    The simple bottom line is if Bev did her job and ASKED them if they were hung on ALL the charges or just some of them, this would have been avoided. She didn’t do her job. She was blinded by biased and her “I was tired” 😂

      Bev was a digrace to the profession. Biased, personalizing her tiredness, favouring lally, allowing lally 56 useless irrelevant incompetent lying witnessess to put the jury jnto a tired stupor, and she CONFUSED THE JURY WITH CONFUSING INSTRUCTIONS AND CONFUSING JUROR PAPERS.
      Bev caused the mistrial.

    I love the idea of pro bono work for people unable to qualify for gov aid but still unable to afford private lawyers. I grew up really poor and many things were harder as we began to earn more money as we no longer qualified for help despite still needing it.

    The people saying that the defense team should've asked to poll the jury on the charges, as far as I'm aware, the judge should've done that as part of her job before declaring the mistrial.

      The judge’s job is to protect the record and I’m not so sure she did that here. Even if that were to only confirm that they were hung on all charges. Had she done that, there would be no question about the result.

    The jury was so confused. They couldn’t even tell Brian Albert from Brian Higgins it seems. Between Lally’s endless word salad and bev’s lengthy and confusing instructions, not to mention no transcripts were provided, is it any wonder they were confused?

      It wasn’t necessarily the juror who confused the two men. Remember this is an account by someone (informant) who was told by and intermediary what the juror said.
      So the mistake could be by the intermediary or even the informant

But in Florida if any juror requests to have a transcript of trial testimony, the court must inform the jury that transcripts are not available but that they can request a readback or playback of testimony, which request may or may not be granted at the court's discretion.

      @@annm9589 from what I’ve seen on lawtube, lots of things are done differently in MA. The jury just seemed really confused, and the judge seemed like the whole case was an inconvenience to her (“get this over with” “I’m tired” etc.). Anyway, my main point is that since transcripts are not provided, it seems Lally’s method is to inundate the jury with words and names and dial tone droning on and on so that information gets lost and leaves the jury confused. I’m sure this isn’t the first time he’s used this technique. Not a very skilled ADA in my opinion. Just a recipe for disaster.

      Hopefully yes, but realistically it really depends on the jurors in question, whether they're even aware of the filing, and whether they interpret this as "we'll be contacted if it's appropriate anyway" or as a "we better be heard, so to avoid it being dismissed I'll contact them to see if it'd help".

    With Proctor now suspended without pay based on his actions during the investigation of this case, I really can't imagine what the cross examination in a retrial would look like.

    It is possible the jury believe she didn't hit him with her SUV, but they would like to convict her on driving intoxicated, a reckless behaviour that can be a danger to anyone.

    Who saw the jury slip? Did they mark nothing on it? How do we know? Isn't it the responsibility of the hand-picked jury foreman to fill it out?

      Do we know if she even accepted the jury slip? Or instructed the jury that they must complete any portions that they were able to? Or did she just look at the note which mentioned they were hung, assume that they were hung on all counts (*giving her the benefit of the doubt vs. knowing otherwise), not even ask a single question about that nor allow either side to do so, and dismiss them? I don't know what happened but I did expect that after a few centuries of experience with our jury system, she ought to have known how to conduct it in such a manner that no after-the-fact ambiguity was possible.

      @@brucedklein I don't believe that there's any confirmation whether they filled it out and I wouldn't be surprised if they didn't want to touch it until their decision was final across the board. But I also think that the jury didn't know that it was an option to acquit on some charges, as their notes to the court didn't indicate that they were only hung up on one. In hindsight, I think it would have been a good idea for the judge to ask that the second time, or the jury could have said 'we are ready and able to deliver a partial verdict.' It's tricky either way I think but it could be avoided if it were addressed in the freakin jury instructions.

      So what I'm trying to figure out is how they're deadlocked on two or more charges while also acquitting her on two charges when she's only charged with three crimes.
      It literally doesn't add up.

Half of us have come so far, and the other half have plummeted backwards - they've lost the ability to reason, to change their minds, to identify their own biases, to consider alternate perspectives, and to truly empathize with others.       In Ireland the protection from double jeopardy re conviction and also sentence has been taken away. It wasn't ever in our constitution and so yet another right was just removed for political expediency. That said the sentences in Ireland are much less draconian than US ones. Also prisoners have fewer rights removed, for example the right to vote.

      ​​@@eammbutler1323 I just want to point out we never had double jeopardy as a right here. Really it wasn't until 2008 that we had an SC ruling on how many times a case could be retried.
      However, if a finding of not guilty is put forward by a jury, it cannot be appealed by the DPP - in a deadlock / no verdict a second trial can be heard.
      Sentencing has always been appealable by both sides. Double jeopardy applies only to a conviction and not to a sentence - and in Ireland it hasn't ever really applied at all outside of some offence specific statutes (eg criminal law (secual offences) acts.)

    As of now, we don't know whether the "NG" was checked off on any forms or not.
    Jackson asked for there to be both "G" & "Ng" boxes next to each charge & each lesser included - which Bev denied. Ultimately, the forms weren't clear, and neither was the jury note. Otherwise, this wouldn't be happening now.
    Bev should've asked which counts they were hung on, for clarity, rather than assuming it was all of them. Everyone watching expected her to ask. The defense also expected her to, and before they could ask, Bev had hurriedly concluded the proceedings. Because of her failure to ask, all 12 jurors should now have to confirm their votes on the record.
    Personally, I would've indicated that we were hung on 1 charge if I'd written the jury note, but Karen still deserves any acquittals the negligent foreperson failed to mention in the final note.

    One exception to double jeopardy in the US is civilian and military courts (for military personnel) - see Eastburn murders - ft Bragg as 1 example

      @-c3202 very fair! Though I think the fact that it got more than 1 degree of separation from the juror is concerning. If I tell a friend a piece of information and they go telling another friend, then I have lost control over that info. We know of the communication to the lawyer, we don't know how much farther their identity has spread

      @@animal_cookie also very fair! Juror A and Juror....I think it was B? concern me less than the one where the intermediary is relaying everything to the informant. Though also the juror is having Zoom meetings talking about their experience and we don't know how exclusively they chose participants in that (just close friends/family? wider social circle?), so it's hard to know exactly how much the juror cares about their identity being known without more info

    Caught the VoD. It's great to hear your perspective. And, to compare it to Emily, Peter & Dad, and Lee.
    I think on Day 31 when the Judge read the jury instructions, the impression is given that thenjury form is only filled out after a unanimous decision on all charges . This lead to an option where guilty/not guilty verdicts on some charges and mistrial on others was not an option.

    Dear Runkle of the Bailey, hearing about your plan to work pro bono makes me so incredibly happy! Wonderful. Unfortunately, there will always be a screaming need for pro bono attorneys so I salute your choice. The day I climb out of my abyss of debt and hopefully one day have a divorce agreement honored, I will happily kick in for that.

    Just looked up the Captain Kori book and came across the “other” one… all of the reviews mention “endorsed by Pixie/Kori’s mom” in some way or another and that POS has apparently gotten all the negative reviews taken down by Amazon somehow. If Pixie is against this book, those reviews and the blurb describing the book as having the “advanced knowledge and permission” of Kori and Pixie needs to be removed too. Imagine taking advantage of a child who passed… I could never.

      They didn't turn in any paper work - normally the Judge reads each Charge and result. They don't have to poll each Juror but they always ask the foreperson if the form is correct on each count . P & D can't ask for polling on a hung count but MUST be allowed to ask for polling of the Jury on each non-hung count. P&D were not given that option as required.
      In most States the Judge MUST declare a mistrial on each count and that requires a affidavit or fact from the Jury that one has occured on each count. Can't be verbal or a "note" from the Jury.

    I just got to the part where someone commented that they are going to cancel their membership because Runkle has too extreme views on anti monarchy. And lol, Runkle had the least extreme take on monarchy I have heard. Spend 1 day in Ireland, you'll hear some unsavory shit about the king and the monarchy in general.

      @thatssewjessica I know very little and care very little about the monarchy, but just the death of the queen was enough to show that it's still a big thing and some people really still love the monarchy. People were driving hours to be at the path where they drove her around the UK. I think it's mostly the older generations that think it's great and like Runkle said the Queen was probably more liked than the king is and the rest of the family. And I get not wanting to pay attention to other countries problems when we have our own, but world news is still important at times

    And I still maintain my opinion on jury verdict forms and instructions. They should be written as simple as possible, with simple language and short sentences. Not because juries are dumb but because no one can misinterpret anything if it is clearly written. No one has to be confused because the instructions and forms are such a spaghetti language there's no up or down on them, if it's written simply.

    The jury can't meet up for beers in public to avoid being identified as jurors.
    Zoom meetings are preferable for some as there might be in the group: introverts, non drinkers, those of limited means, those who can't get babysitters.

    The defense argued against speaking objections, not objections followed by the legal reason for the objection.
    This is the only court I’ve ever seen where they have to approach after an objection to state the legal reasoning. It’s ridiculous. What is surprising is that the defense for Baldwin were surprised by this. One would think they watched the other trial and already knew about this and wouldn’t be surprised by this nonsense.

      The speaking objections were bad in the Hannah g case, that she had them approach the bench every time. If he instead of filing a motion about another case (which is so odd) and just used his remedy to object he likely would have gotten what he wanted. Instead she slapped him back so hard with approach the bench. Be careful what you ask for.

    Ian, I get that judges makes mistakes and can’t be punished for every little thing. But KR’s freedom hangs in the balance. Bev may not be reprimanded, but she certainly needs to investigate the messages the defense received and then act accordingly and clean up her mess. How in the world did a judge NOT have the jury write SOMETHING on the verdict forms stating that they were a hung jury or which charges they’d been able to come to a collective guilty or not guilty. Her “We’ve always done it this way” is out of touch and reeks of her ego getting in the way. I’m appalled!

      @@meln4214 They are never going to reveal the names of the jurors. The jurors can reveal themselves but the judge thinks in this case it could be dangerous to the jurors to reveal their identities. Think about the number of cops involved in this case.

    Ian talking about people not being able to afford an attorney is one of the scariest things about this trial. KR could be any one of us. Luckily KR and her family were/are able to pay for some of the best attorneys. A lot of us wouldn’t be able to hire attorneys of their caliber.

      I too listened to The Smiths in the 80's as a kid. The sentiments about RF & the Establishment, 80's workers being laid off globally, lies about wealth trickle down effect - impacted us Xgens. However the disdain for the RF has definitely changed since The Smiths songs of 40 yrs ago.
