      Agreed, so it should follow that a background check is racist as well. If showing id to vote disproportionately effects minorities, then it effects them disproportionately in the ability to defend themselves as well.

      "Loophole" is just a euphemism for "we haven't passed a useless and counterproductive law to criminalize exactly that yet".     Its not a loop hole its the law that you can sell guns privately and has been from the beginning of this country. So this time they just bypassed the dog and went after the human. The ATF should be raided and defunded for selling guns to the cartel after Fast and Furious. JMO

    3 thoughts.
    1. You are not required to have an FFL to conduct a private sale. He was not in business, it was a hobby. Even if he sold 100 guns a year, he at most made $100 per gun. Doubt a guy making $200K + a tear gives up his weekends just to make an extra $10K.
    2. This was a "search" warrant not an arrest warrant. There is only one reason to conduct a no-knock search-to prevent the loss of evidence. Dude was certainly not at risk of flushing his guns down the toilet.
    3. Most normal gun owners would come up firing when the door is kicked in at 6am. This is deliberate confrontation/escalation by the ATF. The search could and should have occurred while he was at work

    He was killed for doing something he was legally allowed to do. You do not need an FFL to sell firearms person to person. Buying a lot of firearms is also not illegal. The ATF literally murdered this man for his legal rights.

    Few facts here: they didn’t even have an arrest warrant, just a search warrant, the warrant read during daylight hours from 6am to 10pm, why a no knock kick the door in? Dude was rich and clean record, just knock on the dang door!!! Shootout with agents?? What would you do if your door is kicked in while your sleeping??

    In Massachusetts few weeks ago, a FEDEX driver from Middleboro stole multiple firearms from the FedEx truck that were being shipped and then sold them later got ONLY 10 days time served....and probation.

    6?? You mean 3 that found during a traffic stop the cop said they smelt marijuana?? Technically it was a crime to possess a gun and marijuana at the same time. But never said the guy that purchased the gun was a felon. Then the three guns that were purchased by the ATF. It was a search warrant not an arrest warrant either. Plus the warrant said 6:00 a.m. to 10 a.m. and they went during daylight savings time. To ensure that they have the cover of darkness to kick in the door.

    So how many guns can you buy and sell to where they consider you have to have a FFL if you ask the ATF they cannot answer your question it's like people that sell cars you have to have a dealer's license if you sell over a certain amount

    I once worked with a guy who privately bought and sold cars at a much higher rate than the average person and I worked with another guy who bought and sold houses after fixing them up with his wife. It is not the government’s business what free people do.

    so having read the entire warrant in its entirety clearly, something KARK didn’t it seems as if he was selling his personal Firearms 3-4 to individuals in an individual to individual sale again completely legal he also purchased a large gun safe for his home and approximately 94 firearms for that safe again completely legal most people don't know this but whenever you buy more than two Firearms at one time it's reported to the ATF and your County's lead law enforcement officer
    then it seems like the person that he sold the Firearms to resold them to criminals and they were stopped by LRPD and Conway PD all of that triggered an ATF warrant for a search of his property and a No Knock Warrant at that SO the ATF rolls up to his house in a VERY nice neighborhood at 5:45 AM and kicks in his door without identifying themselves they are shot at they return fire and bams your uncle we have 2 people shot now one dead

    It's not a Loop Hole. It was specifically added to the Firearm Owners Protection Act to allow private citizens to sell their firearms through private sales. It's not a Loop Hole if it's the stated intent of the law.

    They only had a search warrant not an arrest warrant. This could have been avoided if they perhaps waited as he arrived home from work, approached him, identified themselves and presented the SEARCH warrant. They had little evidence, the SEARCH warrant was to try to obtain more evidence for an ARREST warrant.

    no such thing as a gun show loophole the laws do not change in a building jsut because it says gun show all ffl dealers are required to do a form 4473 and a background check private salers are not federally required to do so they heave to follow stater lwas like in missouri private salers can sale wihtout anything ruther its a gun show or not just cant knowingly place a prohibited person in posession

    yeah so, he was such a risk that the ATF had to do a surprise raid early in the morning on his home? so sure, he wouldn't just think this was a home invasion!? they were watching him, knew where he worked, knew he had no history of violence. and yet went with the most extreme way of taking him into custody.

    Premeditated murder , there's no reason why they couldn't show up during normal business hours and contact him and his job or other places and kept it cordial, they did it in a way where they could murder him, that was the reason that's the way they executed it and that's the only way you can sum it up.     I think the big question here should be the lack of judgement on the ATF’s part. This should have been an issue handled by lawyers and should not have resulted in a shootout. This guy was a respected citizen in his everyday life and was not out here selling Willie Nellie to drug gangs .

    It's funny that the news is only focused on him and not the ATF raiding his home at 6am. They had been watching him for weeks and knew everything about him. They could have simply went to his job, pulled him over, or went to his house at any time other than a 6 am raid. They get their thrill on when it comes to raids.

The possibility of him having weapons is greater at his house than anywhere else especially work. They could of had a marked unit pull him over in a traffic stop. He wasn't wanted for murder or anything. They were checking in why he was buying and selling weapons. Which by the way is LEGAL. Get a grip.

    Why aren't these "Journalists" asking some of the most obvious questions. Like Why was a no knock warrant being served at 6am while his family would be there and any normal person would believe they were being broken into and respond to a threat, just like he did? Why not serve the warrant while at his place of work so this could have happened in a controlled manner? Who was the judge that signed the No knock warrant and the reasoning they and the ATF used for it? Body cameras were reportedly not worn when that is the norm, why? This sounds more and more like a hit.

    The ATF Raid on Brian Malinowski's home gives all the appearances of an assassination. Several agents armed with fully automatic weapons arrive at his home at 6AM while the majority of people are soundly asleep in their beds, they place tape over his security cameras, they break down his door and enter his home with machine guns at the ready. Brian Malinowski in all probability believed that there was a Home Invasion taking place, arms himself and goes to meet the threat to his home and family. Gunfire is exchanged and Mr. Malinowski is shot in the head and expires later. My questions are: Why did the ATF place tape over the home security camera if they were only there to serve a search warrant? Why did none of the agents and officers at the scene wear body cameras? Why was the search warrant served at 6AM when they could have just as easily served it at noon, in broad daylight when the man was awake and could easily recognize the agents to prevent confusion?

    I'm somewhat surprised that the promoters don't require an FFL to get a table. This wouldn't prevent the common parking lot trades between private owners at gun shows.

      See that’s the thing. Just leave all of us alone. The criminal part of society follows no laws. This one is a Bill Of Rights thing that can’t be restricted regardless of what Scalia thought. Just keep using the tables. To do it any other way makes it look shady instead of law abiding

    He didn't have to have a license and there is no limit on how many he could sell. They had no proof he knew anyone used those guns for a crime either. Why didn't they go to him in the daylight and speak to him instead of busting in his home with no body cams at 6 a.m.? I say charge the atf with manslaughter at the very least because they had no right doing what they did. Man had never been in trouble before. This ended the way they wanted it too. Trying to make him out to be a crazy gun owner.

    I especially like how they left out the part that, even if you are a private seller, it is still a felony to sell, gift, loan, or otherwise transfer a gun to a prohibited person. If you didn't know they were a prohibited person? Still a felony. It is for this exact reason gun owners will be advised by other gun owners, repeatedly, to not sell to anybody whose personal history they do not know well.
    If you're going to talk about the "loophole" that allows prohibited persons to potentially acquire a firearm, it is the highest order of dishonesty to present that as if the person who sells it to them will face no legal consequences for doing so.
