Minute 47, it is not a discrepancy because when one parent is exercising parental alienation, the minute he gets or she gets more than 50% authority, the “favored parent” gets even more controlling and has nothing to lose so the toxicity It’s worse.

@@charlesrosaly I think she meant that when alienation has been proven and the “alienated” parent gets more than 50% custody because of it, the parent doing the alienating becomes more toxic. It p*sses the alienating/“favorite” parent off so much that the other parent has more custody, they become worse. They lost their control so they try to regain it back. They feel they have nothing to lose because the case is over.

50/50 should NOT be a must. Many children have been FORCED to go to parents (mother or father) and have been abused. There should not be bias on either side but it absolutely should not be a must 😒

Thank you for law education. Unfortunately, the problem in my divorce case is judge's violation of the law and deny the fact. Judge Kimberly Todd denied the document recorded in docket entry by the clerk has ever been filed, made two different divorce dates in my one divorce, made two different amount of reared child support amounts based on one child support order, faked an case number to jail me in order to block my cancer treatment, faked her order date to cover her failure to satisfy the legal procedure.
Some judges do not work on the law. They work on violation of the law. They are the real criminals.
This is not law, this is legal which has nothing to do with law. The only law is one self
It is judge's violation of the law. The judge has the immunity to protect them to violate the law without any punishment. Some courts are like the criminal scenes for judges to fully perform the crime of violating the law and destroying innocent's lives.

@20:00 where father was assaulted and court threw out the evidence for relevancy. This is the norm, even in cases of abuse with children present or abuse directly to the children. I'm glad the appellate court overruled this but it should not have to go to appellate court.

@@USERTM7 It's not always about mother. As a mother, I filled a joint physical custody and legal custody for my minor children who are 4 and 6 years old. But my children's father filed sole physical custody and legal custody. I did not want a Judge to make decision for us, but he chose to.

I went to fathers right and put down 4 grand and they just wanted my money too. They sounded great when I first went to meet a lawyer but it was all smoke and mirrors. Once you sign on the dotted line they treat you shit. And no results.basically you can do all the same shit yourself. Save your money and try and try and try yourself before hiring a lawyer that will do all them same shit but charge your triple the cost . The court is based on making money from fathers who love and want to see their kids. You can't win. Even with a lawyer. Even a fathers rights lawyer! I had hope after talking with them but all that ended when I handed over 4,000. oh! It doesn't end there, they've been to ONE court date and I just got a bill for 1,200 . A month after giving them 4,000. Have I seen my son? Nope. They don't give fuck. It's a big hustle and everyone's in on but you.

I have a divorce case without a lawyer, he filed withdrawal because I lost money. Now I have to deal with the father of the child wanting complete control of custody. Meaning I have absolutely no rights and no contact with our child. There was no abuse and I am the primary even when we were married. I need help and each consultation I find out here in Houston has lead me to a dead end.
File for 50/50 shared custody. I went through the exact same thing.

I hope to God that was actually unsubstantiated and they didn't hand those children over to a pedophile child abuser. We don't know more than they tell us. But some day all these children are going to be adults and these people will reap what they sow for what they have done. Children know who is alienating vs protecting them and who is abusing them or not.

Alienation is a major problem in this country and it is not being addressed,; these Judges are encouraging this behavior. Family court is big business, and lawyers purposely keep tension between two parents, the goal I to run up billable hours, this is why some people are stuck in family court for years. "Divorce Corp" This documentary movie that came out in 2014 explains how Judges and lawyers play God with people's lives and leave them homeless, penniless, and encourage one parent to lose their children. As Attorney Gloria Alred states in this film, "FOLLOW THE MONEY" The attorney I hired at the time (Mike Schmitt) told me that if DNA showed I was the father, I should be able to get 1 or 2 days visiting time. Why only 1 or 2 days? Why am my JUST a visitor to my own son? Unless there is a finding of fact that a parent is unfit, it should be shared parenting across the board. The state has no business getting involved unless there is a finding of fact that one of the parents is unfit. I am dealing with an alienator, I am going on 7 straight years with zero contact, and the child will be 16 this year, I have only seen him a hand full of times.

And you are correct, these are narcissists that we're dealing with, I won't even bother with narcissists anymore,, I'm fighting family court legally but I avoid unnecessary dealings with narcissistic people, they are a waste of your time.
The unfortunate thing is that family court judges can get away with whatever they want; no jury, no discipline, etc. In my state the Judicial Discipline Commission has told me that even judges lying or adopting dishonest court orders written by the attorney for one side is not misconduct. Judges, even at the appeals level have told me that following the law is 'not an appropriate use of our time' or 'beyond the scope of our duty'. You can represent yourself in family court matters, with most of the law available on line, and court support staff for domestic matters, e.g. in Colorado, the family court facilitator.
And you will get the same outcome! Trust me! 10 grand later. I'm on my 2nd lawyer( from "fathers right") thinking I paid big bucks for the real deal. Not! Their all a bunch of fucking scammers.

Keep a binder for medical documents one for taxes and bank statements one for court documents one for proof also make sure your proof is not in the past present I wish u good luck

in my case i tried to show parental alienation,
i showed the mother willingly keep the child from visits
i showed the boyfriend of the mother did the same.
i used the transcripts of the trial court against them showing the GAL report that stated "if the child's mother liked Larry again then the child wants to see him",

I have been fussing with my situation or our grown son, I was married to Arron Scott Reeves as our son was going into the military. My spouse, Arron began to cause conflicts to upset him in AOL chat rooms when we were together, so that we would never converse much again. And, due to his fears, we have no schedule and it quite upsets me to know our son is not being repaired. I am told to have nothing to do with my X husband and I do not appreciate this pervert they arranged that I live with due to my having no parent, that I appeal.
His dad relocated and we are both losers for our son is a returned Veteran now and our whole rights are infringed upon. I have no phone number to his dad, not my fault. Nobody, not the courts have helped me on any of these matters? I feel defamed, disrupted and accused because he was the bread-winner.

How the heck would somebody only get every other weekend as they’re only form of custody. That equates to one day a week that’s not even legal based on supreme court rulings unless the parent was deemed a very serious danger to the child. I mean seriously one day a week every other weekend that’s pathetic that’s literally 15% custody unless the parent was a multiple of violent felon deemed a danger to their child that’s a complete violation of the parents fundamental rights.
I have not had one day in 5 1/2 years. My daughter has been devastated.
Google King v king appellate court in Missouri. They determined 1 night a week and every other weekend was sufficient to satisfy “joint custody” under HB 1550. A lot of states don’t even have HB 1550 language on the books. That’s why we tried to pass HB 1667. But it failed.

I’ve had that less, going to trial in a couple months and haven’t been allowed to see my daughter in 1 year 4 months. Everything was going ok (of course I wanted to see her more) but then I said something her mom didn’t like, no threats or anything, and then bam! Restraining orders and court filings for more and more money. I had to seek my house, truck got repoed and when I sold the house got a lawyer who seemed didn’t help at all. All I’ve ever wanted is 50/50 and even that breaks my heart but I’m hoping for a judge who can see the truth, what kind of person I am and what kind of person she is and the damage she’s caused.
You need to understand that there is FAR more money and incentives for "the state" to see a highly contested custody issue result in a lopsided parenting time award. Look into Title IV funding. The more the state divides the family, the more assets and reoccurring payments the state is able to "manage."
I'm not accusing these judges of being malicious or biased intentionally, but there is certainly a conflict of interest that is material, meaningful, and reoccurring. Things you look for in conspiracies and racketeering schemes. Keep researching. You're on the right path based on how you referenced constitutional law. Now you need to research the funding aspects and state and county level paradigm.

They are functioning under a ministerial capacity not a judicial one. It’s not law, it’s a contract. Do not consent. I’m not an attorney, do your own research.

Does paying child support determine visitation rights? Or is that a separate issue?
Child support and visitation are separate, although child support ( depending on location/ state) can be sometimes modified due to the amount of visitation/ custody time. I'm in New York where both parents are obligated by law to financially provide for the child. Even if joint custody is set, one parent will be on child support. In some other states, if parents have equal parenting time (say one week each on and off) neither patent is legally on child support as they're both expected to provide the child's needs during the time the children are in each parents home.

why do the state move children more than 50 miles away from parents also the state can default on visitations and a parent can't in anything like forgetting a family meeting considering that some parents work in high physical jobs they will be tired after work and the state will suspend a parent visits for forgetting a meeting once.

She is living half the week with a dysfunctional family that has tow full grown German shepherds that live in the home and are on Prozac. He is to stupid to have responsibility of a baby. However a judge has split visitation right down the middle. Watching the way it is affecting the baby is horrendous. The thing that should be considered is the well being of the child not who has to pay child support.

I would be considered an enemy of the feminist movement, I am proud of men and what they can achieve, however most men are loved dearly by their children, but when they are babies they more often than not need their mothers. Men should love their children enough to not cause a disruption with their nurturing years with their mother. We need help! My fiance's kids are adapting their mothers habbits in acting out negative behavior toward their dad as the mother does and she's using this as a way to ruin his relationship with the kids. It's been a struggle but it seems that all she has to say to the children is negative things about our home and their dad, from the way they smell like his house when they go to her where the children feel they have to take showers before they go home with her, saying he's a looser and don't make money, telling' them he doesn't pay child support to as far as not buying them clothes amongs other things. She is teaching the 7 now 8yr old to write hate notes about us and love notes about her and her new husband. States to the children that our church is a cult when is just a simple small church. We jsut want to teach them morals and values, is something they were introduced by him since babies. It just keeps on going and is never ending. When we feel a calmness she always finds something new to harrase him and now me about things. I just don't get it why can't she just be an adult and see how this is affecting the children and that they're the ones that matter, we all should do the best to raise them healthy and strong. Not broken full of hate and confusion. I feel really bad because he's honestly very nurturing and a really great parent to his children. Can someone give us some advise on what should he do and how should he go about to stop this or at least defend him self?
Honestly, the best move you could make is to leave your fiancé.
Children deserve to be raised by two loving, married parents. If that cannot happen, the worst thing the parents can do is to put their happiness above that of their children by entering into new romantic relationships. These new relationships only add to the chaos and dysfunction that the innocent children have to deal with, through no fault of their own.
You yourself have stated how toxic the relationship has become because of the ex-wife and her new husband; why would you choose to add to that trauma?

The one fact this speaker is not addressing is that the federal incentive funds that each state gets under the Title IV- D and
Title IV-E is actually rewarding state officials such as Judges, child support hearing officers, case workers and law guardians to separate children from their parents. The less time parent has with their children, the more money that gets laundered through the child support agency, which equals for federal dollars for that state. Former State Senator Nancy Schaefer exposed this money laundering scam and said you have to shut down the incentive money that drives this corruption. Law Guardian Ella Marshall recommended in my case that I start with 6 total hours a week of visiting time with my son, she also stated to me that the mother was WILLING to let me visit Nick for 2 hours on Christmas. No due process, no specific charges of wrong doing brought against me, nothing, Ella Marshall just pulled this nothing of visiting time out of thin air because it allows for the maximum amount of child support to pass through the child support agency so they can report higher collection numbers. The mother, Deanne, decided that 6 hours on Saturday was too much time and zero holidays was too much time and made the decision that a court order that gave me joint custody was meaninglessness, But there is a Void Judgment court order that forces me to send money to the child support agency, I say void judgment because fact finder Linda Lohner Pilato who is not a judge signed the phony court order.
I have some proof of alienation there's been a lot of different factors that have gone on I've been keeping a journal documenting the children's behavior long story about things I have been honest throughout the entire process I say nothing about their father in front of them It's been a difficult rd joint custody isn't working out at this point so difficult he has a restraining order that is up soon i find the legal system here hasn't been good. @Robyn I hope it is better for you now, that is 2 years later. I'm sorry you had to go through this. Unfortunately, I'm finding out, it's not about truth nor being honest. It's a legal system working on manipulation and controlling people. Documentation says one thing, and the judges choose to rule with their own decisions not by the 'law' unless it is to benefit the party they choose. These judges must be removed from public office, never to work again in such positions. Permanently banned from holding public office. But they make the laws to protect themselves and the attorneys who are liars and disrespectful to the people. Especially in family court. There is no exception for being disrespectful. Period. Another lawyer who will not acknowledge the bias against father's in family court. I'm beginning to see a pattern.
He keeps referencing the courts "obligation" to consider the possibility of joint custody but fails to mention how loose the standards of consideration is in these cases. The statistics demonstrate the proof. Mother's get custody and father's get visitation. Father's pay child support and mothers are almost exclusively entitled to additional state benefits.

You are 100 percent correct, these lawyers are not going to help fathers, my atrtorney seemed to be helping the opposing attorney and the hearing officer to force me into a title IV-D contract. The law guardian offered me 6 hours of visiting time on Sunday and said the mother was willing to let me visit my son for 2 hours on Christmas, the decided i shouldn't have any visiting time.
I'm 24 years old.. And have a 5 year old daughter, that the co-parent and I have been raising together... I've been part of her life since the moment of birth .. till the last 7 MONTHS... The co-parent and I are no longer together... The 3rd month of not being able to see our daughter. I served her paperwork for Legal Separation, and Parental Rights... There is an agreement, and set Parenting schedule that has been in affect since the agreement.. My question would be, Within the 7 months of not being able to See, nor communicate with out daughter. Is there Parental Alienation happening? I would assume so.. because I wonder what she's been telling our daughter about my "absence"? I miss her terribly. Hoping that there would be some kind of communication during Holidays and Birthdays :( I always make a gift baskets for her with small toys, and puzzles and most importantly including snacks, and drinks.. I always write on a gift card that I miss her, and that she's doing a great job taking care of her mother, and that she'll see me very soon. Her first day of school was 2 weeks ago. Long story long court battles over 4 yrs no joint decisions being made were the victims of conjugal violence it's extremely difficult there's been parenting alienating from the being I'm being further abused by the other party through the court system. It's gotten to the point my name has been slaughtered. I have gotten to the point I've seriously altered the agreement to basically loose out on how much child support that has been owed over 4 yrs which wasn't paid until recently and hasn't been abided by late drop offs examples paying child support late neglect. There's even been child abuse. There's been many factors and the recent one has been him saying he won't continue to pay our child will be needing braces I feel the support needs to continue due to our child needing dental work done. As well their father claims that the child never asked for therapy when she has been asking for yrs. Custody exchange is through 3rd party and commication due to him threatening myself and stalking behavior in the past. He has continued his behavior throughout the court process I've had to change my phone number 3 times I've been the primary parent. He has gone as far to threaten Custody it's been so difficult when he's purjing himself and contempt. I just want what's best by our children. I wish I wasn't shared in shared custody we can not get along never have I tried to settle so many times so much back and forth barely getting anything from him because I didn't want to give up fighting for our children and still it wasn't good enough on his part. I have enough evidence and witnesses that I can use against him I tried to be reasonable and still he wouldn't do what is best our children are suffering in this case I don't think it's best the shared I'm dealing with a narcissist him and his lawyer. I'm heart broken 💔 for our children I want to move forward he's trying to ruin the relationship I have with my children it's been beyond difficult. 💔
The court should talk about conjugal abuse when there's no contact I'm worried for my safety the abuse doesn't stop it keeps going either through the kids or through the phone. I was trying to tell my lawyer joint custody isn't working out. This is Horrible I feel like no one is listening I've taken the kids to all doc appointments and paid for all appointments. I won't agree to contact I don't trust him we can't get along. Here threats has to be death threats he was pretty close breaking my walls and my cello stealing items a phone that has audios I copied them I should've erased my phone I didn't know he'd break in a steal it I still can't find that phone I strongly feel hes stolen this and a lighter of mine. I stayed in our apartment and managed to pay all the bills It's been rough,but I managed by myself. I kept the kids in the same school for all the school yrs. I have tried to do what is best by our children. I have my parents thankfully I'm very grateful I work odd hours it makes it difficult the children have a great relationship with my parents I'm truly grateful for them they have been my rock and my support. In 2009 when jace was 4mo old Jose hit my doughter blackened both her eyes after that we never seen or talked, then in late 2016 jose showed up and ask if stacia was home then if he could see jace BIGGEST MISTAKE I EVER MADE. Yep I feel my sons lawyer screwed him over we had so much on he ex wife but no one listened not even the judge. Now he has to pay 600 a month in child support and we are struggling to hold everything together.

What has to change in that respect is when there is A legal visitation order any blocking of it it should be an.offence by which it counts against the custodial parent.
