Can I insist on working my notice period? [LBC Legal Hour]

  • Vicky's daughter has been told not to work her notice period because a replacement has already been found. But this leaves her £900 out of pocket. Can her employer do this?

    The title is misleading.
    She has no right to work her notice period, that’s up to the employer. But she has the right to be paid throughout the notice period.

    simple answer to Can I insist on working my notice period is no, you can't insist on working your notice period, but the employer still has to pay you for the contracted hours of that period.

    If she has 2 years’ service - unfair dismissal claim? No compensatory award but at least a basic award.
