شرعی اصطلاح میں طاغوت سے مراد خاص طور پر وہ شخص ہے، جو ارتکاب جرائم میں ناجائز امور میں اپنے گروہ کا سرغنہ یا سربرہ ہو۔
طاغوت کی تعریف ادب ولغت کے امام جوہری نے یہ کی ہے۔ والطاغوت الکاہن والشیطان وکل راس فی الضلال۔ یعنی طاغوت کا اطلاق کاہن اور شیطان پر بھی ہوتا ہے اور اس شخص کو بھی طاغوت کہتے ہیں جو کسی گمراہی کا سرغنہ ہو۔[1]
اسلامی اصطلاح میں اس سلسلے میں مزید وسعت ہے۔ طاغوت سے مراد وہ حاکم یے جو قانون الہی کے علاوہ کسی دوسرے قانون کے مطابق فیصلہ کرتا ہے اور وہ نظام عدالت بھی اسی میں آتا ہے، جو نہ تو اقتدار اعلی یعنی اﷲ کا مطیع ہو اور نہ اﷲ کی کتاب کو سند مانتا ہو۔ لہذا قرآن مجید میں ایک آیت کے حوالے سے ہے کہ جو عدالت طاغوت کی حیثیت رکھتی ہے، اس کے پاس اپنے معاملات فیصلہ کے لیے، لے کر جانا ایمان کے منافی ہے۔
