  • Corrupt Irish Gardaí breaking multiple laws. They stopped me and tried to profile me for no reason. Then he came up with the "ongoing criminal investigation" excuse and tells me I can be arrested for refusing to give details even though the Spunout websites states 'In order to be arrested, the Gardaí must have a reasonable suspicion (this is a specific legal term) that you have broken the law. You can’t be arrested just because they believe you could help with another criminal investigation, unless the criminal investigation is to do with an offence under 'The Offences Against The State Act'.
    One of the guards then tells me to put my hands out without giving any reason for detaining me and as I was trying to put my phone in my pocket he rips it out of my hand and turns off the recording. At 1:56 and 2:13 minutes into the video you can hear the other guard mention that I've just started recording after they explained everything which was complete lies and the reason he said it was because he thought his clown buddy deleted the footage I had from when he grabbed my phone.
    Two minutes later they decide to detain me under section 23 misuse of drugs act with zero reasonable cause. Funny enough he only detained me when the phone was turned off , that's why I kept asking him why I was being detained, telling him I didn't understand and he was refusing to tell me because he knew the phone was back on and that threw the whole 'ongoing criminal investigation' bullshit out the window. Also refused to provide a badge number / identification when asked. A corrupt power trip of the finest order.
    I know I should have tried to remain calm but its easier said than done. I have no problem complying with guards that act professionally and carry out their duty how they're suppose too. I'm not a scumbag, I've never been in trouble with the guards. I have rights and they are there to be used, not abused.
    Look at the head of the fella on the left aswell. He looks like someone after coming down off cocaine the night before hand the eyes were hanging out of his head. He clearly has some serious problems going on in his personal life.

      Well I know somebody from Morocco who lives in Dublin. He was stopped on the street. Gardai asked for his name and proof of ID. He gave it and Guard was extremely nice and thanked him for his cooperation. Why not just give your name. Leave in Dry Cleaning you give your name and phone no. Could be anybody working in the cleaners!!

    In Ireland we absolutely do not have to identify ourselves unless you are about to or are in the act of committing a crime. Fintan O’Toole of the Irish Times also wrote about this.

      Maybe it says that on paper somewhere, but that is not the reality in practice.
      If you refuse to give your name and address you will be arrested. All they have to do is say, I got a call about a suspicious person matching your description or some other made up stuff, if you refuse you will be arrested.
      Look at the behavior of these two guards. Where having a consentational conversation now give me your name? You refuse? Well your detained, but we can't disclose the criminal reason why your being detained.
      And they want to ban filming of the gardai and not have them have bodycams, madness.

      i was at a function some time back,i over heard an off duty garda say 'the only place you can give a lad few clouts is in a garda cell' because of all the live streaming,a very sad situation if that is the case,granted this chappy had a few drinks on board,was the norm until recent times if a youngster gave out guff,taken to the station on the pretence of a drug search and roughed up,posted this about a year back it was taken down recently

      @Brian the vast majority do an excellent job in Ireland in my view and they do it without any weapons and no big money wages. They are underpaid, understaffed, underfunded, underappreciated and legally uninformed on how to do their jobs and people wonder why they might get pissed off??Performance wise its impossible to soar like an eagle if you are being led by a budgie.Government is a deaf budgie and needs to get the finger out and make it a more attractive and rewarding profession. Just my own opinion.

    You have to give your name to a garda IF they suspect you of committing an offence. So while they might refuse to tell you the crime"they say are investigating, you can ask them to confirm that you look, sound & are dressed similarly to the suspect they are looking for. If they say yes & you refuse, you can be arrested. But if you make a complaint about being arrested while going about your legal business, you could find out did you look like the person they were looking for. If not, you have grounds for your complaint of harassing a law abiding citizen.

    What this man should have done is phoned the local Garda station and stated two men have stopped him in the street claiming to be Garda.
    They haven't identified themselves and have no visible identification.
    They have not told him what crime he has committed and he should demand that the Super be present or he's leaving.

    There's a park in Cork, the woman's walk or something, just beside the skateboard park, there is a little bit of a wood right beside the bridge.. For the past year of so there are phentanyl addicts dealing openly there. They buy their stuff from a guy who sits under a pedestrian bridge. Now they started approaching people. Or when they are all stoned they fall asleep on top of each other. There's no garda trying to take their names. Wonder why?
