    One should always report it and if you have a witness try to get a written statement. The company doesn’t care . The employee is the only loser In the long run . Don’t be intimidated. File it .’

    I am in Texas and I hurt my back at work lifting a box (Lumbar strain) and I notified my supervisor within the hour of my injury. He did an injury report and all he asked me was "What are you going to do now" and I replied that I was going to go home and put some Icy hot or something on my back and see how I felt from there. The following day the HR lady sent me to go see their doctor and I was drug tested given a shot, they took X-rays, prescribed me medications and scheduled me for therapy sessions. A few days later I get a call from the insurance company saying that I failed the drug test (THC) and that they were denying my claim due to intoxication at the time of my injury (which is false). I did not lose my job because my employer offered me a second chance agreement which included counseling and random drug testing for two years. Then my employer started drug testing me every month and a half after that and a few months later I was terminated because they said that I gave them water in one of my samples. I was left injured and now am unemployed, it felt like they wanted to get rid of me and they found a way to do it. Sad to say the least.

      I am sorry to hear this. Texas has a very different system so I would recommend trying to find an attorney there who handles these kind of cases.

      After you find an attorney for wc ask that attorney to recommend a employment law attorney and see if you have a wrongful termination case .

    Can you do a video of how companies have the ability to turn people that live around claimants can actually cause claimants distress by constant agitations and stalking

      Are you talking about surveillance? I should do a video about that!

      @@KaplanMorrellLaw I would think so. Because I’m my opinion it seems they can gather help from the people that live around you “claimant”. I’m just speaking on personal experience. I’ve had way too many people throughout this entire duration looming over my home in many different ways.

    I got injured at work.reported to supervisor next day after being fully awared of my injured he didn't take any note nor report. Next week I reported it again he did a report. And I got a warning and they took my bonus away for late report policy. I told them I reported it next day and supervisor didn't do his job. What can I do?

    • @KaplanMorrellLaw
      @KaplanMorrellLaw  Před rokem +1

      As always it depends. In some jurisdictions the loss of the bonus might be viewed as retaliatory so you should consult an attorney on it.

      I was told to use my PTO and vacation time to rest. I had no clue about workmans comp. I called my higher up boss and she immediately said call this number right now. I lost 8 weeks of lost wages bc she didn’t report it. It’s 6 months later and I’m still in pain. This system is a nightmare!! I also immediately called an attorney bc things were not adding up. People are so shady!! Did you call an attorney?
