The Legal Framework of Freedom of Religion in Malaysia

  • As Malaysia's Universal Periodic Review (UPR) draws near, we interviewed and investigated the status of freedom of religion in Malaysia to understand the complexities for the legal framework and public perception when it comes to freedom of religion for all people in Malaysia.
    The Coalition of Malaysian NGOs in the UPR Process (COMANGO) was formed by civil society organisations in 2008 to engage in the Universal Periodic Review (UPR) of the United Nations. It is the biggest rights-based civil society coalition in Malaysia working on the UPR process with 52 member organizations. EMPOWER and Suara Rakyat Malaysia (SUARAM) acts as co-secretariats for COMANGO.

    i feel so sympahetic for ex-muslims in malaysia not being able to express their freedom for fear of the government. we should all be given the choice to follow what we want. the fact that this is even accepted in malaysia is terrible.

      Exactly ! If a muslims want to leave islam then the other muslims get hurt and want to kill that person. They like to mind other peoples business. The worst thing is that the police, Judiciary, religious department and full force of the government machineries get involved and come after you ! And yet the constitution guarantees freedom of religion. But if your a muslim then you are the slave of the government and the religious department.

      @@Pr0fane26 ! I am trying to understand the emotional blackmailing they have to go through ! Being a Non-Muslims it is difficult to understand because Non-Muslims are not bound by laws that compel them to remain in their original faith. For us it like a free human trying to understand a slave's mind and their fears of punishment and torture by their master. In this case the master is the mental slavery the muslims are subject too since the day they are born till grave.

    I remember back then when I was a muslim, the word Comango was such a negative name within my mind and my community i was in. But now I see that Comango is so relevant and is actually doing the necessary works to better our nation and communities.

    The problem is, they know that there are a lot of muslims that only remain muslims because they are scared to leave. If that fear is not there a lot of people would quit the religion and they lose power.

    Had a Muslim girlfriend. Mother said if you want to marry must convert but she wasn’t forcing me but if i don’t I can’t marry her daughter. Never got to marry her but I’m happy. What’s the point of converting if I won’t be a practicing Muslim because I don’t believe. Marriage is between two people who love each other.

    The law doesn't make you a Muslim...it's your conviction that makes you a Muslim. I totally agree with you. It is also true for other faiths. One is a Hindu, Christian, etc because of one's conviction. It's a personal relationship with whoever you beleive in.

      @@NotLikeWhatYouThink The command to kill is not applied forever lol. It's a command applied only at that specific time, place and person. The story was there in the bible for people to learn the history of Christianity. Not to be followed.
      Unlike quran and hadith, it contain verses and command about killing which applied forever. For example, the killing of apostates. Thank God not all muslims follow this command, because deep down they know it's wrong. Since 2000 yrs ago until today, there are muslims who kill apostates.

    Will RUU 355 make people a better Muslim ? Such barbaric law will only make people fear law more than god. This bill does not at all meet the basic tenets of law where its main objective is not about the punishment but to administer justice. This guy does not know what he is talking about. Terrifying people with such harsh law is definitely a great way to control them.

    Yes there is freedom of religion in Malaysia but not so when it comes to Islam which is the religion of the federation.
    A Muslim cannot marry a non Muslim unless the latter converts be it he or she.
    A Muslim leaving Islam is denounced an apostate unlike any other religion.As such a Muslim by faith is a Malay and a Malay is by definition a Muslim.

    The lesson I learned recently was that one religions idea of ‘Justice, Corruption and No Compulsion” is not the same as another religions definition nor even a Liberal’s definition of such. Be very careful when quoting religious texts on “justice”. Justice, as one astute British High Court Justice put it, is “like beauty, it lies in the eyes of the beholder”. As a corollary, being asked to be fair to another may make an ardent religionist feel “oppressed”. That is going to be the tragedy in Malaysia.

    Firstly one should not get confused with the interpretation of the religious laws. If it is from the one and the only true creater than there cannot be more then one interpretation for any law, because different interpretation would render it a man made law and not a divine law. A divine law should only have one interpretation for all time and for everyone alike. If that is not the case then it cannot be devine but instead a man made law. Man made laws to enslave the minds of it's followers to submit without question for the benifits of the elites who become their slave masters. Why should any human being choose to become a slave to anyone let alone a mentle slave to a religious ideology ? Something had gone seriously wrong with Malaysia after 01 january 1997 when Jakim was established under the Prime minister's department.

    Melayu ramai je nakkn kebebasan beragama. Cube kerajaan benarkan benda tu berlaku ramai lah nk tukar IC buang perkataan tu kt JPN dan dlm sistem.. ade apostate malay yg latar belakangnya beragama termasuk family dia. Ade yg pernah sekolah kt tahfiz, ade yg pernah belaja kt university islam tetap ade juga murtad.. zaman semakin moden manusia mule mempersoalkn kewujudan agama dan tuhan ni adekalah benar atau tidak.budak2 yg belaja kt tahfiz pon kebanyakn masuk pon sbb mak bapak pakse sejujurnya dorg taknk pon masuk ade yg mempersoalkan lagi agama sendiri adalah.aku sendiri pernah jumpe lepak dgn budak2 ni. 25% org muslim keluar berlaku diseluruh dunia dan setiap tahun makin ramai. Tengok arab tu dah mule menunjukkn mereka pon dah mula terbuka dan bebas sikit2. Ade beberape ulamak dunia pon mengakui 25% muslim mule meninggalkn agamanya dan tidak lagi mengamalkannya..
