Malaysia’s top court declares 18 Islamic laws enacted by Kelantan null and void

  • The Federal Court in Malaysia has declared more than a dozen Islamic laws enacted by the state of Kelantan as unconstitutional. This includes criminalising sodomy, incest and the desecration of places of worship. The 8-to-1 decision is seen as a landmark move which could affect similar sharia laws in other parts of the Muslim-majority country. Afifah Ariffin with this report.

    I have a better solution, might as well merge Perlis, Kedah, Terengganu and Kelantan into some kind of New Federation of Caliphates and secede them from Malaysia so that they can build a nation based on whatever syariah law they want, then they will be dubbed the “Afghanistan or Pakistan of Southeast Asia”. Don’t involve the whole Malaysia, we are a multi racial and multi religious country with different beliefs and cultures. Those Malaysians especially the fundamentalist minded Muslims whom don’t like the idea of multicultural or a multireligious identity can move to the newly Islamic Republic of Kelantan or whatever you want to call it.

    Although Islamic law is for Muslims, but that cannot be guaranteed eg kelantan has fined people wearing shorts. It is pas that always stirring issues in malaysia.

      do you even know the content of the laws, sure some of them seems over kill but some of them that is unconstitutional kinda make sense.
      for example - Section 16: Sexual intercourse with a corpse
      - Section 17: Sexual intercourse with a non-human
      - Section 31: Sexual harassment

    As a Muslim, this is not shocking. Some syariah law are too harsh due to misinterpreting Islamic precedence in its historical time. Perhaps the federal court did what was just and non discriminating befitting the current times.

    Malaysia is a secular nation with Islam as the official religion, it is not an Islamic state so its laws must not contradict the Federal Constitution.
    PAS is the Taliban of Malaysia and they want to be more Arabian than the Arabs.

    🙏 Like someone just commented , PAS should tackle their urgent need to supply Clean Drinking Water in Kelantan or Trengganu first! Do not hide incompetency of governance under the vile of religious precepts! After Clean Water problems , we are sure there still will be Monsoon Drainage problems , Electricity , Housings , Schools , controlling rebellious youths from committing crimes & speeding with modified motorcycles on public roads & jobs creation problems to deal with! Looks like PAS has a lot of things they should be focusing on tackling but didn't! PAS is good at focusing on the politicking of stirring up racial tensions & extremized religion for their political & economic agendas that not going down well with many PAS own mismanagement & scandals! 🙏🕯🌏

    The jurisdiction is whether the state legislation has rights to pass the enactment. The Malaysia's constitution clearly states that only the parliament has the rights to do so. The jurisdiction has nothing to do with religion but it has been purposely linked to religion so that they can instigate the people.

    Last time i had a friend who used to joke that Sultan Johor incase of war with Singapore is praying very hard that Singapore's army managed to capture Johor and then Johor become part of Singapore.

    We have the Supreme federal constitution. Any law passed in parliament must be consistent with the federal constitution. Any law passed in parliament even with two-thirds majority if inconsistent against the federal constitution is illegal.

With great respect to All Sides , religious precepts cannot be applied into the Judicial Civic Laws of a Country which must be Fair & Just to All Citizens of that Country! Some Hindus , Buddhists & Sikhs are Vegetarians & some would not eat beef , but they didn't force others of the same Faiths to follow their religious precepts!     In the detailed description, it mentioned that 2 of the Islamic laws followed were also unconstitutional as there is no legal process for that and only accepts the third which can be challenged in court and doesn’t immediately give the Muslim party/ person almost a certain win.
    Either way, it’s the best decision the court has made in a very long time and they should crack down on shariah law until it’s subservient or at a minimum in compliance to common law (I.e take cases with a Muslim man and a non-Muslim woman must go through common law courts, forced conversion of a non-Muslim woman’s children can be considered a guilty sentence without trial in common law and applicable to 50 cans strokes at the crotch with a steel rod)

      Yes they can because the Federal Constitution legislates Criminal Law through the Federal Parliment. The State legislature can enact Family and other non-criminal Islamic Shariah laws for Muslims only.

    The shariah law itself was successfully regulate muslims in Malaysia first decades. Muslim community majority was pleased and safe with shariah. Sodomy, public drinking ,fornication are wrong by sharia law and only for muslims and those non muslims are not bound to this law..but the one who strongly against is non muslims in Malaysia and non-practising muslim.
