  • Too often situations come up when someone can’t (or just chooses not to) pay the child support that was ordered by the court for various reasons. But what happens when you don’t pay? How does this negatively impact you, and what can you do to avoid problems.

    Are you a deadbeat parent who abandoned their children and no longer wish to have anything to do with them ever again? If this is you, and you don't want to pay your court-ordered child support ever, then move to the state of TN! Tennessee is heavily lenient toward deadbeat parents, and shows no justice to children and custodial parents--even with a court order for child support in place! A non-custodial parent who chooses to no longer be involved in their children's lives can remain perpetually unemployed or underemployed, racking up all the arrears and interest, until they are finally deceased, then they will never have to pay what was ordered by the judge. Hence, in the state of TN, you will never suffer any significant legal repercussions whatsoever for not paying your child support. It does not matter that you are essentially in contempt of court--it won't go anywhere as long as you are able to keep a low income or neglect to report income you are making under the table. This should come as a tremendous comfort to the deadbeat parents who already don't care. The custodial parents, like myself, and our precious children, don't need help through financial hardship, we can just keep supporting everyone no matter what--not providing for our children is NOT an option, nor would we ever want it to be. We love our children enough to provide for them, it is our God-given role to provide for them, to love them, to support and provide security, to nurture, to always be there for them. People who refuse to provide for their children make me physically sick. The court system in the state of TN fails children and mothers. The only true justice is God's justice, and woe to you who are guilty of mistreating your children, for you will face God's perfect justice and wrath on the Day of Judgement.

      My ex owed $17,000 2yrs stop paying child support this was ordered by Court. He refused to pay and I was informed by the Child Support agency that his driver license been suspended since July 2021 but we found out that wasn't the case. California it's been a "deadbeat"dad State. They don't really take care of children and the full custodial mother. Unless you have money to hire an attorney. I am really at lost.

      Here's the thing the state is not allowed to harm the DB, He could sue the government. They take away his license. He has no way to make money. They have to be careful what they do , The problem is they lead us on to believe they have more power than they actually do. They can only put pressure on them to they still have their day in court, which they can give their answer. And if it's satisfactory to the court well... However, I think they should be a little bit more aggressive when an order is in place. Especially, you just went through court proceeding. And they saw the evidence enough to issue this order, And when violated, that's what gets them, put jail. Not just that they don't pay as this is a no debtors nation, or at least not supposed to be. 😉

    The first consequence for failing to pay - is that the judge will slap a criminal contempt of court charge on the deadbeater. This will mean a criminal record on the deadbeater, and usually this is a Class D misdemeanor--which means 30 days or so in jail for the defaulter. Also depends on the state the deadbeater is when facing jail time - can be more than 30 days or less. It varies.
    Additional consequences can be painful too---whether these penalties will be on your rap sheet or not:
    1. Your passport can be taken away.
    2. Your pro license/certification license can be taken away. If your law license is taken away, for instance, you could be disbarred indefinitely until you get that license back.
    3. Your wages could be garnished. This garnishment can even hit a parent's pension, 401K, other investments, and even worse--one's social security checks!! The garnishment penalty is to help make up for the lost support.
    4. The unresolved default will be passed to credit bureaus. This will mean a severe penalty drop on your credit rating. So a FICO score of 780 can go down as low as 200 or less if you "deadbeat". This will make it harder to do things like renting apartments or opening up bank loans.
    5. Liens on a deadbeat's assets (for example, a parent's boat, or a parent's vacation home) can also be possible too.

    This is why i am single and will remain single probably for the rest of my days, because i don't want my HARD EARNING MONEY to be enjoyed by some lazy bum. ( she may have a boyfriend ) and some of my money for sure she will give it to him and he the Bum will go buy weed.

    Child support is a contract, plain and simple. It is ALSO a Voluntary contract run by a third party company who's only interested in making money for it and the state, NOT the child. I do advocate BOTH parents pay EQUAL amounts monthly that CAN be verified. CS is NOT a fair practice business, it's NOT part of the govt., It has a contract with the govt to receive 60 percent from the fed govt for every dollar it brings in. Lawyers, judges, clerk's , receive a percentage put into funds for them. So you think your gonna get a fair shake when the courts are committing crimes? Please..

      Be mindful of other jurisdictions to resolve your case. You may have to measure the issue and bring complaints for proper service.

      Pursuant to 45 C.F.R. § 302.10, the IV-D agency was required to enter into a 45 C.F.R. § 302.34 IV-D contract with County courts and law enforcement officials to provide for collection of IV-D order money. § 10:110-1.2 (c) Region 2 oversee the delivery of child support IV-D services involving Contracted service providers of the Child Support IV-D program operating in New Jersey.

      A child support order/ comes from the court. The child support collection agency is just that a collection agency. The courts or agency don't recieve any money collected from childsupport unless due through other welfare cash programs that were recieved by the CP. The processing company may charge a fee. I'm not sure how you can call it voluntary when your served , It's not like you get to choose how much Child support you pay. The agency lacks on collection, it's more of administrative mediator to keep it out of the court.

    You know when parenting has become a HUGE irresponsibility issue when mothers and fathers are referred to as "Baby Mamas" / "Baby Daddys", and shows such as _Maury_ now hold standard daytime TV programming timeslots to the tune of millions, if not billions of viewers! It's gotten to utterly disgusting proportions!

      Sad part is him or his family wants anything to do with the baby. No letters, Birthday Cards, presents,pictures,gift cards etc yet they have money.shame on them people. What can you do to help a Mom in that scenario who doesn't have money?

    Who remembers the "Law of the Land" The Constitution"? .. The child support agency is not"judicial" they are"Executive" and have no Laws. Anyone who is Contracted under Title iv-d is Independent: agents/Employees/Police/Sheriffs/bailiffs/lawyers/Judges. No powers at all. You can't be jailed for a debt that you can't payoff anyways. They don't investigate anything about your situation because it dosen't "PAY". They have no authority of you"Jurisdiction".. They trick u into consent.. Verbally/signing/responding to Hearings/warrants/summons. Numerous unlawful ways. So ask yourselves this, when did i sign up for a loan? I mean this is all about a debt of monies..no? So when did you take out a hefty loan and never paid a cent back on it? Tell them you want to see that contract. These lawyers/judges watch each others backs so be weary. Child support is "Voluntary".. They get paid fromcthe Fed Gov't to lie to you and Coerce you into signing on that dotted line. Referees aren't judicial judges. Actors and the badge wearing court officers are"Private Security". .. Start fighting back on this Unjudicial system. You want your Case files and you wanna see the Contract you signed for that Loan? Guess who actually owns that Loan?

      Im new to this a bit and still researching but theres other measure that child enforcement can take, like garnishing unemployment, tax refunds, a lien on their vehicle, reporting to credit, taking license... im sorta at this stage myself, i dont want him locked up but since hes done this before he seems to not care if hes going to court or what could happen either, when i try to figure it out im told im making threats smh

    Ok so you work at McDonald’s you make 230 a week. Child support takes you down to 90 a week. Somehow you have to buy food and pay rent. So you eat for free at work once a day and live in a shit hole .... you go down to child support to modify your unfair amount. And that costs you 140 dollars you don’t have. When the sytem knows you can’t survive but garnishes you anyway. What’s your answer ... go to school .... not if your a white male. You can’t get help for that unless you have good credit

      No, you fight this system by having them prove jurisdiction over you (THEY DON'T HAVE ANY POWER OVER YOU) and have them show you the contract you signed for you to garnish your wages

    I really enjoy your videos! Here in Virginia there's a law here that if the NCP is proven to be willfully unemployed to avoid CS that they will still have to pay the same amount and a modification to CS wont be granted (which my ex has said he filed for). Is this commonly done? I recently have found PROOF of his fiance from 4 years ago till last year advertising on social media to get him side work but also had made a business logo. They seem to have no license and not claiming wages. Will photos of these fb ads help my case or do I need more to show that he is trying to avoid CS so that I can request that it not be modified. I'm not even sure what to do next with this info, I just opened a case with DCSE... do I make my case to them or do I need to file like a show cause or something? Any advise would be so much appreciated!

    Please explain to me how you going to charge me interest on a debt that you don't even have my permission to put me on. You should be teaching people that child support is fraud and be in fighting for that.
    It is absolute BS that the government charges you interest on a debt that it doesn't even have permission to put you in.

    Hey. Love your channel. Two years ago I won custody of my kids, but the mother hasn't paid any of her court ordered child support. She's a self employed beautician, but now she's claiming that she doesn't work. What can I do??

      Willie McDaniel you need to find her income. This can be done in many different ways. For example...private investigators can discover where she works and how often and potentially how much she makes, or you can conduct discovery (look up: form interrogatories or special interrogatories) to ask her to produce documents or info related to her work, you can also subpoena her clients to testify about how much she charges and how often they see her. Finally, you may be able to ask the court to impute income to her based on her earning ability, rather than using her actual income. These are just a few ways and of course you should seek local counsel or look up the laws and procedures related to this in your state. Hope this helps get you in the right direction at least 😊

      But yes, you’re correct you will end up in jail because they don’t follow the law they do whatever they want and there’s nobody holding anybody accountable to legal to incarcerated person for a death in America yet we have thousands of people locked up for debt right now…. when the lawmakers find a way to bypass laws …… we live in a lower society and that turns into tyranny, which is the whole reason we fought the revolutionary war only this time there’s nowhere to go to get away from it

    My daughter is 32, her father has never been I. Her life. There was a csu order started in 93 he has since moved to another city gotten married 2 x and has about 6 children. The order started at $100 was modified to $60 and he has never really paid the support although we would receive a $5, $11 check from time to time as a result of a garnishment of some kind. Now the amount owed is 48,000.00. Did I mention my daughter is 32? I’ve raised her she is an adult adult. They know where this man is yes they continue ye to collect this small change? Thank goodness she didn’t need him to survive. What can I do to get that 48000.00?

I thank him daily for the gift he gave me because she brings joy to everyone who knows her. She has unconditional love which you can’t pay for and despite his lack of support has grown up to be an absolutely outstanding woman. His loss.

    It's an agency based on artificial success ratings of the assistance provided. They extort money and improperly process proceedings based on miscalculated guidelines. With interest on money that further in debts the payer, may have a chance of property loss and or prosecutions of fines and jail. The organization also conducts itself thru forced authority by not informing you to resolve your case in a jurisdiction court not to face agency charges. They would lose funding. According to the original purpose of the program, no one but the agency is supposed to benefit.

    Hello i been on disability since 2019. I stopped paying my required child support for the past 2 years. I hired an attorney and filed a motion but i was denied for reduced payment now I got a notice that my passport in denied. My question is will I be able to travel overseas since my passport is not revoked? I was paying $988 a month now I owe $ 26000

    Will you please talk about when one of the parents is not paying child support, not calling, not visiting or taking the kids on his days and also blocking the mother of their children on the phone and removing from social media (use for childrens video call) so there is no communication as he ignores the mothers calls and the childrens calls and voice and text messages and also moving without telling the mother of the children, what to do in that case?

    I don't know what to do anymore..
    It's been an year n my baby daddy has never gave me any child support..I called him yesterday and he said he has no problem upbringing our child n now am calling him he's not picking up...
    He relocated from where he used to live to another place where I have no idea where he lives.....

      muscle hamster hey! Lol typically, it’s not used unless the circumstances are extreme such as...if the grandparent has adopted the children or otherwise has Guardianship of the children. Then, it may be used to calculate how much support they should receive for taking care of the kids. Otherwise, in some states it may come into play if a child’s parent lives with their parents (the grandparents) and is claiming they have no income (because the parents take care of them). Then, it’s possible some of those expenses being paid by the parent may be imputed as income to the parent. But, it really depends on the state, laws in that state, and the circumstances.     you don't have to file any modification when you didn't give voluntary consent. these are not court orders at its administrative..and this is why there is a separation between men and women and them contractors you talking about are imposters stop lying
