This one hits so close to home! I thought they cared about me and that I would have a job to come back to! This is not the case and with workers comp you find out the true colors of the adjusters as well as your employer.
Mr. Kassem and Ms. Ramirez I have an attorney and my work comp case is nearly celebrating 7 years. I will confess I have nearly lost my patience with the system but my attorney reminds me that my case is quite complicated. (knee, hip, back injuries') I've watched many of your pod casts and I have learned so very much about the system. I've made all my QME appts. and I have experienced a lengthy deposition. I greatly appreciate all you two share with us injured workers. It is my hope that my case will settle before it's 8th birthday. Thank you very much.
Thank you, we understand very well the frustration that can come up when fighting the workers' comp system. Honestly sometimes patience is key in some cases. We appreciate your comment and are very grateful that our content is being watched. Best of luck to you in your case and hopefully the new birthday celebrations will be to celebrate the number of years since you've settled.
my adjuster called me the day before my doctor appointment to see if I will attend. I had no knowledge of the appointment, and it was 200+ miles away, so I told her that I will call my attorney at pacific attorney at law and discuss how I can get the appointment closer to me, the adjuster told me JUST DONT GO, COULD YOU BELIVE THAT? With the help of my attorney i was able to take care of it.
Thanks so much for bringing up these topics in regards to CA Workers Compensation. I broke my left thumb at work in a forklift accident last year and it's been a rollercoaster of emotions and confusion regarding everything about the injury and workers compensation. I decided to lawyer up before I got MMI so currently going through that process.
Hi Luis, yes it is very complicated and we totally understand the rollercoaster of emotions and confusion. Glad you got the help you needed. Best of luck and thanks for watching!
Also, can you guys cover how a settlement with multiple body parts are involved. For example the back, leg, and foot are all involved in the work injury and you've have surgery on the ankle and two surgeries on the back. Including a lumbar fusion three levels and a disc. Also a surgery burning nerve endings off the disc.
The best advice in this video is educate yourself as to the workings of your states workman's comp system .Your attorney works for you and not you for them. The injured worker is the ultimate decision maker in many aspects of the entire process.
What if you hire a law firm but never EVER have spoken to an actual lawyer only to one case manager after another , I think they have changed my case manager 6 times within these two years. Is that a red flag?
Sometimes the attorney is working behind the scenes but just because you have not talked to them doesn't mean they are not on top of your case. It is weird that they've never spoken to you. Case Managers change all the time unfortunately, as long as your case is being moved forward and you feel they are helping you out, it's not a bad idea to communicate these concerns and request to actually speak to an attorney. :)
My provider just told me to request assistance for my case. I am receiving in good faith permanent payment at 580 every other week. But they are denying any more medical services including an evaluation with a spine specialist. I have multiple issues on my cervical and back area. My doctor is suggesting social security permanente disability. How can I talk to you
Hi sweetheart. So true Specially me being injured on my neck and back and feet . And have to drive far away and plus monetary It’s so inhuman and sad Risking the person into getting into a car accident Edy kind of you . You are amazon Wow So kind 🙏♥️
If you took MRIs for all the body parts injured ,and Drs said you need surgery, and you don't want to have surgery , as in my case adjuster stopped my benefits for saying no to surgery , I know now that the Dr I have been sent to favors and works with insurance company. This is very unfair. Why would this be allowed ? I had already been denied medical attention for this one body part and won the argument about what they claimed why they weren't helping me . They are very tricky.
I have two different injury dates one of these dates were denied and went to court and I was awarded compensation for the first date, however the Dr STILL HAS NOT TREATED ME for that injury only for another injury that he was trying to do surgery on and I said no so they stopped award given for other part that they didn't even treat. The other date has not even been addressed. Both Injuries happened two years ago ,two days apart . And I'm seeing that they are mixing up these two dates and treating all of injuries with one Dr is confusing to their benefit.
I have a lawyer I feel is not doing what they are suppose to. They never answer me until two weeks sometimes more. I feel that they are not even on my side anymore :( by the way they speak to me always making excuses to get back to me and never do.
I have a w/c case for a torn meniscus and the claim took a year to get accepted during that time my lower back was affected bc of my off gait. We amended my claim to include the back. During my case my employer has filed for bankruptcy and has stopped payment on my TD paymentd and r no longer paying me. I have applied for SDI and they won’t pay me bc they say that the w/c ins co. Is to pay me. I have an ame in October but what do I do in the meantime to get money to live on and pay my rent and bills. I am so far in debt now. All this has caused me great stress and anxiety leading to my depression so my PCP has put me on an anti-depressant.
Hey! I really enjoy your videos. I'm a subscriber to your channel. Can you guys cover spine surgeries including lumbar fusions Spine related settlements. Also late payments 30 days after stipulation award at workers compensation court, filing for penalties.
What happens when the insurance carrier (ICW) didn’t send in prior authorizations and I had appointments cancelled, therefor getting my workman’s comp payments stopped because it was over six weeks to reschedule?
Lastly, if you would like to do a video on a injured worker, I wouldn't mind doing a zoom video or something. I've been involved in with workers comp for about eight years now. I'm 33 years old, been injured since 26. Also, I actually study workers comp to help me in court and decisions. Example your videos. I'm 10 and 1 in workers comp Court. I've had three surgeries and have also tried to return to work four times. Also had a job change in the middle. Message me if you want to set up something or talk.
My injury was 10-27- 07,I have a tbi, tramatic brain injury, witch iam slower now and week over all,and a autoimmune dessi, can u help me,they keep trying to stop treatment, and not pay
Unfortunately, we do not practice in Texas. Sorry to hear you are having a tough time with workers' comp, it seems to be status quo regardless of the state you're in! We wish you the best and hopefully things turn around for you. If you are in search of a lawyer, I would recommend contacting your local county bar association or searching on places like Avvo, or Google, and looking at reviews. Consultations with lawyers in your area should be free. Ask a lot of questions and make sure you are comfortable!
You don't have to like your lawyer, as long as they are putting in the work and getting you a great result, that's all that should matter. Also, it's never too late to get another lawyer.
My opinion just chiming in, I would stick it out with the lawyer you’re not too happy with. If I were you I would read up and essentially become your own legal assistant so you can point out any information you think your lawyer is not paying attention too. I say that because if you do switch attorneys, that means the two attorneys will have to split the fee between the two of them. There’s no additional fee for the second attorney. Will your new attorney give it everything that they have to work your case for a smaller percentage of the fee? Good luck tho. Claimants are targets for negligence in these situations

7 years?? man. I'm barely 5 months in for a complete torn bicep and arm issues on my right side. Post-op

If you are fired, while on worker comp and have gotten to the point where you cannot work, should they pay you since you were hurt at work?
▶️Great information, & well presented, thank you! 💫
I have experienced this phenomenon and I believe Not being pro active is a psychological affect of depression.

You got it! Happy to cover these topics.

Penalties and Sanctions! You can hold them accountable for their actions. Get a lawyer!

Hello, this is my first time here.
Welcome!
Has it really been going 6 years? 😣 what can I expect, or does my lawyer need from me or do they need to do if my state has no bad faith laws?
It's just the system sometimes. We wish you the best of luck.
Do u handle Texas workers compensation

Do you know any attorney’s in Texas that can help me?
Have you tried Zimmerman or Sandoval?
Are we allowed to make podcasts while on workers comp? I live in New York btw
Hi Fabian, thanks for reaching out. It depends, but If you do decide to do one, send us a link so we can share! Happy New Year - Bilal and Carmen

I have my tp payments stop because I left the country for due to an emergency
Tp payments? If you mean TD payments it's likely they didn't have a current medical report finding work restrictions or TTD.
