    EXCLUSIVE: Baby Reindeer‘s real-life Martha appears to be making good on her promise to sue Netflix, but has yet to hear from the streamer despite being identified against her wishes and claiming to have received death threats and unwanted attention.
    Chris Daw KC, a barrister working with Fiona Harvey to build a lawsuit, told Deadline that Netflix had failed to contact her in any capacity after she was thrust into the media spotlight last month.
    He said the series, which has amassed more than 65M views since premiering, raised serious questions about Netflix’s duty of care standards. He called for a “major review” of its compliance procedures.

That month, an unnamed woman who was outed on social media as "the real Martha Scott" told the Daily Mail she was considering taking legal action against Gadd and Netflix for the harassment she has faced as a result of viewers trying to track her down.
    On Wednesday, Morgan revealed he had interviewed Fiona Harvey, believed to be the woman first interviewed by the Daily Mail. The interview will be released Thursday at 3pm ET on Morgan's CZcams channel, Piers Morgan Uncensored.

      Right! SHE revealed herself to be an outright liar to the world. She lied sooo many times in the piers Morgan interview. How does it make sense to sue somebody about a movie saying it wasn't you and the only person saying it was YOU is YOU while giving evidence against YOURSELF that you emailed him, sent a letter and called him yet you didn't have his number and only left one vmail.       Thank you! She stopped being a victim when SHE decided to claim herself as Martha. If she was getting threats from the public. She needs to sue the public lol
      If she was a victim, she would have gone to the police and contacted Netflix behind the scenes with the evidence she’s being harassed.
      BUT NO
      She decided to go to known publications, go on an interview with Piers Morgan (who exploited her more than any show or Gadd did. Argue with yourselves in the comments lol) and SHE said it WASN’T HER!… What is the lawsuit?! 🧐
      She wanted attention. She’s got it. I hope she gets the help she so desperately needs as does Richard. He’s entitled to tell HIS story!

    I don't feel sorry for Fiona, even if Netflix & Richard Gadd haven't done the right thing. The reason I say this is because she lies in her interviews. One minute she says that she never had a reindeer toy, like never ever ever, and then later on she says that she did have a reindeer toy. Which one is is, because both statements can't be true. Its the same with saying she never emailed him and didn't have his email address and never sent him letters and never had his real address, but later trips herself up and admits she did have both his email & real address. So I don't think her lawsuit will go anywhere, and I think she is just trying to profit off her crime.

      Based upon what I have read or seen so far I do believe that Netflix in this instance have overstepped the mark and this wouldn't be the first time that Netflix states something is true and it turns out that it isn't. Considering we pay a fee to Netflix for content, we have the right to legitimate content where there is a claim that it's fact

    1) No one knew who the real life Martha was until Fiona admitted she was. 2) This lawsuit could be seen as her victimizing Gadd once again. 3) This lawsuit is coming off as a cash grab attempt on her part since she never once went after Gadd or anyone else when he was doing his one man shows & depicting "Martha". She saw that Netflix picked it up & probably thought she could easily get a couple million out of them

    I need to say, if this was a series made the other way around and the entire thing was based around a woman's story and how she was stalked by a man, absolutely no one would be losing their stuff, sticking up for her and constantly questioning richard gadd and accusing him. Yes it's shocking the way her identity was really not hidden, an idiot could have found her but as I said no one would talk positively or respectfully of the man if it were the other way around.       Still if she got death threats (which I doubt) she is still a human being. She still have rights. She won’t get 1M£ from Netflix because either way Netflix didn’t point her as Martha Scott. And because she lies and conter her own words. But she still have rights. We saw it with Amber Heard. She got a case and her lies were proven. It’s not up to us to decide if she’s indeed lying. There has to be a case to legally claim that she is in fact lying. We’re not Batman neither Captain America or whatever hero to do Justice with our hands. There has to be a case to prove her lies.

    My theory is that Richard Gadd must have a mountain of evidence against her - if so, that would explain why Netflix was confident in deeming the series to be a "true story." If he kept and catalogued ALL of that evidence as his character Donny did in the TV show, it will come up in court. I'll be munching on my popcorn as I follow the developments in the court case. 🍿

    I have to add one thing I didn't hear discussed... I have a stalker and the one thing the police told me was since all the proof was on the net or text messages I couldn't charge the person who I knew was doing it because he could claim someone else did it or 'phone was stolen' maybe that's why she hasn't been In trouble for what she's done...       This is just another example of the many protections for the perpetrator and not the victim. Her being found out I s possibly the worst thing that could have happened. It all just emphasizes what side the law and really society on the whole is on. I’m 60 and I have never heard of a show being held to standard of a documentary. I feel for Richard Gadd because he likely wrote his performances as a way to heal, and a way to also help other victims in showing they’re not alone. But I’m seeing catharsis is dangerous. We have to ensure that we protect the person who hurt us. It’s a difficult thing to realize and I pray that this isn’t a ploy to pull him back in. It’s offensive to every person who has been through this type of thing.

    Singapore has alot of this, mostly hospitality school, diploma and advance diploma courses. They have a physical school and u have to go to school at least 3x a week 2hrs a day.     A drama CONVENTION is to add 'true story' when starting a show. Netflix is covered because they have a disclaimer at the end - 'based on a true story'.
    FARGO, 1996 movie by the Coen brothers. In the first frames, white text over black backdrop:
    “This is a true story. The events depicted in this film took place in Minnesota in 1987. At the request of the survivors, the names have been changed. Out of respect for the dead, the rest has been told exactly as it occurred"
    The movie is not true! The Coen brothers have stated in many interviews that it is not true, they wanted to set a specific tone - however there are some scenes with the wood chipper that actually true.They added they based their script on an actual criminal event, but wrote a fictional story around it.
    Richard Gadd had every right to write his story from his trauma ... he never said it was a Documentary.
    Fiona would have to prove she is the character by revealing all the abusuve things she's done - which she's not been clear about. Then she'd have to prove, as the stalking abuser of Richard, she is now the victim wanting anonymity by outing herself.

    I just don't see other than the fact that UK may have different laws and precedents as to how this would be a possible Victorious case. I also wonder if she manages to win this what type of precedent will that set for any platform that has already platforms other people's lives without their permission or their consideration! There are a lot of actual documentaries, not seriously based on a true story, that are on these platforms that are about people's lives and these people not only did not give their consent but they weren't even contacted! Could this possibly open the door for future litigation? I also can't even imagine how bad the poor guy in the series must feel. Especially if everything happens the way that it's depicted in the series. I just can't even imagine the pain he must be going through not only because of what happens that we do know about and don't know about, but to sit back and see that people are rallying around her to support her lawsuit against Netflix based on her feelings and defamation! I just couldn't imagine having something like that happened to me and then people try to protect the person that did this to me! I just can't even imagine the type of pain he must be feeling! Or the rage

    Tbh, ive never known there to be any protection of anonymity if theres been a criminal conviction so if she has been convicted as claimed then she probably doesnt have a leg to stand on.

    I was watching a video about this on CZcams where some experts say that in the beginning of the series it says its a real story but in the end of the series netflix says it's based on real life events. Would that make a difference? No one really watches the end credits. Has anyone noticed this in the end credits?? They also mentioned that Richard Gadd has said himself that the series have been tweaked here and there. And thought that he was talking about the convictions

    So if it says a true story. They do that all the time. The characters name is not true. You gotta change things. But if it’s not the real name in a true story, does that mean it’s not a true story? Come on. Fiona is a crazy stalker no matter what little details are not true. His main story of things he went through is obviously pretty close to the truth. She has no case.

    Well if what was alleged in the series is true she has alot to explain. Well weren't her social media accounts public? If you put things on a public platforms becareful what you write. However I do agree that maybe her identity has been identifiable, yet maybe Netflix believe they did their best and followed rules and without intent. This will be an interesting case to watch.

    How could Richard Gadd set her up by voice recording her 300 or more times as voice messages apparently sent to him? Then she said she had only met him 5-6 times. She contradicted herself so many times on her Piers Morgan interview. She is not the victim here.

      @jimmyhyun8546 he hasn't yet but I'm sure he will have to when it goes to court. She didn't deny him having 300 messages she said he'd probably recorded her on a dicta phone. No denials of him having that many just excuses of why he may have. Still how could he have recorded her that many times when she said she'd only met him 5-6. Doesn't ring true to me at all.

      They state it's a True Story but locations dialogue (and in particular) INCIDENTS have been Fictionalized for dramatic purposes. Basically this really happened to him but certain events were Fictionalized.

      So what? The Fargo TV series also starts every episode stating "This is a true story" even though it obviously isn't. As long as Netflix put a legal disclaimer in the credits (which they did) there is no case.

      @tracy3418 yes I did and the disclaimer is there. "The program is based on real events however: certain characters, names, incidents, dialogue and locations have been Fictionalized for dramatic purposes. Ass covered I believe

      For sure. It's the most terrifying feeling..turns ones whole life in to something of an alternate universe. I lived through nearly three yrs of it.. So terrible i still have gaps in my memory from that time due to the stress/trauma. Worst of all, as police would not take me seriously in any way, i went to a psychologist because i HAD to speak to someone..and what do you know, next i was diagnosed ( after ONE visit) with some sort of paranoia syndrome..
      Seriously, being a victim of crap so undeserved and people not believing you is enough to drive anyone around the bend.

    In all honesty, good for her. Not that I belive her or think she would win (or deserve to win) but because I think its important that in the public eye its shown that Netflix isn't taking the care they need.
    There is no difference between what netflix did to her and what they did with Andy. They are so quick to churn out something they don't take a step back to consider if they should or if its legal.

    The man has said, multiple times and it’s documented- that the story was elaborated or exaggerated for affect….. it has been stated that and it’s obvious some of it isn’t true but this woman is focused solely on what she DIDNT do and not all the sick crap- like lady sit down already bc just bc you are just less of a toxic psychotic stalker than portrayed doesn’t make it better.     If she was a he it would be a very different discussion. She has the opportunity to clear her name but has not produced any evidence yet. If she did everything she's depicted of she's a danger in society. Both men and women need to be held accountable for thier actions. We need more rehabilitation for offenders mentally unwell.

    Obviously she intends Netflix to settle rather than go to trial and set precedent with a ruling. Her attorney will get a nice fee and she will have enough for a nice retirement fund. I think Netflix didn't do errors and omissions. The show would have insurance if that happened - industry standard. She has a right to personal privacy. Expect settlement with NDA.
