    Your videos are such a blessing Kseniya! Just wanted to share my experience here with the I864 and recently updated poverty guidelines. My PD is May 2022 but in January 2023 right after the poverty guidelines got updated we received an RFE for the I-864. We were above the threshold last year but fell below with the update and so we had to get a joint sponsor. I did not know this but any recent updates may apply to people who have applied months before, so this is something to bear in mind. Interestingly, in the RFE letter they never stated what the reason was or what evidence they specifically wanted. So it was through our own digging that we found out that new poverty guidelines had been published which was probably the issue we were now facing.

    I just filed for myself for I485 , marriage based. We did get approved for I130 earlier this year (we did it separately because at the time we didn’t know 100% if we could do both together and not enough funds at the time) last year we just made enough over the poverty limit for a household of three but I included more information regarding my husbands current income like 6months paystub and current income amount showing for this year from his work. Let’s see how it goes . And thank you Kseniya for your guidance🙏🏻 would not have been able to navigate it all by myself .
    Edit : my I485 was just approved and I had no issues ! 125 days

    Hello. I'm so confused I applied for my husband and 3 step kids. My dad and stepmom sponsored them, and I also sent in my income information. Today I received letters for all of the kids i485 requesting more evidence from my dad. He is retired but his income is still a lot as well as my stepmom, she still works. Both of their incomes combined was well over the USCIS requirements. I'm so nervous I just want everything to work out. I filed for them less than a month ago and we have received all their application receipts and the letter today for the income proof. I must say they're working pretty fast! I ran to your videos :) I Love them.

    Hi, Kseniya, I am in a predicament and live with 2 family members, I know I make just enough to sponsor my wife, but as of right now I am filling out my I-130 and if it gets approved, which I want it to, what next?
    the only reason I am living with family members is because I am saving a ton of money by doing this, and they are elderly and need help. And also when me and my wife we have a place of our own, I will have double the amount saved up for our own home.
    I am just trying to be financially smart, but also helping out my family by living with them, they are not dependent on me, so I am just curious how would the government would go about this situation? I am planning to move to my new places prior to my wife getting into the states anyways but I realize this process could take 1 year to 2 years. I should also mention these family members are not cosponsers, I just live there for the next year before my wife comes here to the us.
    any tips or advice is appreciated ! Thank you

    He has a business, we are sending his taxes 2022.
    Which amount we need to use in that taxes, he says the amount in 2022 ( $28000+), but I think the amount that appear in Federal Poverty Guideline 2023 ( $31000+)

    Hi Kseniya, thank you for your video! I have a tricky case which needs your advice. I am the only Petitioner, but I have a joint tax return with my husband. In the tax return, my total income is exceeding the poverty line, but my husband has negative income due to close of his business in 2022. So, which income will be count , my own income or the total household income after deducting my husband's lost? If I need count his negative income, does he need to fill in the I-864A?     Hi Kseniya hoping that you can answer my question. So i'am planning to petition my wife and 2 kids. I'am worried about my annual income. Because right now i'm living with my mom and stepfather. My plan is to file the i130 even im still here living with them and then move to a apartment after 1 or 2 years before they process my application and just change the address so that the household number is lower compare to the household number right now.

    My petitioner, who is mi wife, is under de line of the poverty, so her brother in law is going to help her as a co-sponsor. The thing is they live in the same house, but they pay taxes separately and no one is dependent of the other. Is her brother-in-law must be counted as a household member or as a joint sponsor? If he is a household member, what relation proof can be shown? Something that shows her relation with her sister and,in the same way, some document to demonstrates the marriage between her sister and her brtoher-in-law?

    What if the immigrant has worked in the US for 5 years? Can their income be used if the sponsor doesn’t make enough money. My husband makes more than enough for our household of 2 but I’m the one sponsoring him. And we don’t want to use a co-sponsor.

      it's 125% guideline to meet for your household. Even if you meet that, they will deny you because they see it as you just making it, still being a risk for public charge. In reality, you need to be at 135 or 140% to satisfy.
      all in all, the u.s. govt. is pagan, corrupt and evil

    I'm currently on an H1B working visa and have a full-time job. My husband made a little bit more above the line last year. This year he is making a lot more but there's no tax form yet. But we got the employment letter and his pay stubs. As a household of 2, me as the beneficiary, shall we include my tax return as well? (We got married last year and filed separately last year).     Hi Kseniya My wife is a US Citizen and she is disabled from state of MN.we don't have joint Sponsor.
    She has only 1099 Documents social security Income Benefits.
    Is it ok for the Embassy as a proof of income.
    My visa was Refused 5 months ago I am Under Administrative processing I got 221g & DS5535 from US ISLAMABAD PAKISTAN back on 5 September 2023.
    We give Embassy 1099 of 2021 & 2022 income is above poverty guidelines of the USCIS under 125% for 2 Household members.

I received a RFE for form i-485 in form i864. i needs your advice. my Petitioner is my husband, his total income is exceeding the poverty line, but he was repatriated during the period from may 2018 to August 2023 and for that his tax return in total income is cero or negative. he works for a USA company and he presented form 2555 for foreign earned income in 2020, 2021, 2022. how can a fixes that? can i send a letter explaining the situacion.     I am currently a college student and I need a joint sponsor. The sponsor that I have available made way over the minimum requirement 2022 and will make enough this year, however they did not make enough 2021 or 2022. They are an independent contractor (uber driver) but have all of their 1099s and tax returns etc. Are they able to be my sponsor or will I have to look for someone else?

    I applied for my spouse and child, i had little income in 2022 so i had to ask for a joint sponsor who has 3 children, UCIS told me that the income of both of us is not enough to sponsor your wife & child so you will have to prove to the consuler during the interview that you are making enough money now. in 2023 i am making enough money to sponsor my spouse and wife, in this case do i need the joint sponsor or just ignore his tax returns?

      Current income also matters. It’s a good idea to have a co-sponsor in mind if they have questions about the stability of your income.

    My joint sponsor I filed for year 2021 made enough income, but for this year taxes 2022 it is below the poverty guidelines $37,500. Is it ok to change my joint-sponser to a new joint sponser?

    Hi, so let's say my Adjusted income was $8,000 because of the pandemic. but my current year's income
    will be $50,000 for 3 dependents. Will they care about the tax income or $50,000 more? Also, do I put the annual income after tax paystub or without tax deduction from paystub?

    If trying to sponsor two people ( parents ) would the house hold number increase to +2 or 1 ? Sense each would have there own application?

      You are correct, if you are currently alone in your household and petitioning your parents (mom and dad) then you will add 2 people, equals 3. and yes, each will have its own application which means $535 for each filing.

    What about if both the main sponsor and the join sponsor did not made enough for 2021 , but together is more than enough to qualify . can the income be combined to qualify ?

      Assets are optional and in reality USCIS/NVC doesn’t like assets anyway. They want to see income / tax amount listed.

      @@vivinxxi although USCIS only requires to provide proof for only the most recent year, you must still write complete information about taxes for all 3 years in those parts of the form.

    Hello, i hope i can get a response.
    My husband didnt file taxes for the last 3 years and we’re fixing it now. His current job (he started last Feb) pays above the threshold but you mentioned uscis wont look into it but will look into the previous year where my husband was way below the threshold.
    Can i add my income?
    I am working from home for a UK company tho. I dont pay tax here as i do not have TIN or Social.
    I believe i need to fill out i864a if i will include myself.

      if you are the beneficiary do not include your income from the UK. It won't count. I highly recommend getting a joint sponsor.

      I agree with this response ^ unless the late-filed taxes show the amounts necessary to sponsor even if they are filed late.

    We are about to file Form I-485, three months after we filed Form I-130. But I am here in the US on a B2 Visa. My I-94 is about to expire (in early july 2023). I wonder if I need to file for an extension of my I-94, or just do nothing and wait for my adjustment of Status is approved? What would happen if I go into a Visa Overstay situation, which is very likely I will? What do you think? Thank you very much!!
