    Initially, Right to Property was included in the category of Fundamental rights however, by the Constitution (44th) amendment act, 1978 it was removed from the category of Fundamental rights and introduced as a statutory right under article 300A of Indian constitution.
    •Reason:-
    1) As article 31 states that 'No person shall be deprived of his/her property save by authority of law', hence government could not take away the property of an individual for social welfare purposes. The removal of this right empowered the state to take the property of individuals for social welfare purposes by giving them compensation.
    2) To reduce boundaries between rich and poor.

      I have a doubt... Anyways as per Article.31C the Fundamental rights aren't absolute then why did they have to make RIGHT TO PROPERTY a constitutional right....being a fundamental right it could still be curtailed under the A.31C like any other fundamental right from A.14 to A.19

    It was fundamental right but,
    Right to property was deleted from the list of fundamental rights by 44th amendments act,1978.
    It is made a legal right under article 300A in part 12th of the constitution.

    Ma'am it's a constitutional right...then how it can be regulated; curtailed or modified through an ordinary law without amending constitution (as mentioned in laxmikanth)..... If you reply it would be a great help!!!!!!!!!!!

    So is there essentially a clear difference between a Constitutional Right and a Legal Right?

    • @LawDigestbyAyushi
      @LawDigestbyAyushi  Před 3 měsíci

      Constitutional right stems from the Constitution itself. Legal right is a right given by any statute

    • @tusharbanerjea1602
      @tusharbanerjea1602 Před 3 měsíci

      So to begin with, right to property was a FR, following which it became a Legal Right, and is now a Constitutional Right.
      It has in effect, held 3 different positions of recognition! Right?

      I wish to ask something that isn't related to the contents of this video.
      Is there a way to identify statutory bodies, constitutional bodies and executive bodies by merely looking at their names? Knowing this would be helpful
