claimants have come to an agreement with China to jointly develop the areas, except the Philippines. The phines is the odd man out in this matter, no doubt due to their obedience to their US white master.
      The Americans reminded the Philippines at its independence in 1946 that the Spratlys was not Philippine territory, both to not anger Chiang Kai-shek in China and because the Spratlys were not part of the Philippines per the 1898 treaty Spain signed with America.
      Over the past few months, it has been the Philippines who is breaching the common understandings with China and heightening tensions in the South China Sea; it is the Philippines who has attempted to change the current status of Ren'ai Jiao and make it a fait accompli; and it is the Philippines who has on every occasion courted external forces to put pressure on China. No matter what smokescreen the Philippines uses and what blame game it plays, nothing will change those facts : The Philippines promised to tow away the warship illegally grounded at Ren'ai Jiao 24 years ago. But 24 years on, the warship is still there. China and the Philippines had agreed to properly manage the issue of Ren'ai Jiao and thereby kept things stable at sea. However, over the course of this year, the Philippines has gone back on its words and kept sending government and military vessels into the water of Ren'ai Jiao to supply construction materials for the large-scale repair and reinforcement of the "grounded" warship and permanently occupy Ren'ai Jiao. This is what has caused tensions between China and the Philippines.
      The Philippines, bolstered by external support, has brushed aside China's goodwill and restraint and repeatedly challenged China's principles and the red line. This is a major risk that could drive up tensions at sea.
      China remains committed to upholding peace and stability in the South China Sea through dialogue and consultation with the Philippines and other ASEAN countries. That being said, China will not weaken in its resolve to safeguard its territorial sovereignty and maritime rights and interests. Hope the Philippines will realize that trying itself to some major power and forcing China to back down on issues concerning China's core interests will lead to nowhere. Ultimately, it is the Philippines' own interests and the region's peace and stability that will take the toll.

      One of the most intractable issues in the South China Sea is which state has sovereignty over the disputed islands. Some or all of the Spratly Islands are claimed by China, Vietnam, Malaysia, the Philippines, Brunei, and Taiwan. The Paracel Islands are claimed by China and Vietnam. Territorial sovereignty disputes are governed by rules of customary international law on the acquisition and loss of territory, not by UNCLOS.
      the underlying dispute between the claimant countries since 1945 is one of territorial rights over the SCS islands. After oil was discovered in the SCS in 1969, Philippines started to challenge China’s claims of territorial rights over the SCS islands, after having kept quiet for 25 years prior.
      And UNCLOS is not the proper forum because it does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory, which can be decided by the ICJ ONLY. No jurisdiction means no power to define the sovereignty rights over the disputed islands. If Philippines were serious about its claim, it would have commenced proceedings with ICJ and not a powerless UNCLOS tribunal.
      Besides, China had already opted out of arbitration by lodging an article 298(1) UNCLOS declaration in 2006, just as more than 40 signatory countries have done.

    There is supposed to be NO maritime dispute between China and the PH if only China follows and respects the International Law of the Sea (UNCLOS). The area where this harassment of Filipino fishermen and Filipino boats is happening is in the WEST PH SEA which is also called the PH EEZ ( Exclusive Economic Zone). Where is the logic there? How can an EEZ of a country be claimed by another country that is far far away? EEZs are like a country's backyard actually.

    To be precise the areas qouted are not disputed areas , but the areas are being attacked , invaded & annexed by CHINA in violation of International laws & statutes !
    Look at all the illegal claims between India , Russia , the ASIAN countries including Japan , Vietnam , Indonesia , PHILIPPINES , Thailand , Malaysia , etc. and all the other countries ?
    This are all settled boundaries but CHINA just fabricated the 9 dashline map that is growing & expanding in coverage , to invade into the territories of the other sovereign countries , until it would have invaded the whole world ?
    CHINA is embarking in a military expansion for its dream of an imperial domination !

    News reports should not say "disputed" as Phils and other particularly asian countries have indisputable sovereign maritime rights over their respective EEZs as affirmed by UN Arbitral ruling & long ago worlwide recognized/observed UNCLOS to which China is ironically a signatory. China is now focussing on a militarily weaker Phils,good thing we have a defense treaty w the US.China's invasive actions into EEZs of militarily stronger Japan, S. Korea, Vietnam & Indonesia seem to have subsided .

    If we look at the SCS dispute from both natural and man-made reasons, we will find that the Philippines is the owner in both reasons. Naturally, a country owns the sea that borders on the country. Since the SCS borders on the Philippines and therefore it owns part of the SCS. Philippines is one of the owners.
    The man-made reason is the UNCLOS; it delimited a EEZ to the Philippines.
